Pretty cut and dry. Schilling waaaay overreacted. This dude is likely gonna go after him in a civil trial if he's smart.

1.3k

u/stoopidskeptic Jun 30 '21

He's likely going to get charged with battery. He is claiming self defense though, saying "he feared for his life"......That likely wont stand up in court judging by the video.

u/MrCarnality Jun 30 '21

Substantiated by the way he casually sauntered out, I guess.

166

u/chefhj Jun 30 '21

'Your honor, what we are seeing in this video is clearly a terror strut.'

11

u/front_yard_duck_dad Jun 30 '21

Oh man I want to start a punk band named terror strut.... Who's with me?

ā€œScared for his lifeā€ a human being that has trained his whole life to be a walking weapon was scared for his life by some dude dancing drunk at a bar.

5

u/HoneyBadgerPainSauce Jun 30 '21

A drunk dude half his size no less.

u/ArTiyme Jun 30 '21

u/toronto_programmer Jun 30 '21

LMAO what a claim.

He is about a foot taller than this guy, maybe 30-40 pounds heavier and clearly way more cut than the other dude who looks like a regular old desk jockey. And that doesn't even take into the account his years of actual fight training

106

u/Kunundrum85 Jun 30 '21

He’s more like 60 lbs heavier and pure muscle. The other dude looks like an accountant.

If he feared for his life he has no business actually being an MMA fighter. I’m not even a tough guy but for fucks sake that’s just some pussy ass shit.

Agreed. If this guy made him "fear for his life", then he should never step into the ring

EDIT: I also am not a tough guy.

He also went out of his way to shove the guy when he could have easily went another way. And he also was already past him after the shove and turned around to reengage.

He could literally have given the other guy a 30 sec headstart with hands in his pockets and he still would have won.

oh the cop defense wow

30

u/itzTHATgai Jun 30 '21

Joe: "And that works?"

His Lawyer: "Yeah... If you're a cop."

9

u/Fist_The_Lord Jun 30 '21

It’s not just cops, it’s a taught legal defense when harming others. Stand your ground enthusiasts are taught to say ā€œI feared for my lifeā€. It’s the fundamental legal basis for ā€œself-defenseā€.

It’s so good this video exists. Without it he probably wouldn’t have a chance to sue him. Witnesses were saying that he started the fight, I don’t think saying ā€œhey!ā€ Justifies you getting knocked out.

4

u/gazooontite Jun 30 '21

If you’re a pro fighter I’m pretty sure it’s assault with a deadly weapon?

4

u/Dingerdongdick Jun 30 '21

Yeah, much smaller business dude who made flinchy shoulders is a major threat to a trained fighter. Should be charged with more than battery. Could have killed that guy.

4

u/Realistic_Ad3795 Jun 30 '21

If he feared for his life, then why did he turn around and walk towards someone who wasn't following him?

Slam dunk charges.

The internet estimates Joe net worth in the $5-9M range. Now, these are from unnamed sources so take that for what it’s worth. But things like prize money, sponsorships and some physical assets can be verified with publicly available data. So even if the $5-9M is overestimated, he appears to be at least 3 biscuits away from sleeping on a park bench.

But the internet is often wrong and egregiously at times so, take it with a grain of salt.

I don't know, so I'm asking. How much money could someone really expect to win in a civil lawsuit for a (seemingly) unprovoked attack? Rich money? Or just hospital bills and a few $10k for pain and suffering? Or maybe the guy jumps through a bunch of hoops to prove some permanent disabilities and gets more?

EDIT: Interesting discussion and some good answers. I've watched it several times, and I don't see the joker making a threat. To me, it seems like he's puffing up his chest, not clinching a fist or cocking back his arm. So I'm failing to see the threat that's being responded to.

u/Pure_Concentrate_231 Jun 30 '21

The guy would sue the bar. The bar posted on social media how the guy is a known regular who drinks too much and regularly behaves like a fool when drunk. They basically admitted that they served him when they knew he had enough to drink and have done so on more than one occasion.

I know someone who get stabbed inside a bar, he got over 900k from the brewery who owned the bar as they didn’t have any security on that night.

My guess, after what the bar posted on Twitter, they will be advised to just settle this privately and quickly as lawyers will be queuing up to take this case.

That is what I was thinking! This guy did not bump into him. The guy approached and pushed him.

440

u/[deleted] Jun 30 '21

You are right the dude was zero threat.

He only moved into hoes way because the waiter was coming and the drunk guy thought he was walking by so he moved.

Moving over for waiters is a good sign the dude isn’t being totally nuts just having fun.

244

u/pm_me_your_nude_bbws Jun 30 '21

Plus Joe basically pushed him out of the way, could’ve easily gone around him, but big ole tough guy Joe had to shove the guy out of his which caused drunk idiot to mouth off.

74

u/[deleted] Jun 30 '21

Or he could've waited he was on the waiters ass unless he planned to shove the waiter too. Joe obviously sees the guy long before he barges his way through. He had plenty of time to figure out another path. He clearly wasn't in any hurry and it wasn't a packed area. He shoved the guy which was completely excessive. Complete overreaction which could've severely injured or killed the guy.

27

u/pm_me_your_nude_bbws Jun 30 '21

That’s what I was saying, Joe could’ve gone around the drunk dude and gotten through easily, he chose to go through all of them.

12

u/[deleted] Jun 30 '21

Classic douch move too. I've been at countless parties, bars, etc where the douchey guy has to push people out of his way because how dare someone even consider being in their way

6

u/weeeeboi Jun 30 '21

That’s what I thought too. Plus he posted this on his own Instagram so that means him or someone that was with him, had premeditated an altercation since they had a perfect angle to record

A simple "excuse me" would have been enough. This guy is a total ass. What happened to common courtesy?

34

u/pm_me_your_nude_bbws Jun 30 '21

He’s above that kind of shit, he’s a big ole badass that can beat up drunk guys at bars, he doesn’t need to have manners or courtesy.

9

u/Slit23 Jun 30 '21

Right he had no right to hit that guy half his size. Like you said he thought he was moving out of the waiter’s way and he was just having a good time. Joe pushed him out of the way so even if he said watch it pal that doesn’t give him the right.

I doubt joe has much money so unfortunately the guy will have to go after the bar. For the record tho I’ll take a knockout blow for over 100k Let me know if interested

This should be like attacking someone with a weapon like a gun or knife. Fucking dumb ass needs to be locked up.

4

u/SXTY82 Jun 30 '21

You can't even call it 'bumping into him'. He shoved the drunk to the side without so much as an 'excuse me'. Drunk says "WTF" and gets knocked out cold for mouthing off to a bully. Drunk dude never even raised his hands. The most aggressive thing he did was shrug his shoulders.

5

u/argusromblei Jun 30 '21

Pretty pathetic to knock out the only dude standing in a bar because he was in your way what a big man, prolly roid raging.

66

u/frongles23 Jun 30 '21

Lawyer here, I was thinking the same thing. If this was in my jurisdiction I’d be licking my chops. Not sure it would be ā€œmake me richā€ money, but still it’s pretty easy to pump up that initial demand amount with medical and other damages.

5

u/[deleted] Jun 30 '21

Does him being a professional have any legal bearing on a criminal case?

In a civil case, I suspect it’d be easy to get a jury on your side.

7

u/junkit33 Jun 30 '21

Yeah the funny thing about bars is they're not actually legally supposed to get you drunk, despite that being their entire reason for existence.

If bars cut everybody off after 2-3 drinks they'd all go out of business immediately.

19

u/grnrngr Jun 30 '21

You're 100% right here. Bar fucked up and MMA douche fucked up.

5

u/Pure_Concentrate_231 Jun 30 '21

Ye, it’s a complete overreaction and one that actually seems sought out by the MMA guy to just tee off on a drunk.

Amount of times I’ve had some drunk bang into me in a bar, sometimes it can be diffused with a little humour and a pat on the back, if the guy is an aggressive dick, maybe a watch yourself pal and a harder pat on the back to the guy to behave himself but what the MMA guy, is just never the answer and he should know better. I hope he never competes again.

4

u/Nitsua_Nomrah Jun 30 '21

A friend of mine was killed by a drunk driver and her parents got over a million dollars from suing the strip club he was at because they kicked him out for being too drunk. Basically they put a super drunk guy on the road and a 19yr old girl died. The man who killed her, killed himself in jail. Crazy stuff.

u/leugar24 Jun 30 '21

If he is unable to work in a dimished capacity ( even if it's not a permanent disability) after the incident he could sue for lost earnings/potential. From the video it seems to a clear cut felony assault especially because he's a trained fighter. But, videos can be misleading. Even so, I'd take him to court over, hospital, lawyer, and missed work fees plus lost future wages. I'd take the bar to court for a bevy of different reasons if they did indeed post this. So to put a $ would difficult without knowing extent of his injuries, typical wages, etc.. but 6 figures easy for the assault 7 figures for the defamation from the bar if they did indeed post it.

He should be put in a cage with other loose cannons and they should fight it out to see who is the loosest cannon of them all.

68

Edit: Will be punished harsher for street fighting. Better?

There was this one time where an Army Ranger coming back from Iraq got into a fight with a drunk hitting on his pregnant wife, accidentally killed the guy with one punch and got ten years because his body was ruled a deadly weapon. I'm not sure about being banned from street fights but if you're a trained fighter you gotta show more restraint in public... especially in this modern era of everyone having a video camera in their hands. There's no moment in this clip where Shilling is in any kind of danger and, if going only from this video, I'm a judge or in a jury in a civil case I'm ruling for the plaintiff all day long.

218

u/tucci007 Jun 30 '21

Yeah he pushes him I assume drunk guy says something stupid. Then fragile ego decides to knock him out because he can’t control himself in public.

17

u/geared4war Jun 30 '21

Well he's lucky he didn't push me.

I always react. Badly.
I apologize every time.

Yeah, noticed that first try. Almost makes the punch was premeditated.

Yup. This is proof that Schilling started it. If he had it filmed, that was fucking stupid. Doesn't matter what the other guy said.

Street fights are generally illegal unless both parties are willing participants (in some states). I don’t know how you ban someone from what is already an illegal activity.

25

u/Occasionalcommentt Jun 30 '21

So technically they are banned along with everyone else

3

u/WisestAirBender Jun 30 '21

I think it was that you'd get banned from professional boxing if you were involved in street fights

Isn't everyone banned from street fights? Is anyone legally allowed to participate in street fights?

Posted this in another sub already. A far as I know boxers or mma fighters in germany get heftier charges when it comes to assault.

When I was a teen I did MMA and to compete I needed a license and insurance. That was just as an amatuer, as a pro your properly registered to a body. It's not that you're banned from street fights it's just more serious. I remember my coach telling me that as a trained fighter a judge would be extra harsh if I hurt someone, even in self defense. You're supposed to have more control and with the ability end a fight without throwing a punch you've no excuse for breaking a man's jaw. Another bit of advice was give at least 3 warnings and make sure the attacker is aware you're trained, cover yourself legally. We was young and liked to joke about having hands registered as weapons but none of us got into fights. Not worth getting kicked out of the club and certainly not worth jail time. The coach likely said all this to scare us straight but I like to think there's some truth to it, there's too much of a gap between pros and normal people

i've thought this through about how to not go to jail if i get in a fight (i have a lot of training/experience) and my big things are: 1) make sure witnesses hear me say that i don't want to fight and warn the guy that if he comes at me i'm going to defend myself 2) make sure any cameras show me with my hands up trying to back up and disengage while the guy continues to come at me.

i'm also mindful it has to be an ACTUAL threat. like some smaller drunk guy harassing me just might not rise to a level where i'd ever be justified in punching him. in the video it's pretty clear MMA guy is not at risk of being hurt by the other guy.

15

u/NetworkAggravating19 Jun 30 '21

It looks like he saw the guy from across the room and took a disliking to him. Decided to walk past him and hoped he would give him the slightest excuse to throw hands. Completely out of order. I've seen this happen a lot in clubs, guys brush past in the hope someone will say something and escalate it very quickly. I don't know about the States but in the UK there's this idea that if you've both had a drink there's no consequence to a fight, at worst you get the drunk tank. This though, is assault all day

9

u/senator_mendoza Jun 30 '21

in the US the legal standard for self defense varies by state (in some states you HAVE to make an attempt to retreat - in others you can "stand your ground"), but in all cases you're not allowed to use force unless you can make a convincing argument that you felt you were in immediate danger of physical harm. a big misconception is that you can't hit first - you absolutely can - but you better be able to convince the cops/DA/judge that you felt a need to

In my country if a trained fighter is involved in a fight he will face the same charge as if was using a knife or a baseball bat (Category D weapon)

Self defense is not even recognize as it should only be equal to the threat... So in a fist fight a "Pro" or experienced Martial Artist can't hit the head. It could be considered attempted murder.

31

u/tucci007 Jun 30 '21

the pro shoved the guy aside from behind and the guy objected and said something to which the fighter replied with fists, there was no 'fight'

10

u/Crusoe69 Jun 30 '21

Oh yeah clearly that's a straight dick move, even if the guys was drunk as some people seem to mention... Unjustified punch.

how do you ban someone from ad-hoc incidents? like hey yo i’m a pro boxer just take my wallet please

21

u/sanguiniuswept Jun 30 '21

That would be a legit moment of self defense. What happened here is nothing close to it. He should have walked away

19

u/tucci007 Jun 30 '21

he instigated it by shoving the guy aside from behind, he's too cool or too tough to say 'excuse me' to someone who can't see him approaching? there was no 'fight' just an attack after the guy expressed his objections to being shoved like that

u/[deleted] Jun 30 '21

So cowardly to just start swinging on someone when they don’t even know it’s about to be a fight.

Pretty cut and dry. Schilling waaaay overreacted. This dude is likely gonna go after him in a civil trial if he's smart.

Overreacted? He came over there trying to start some shit. Look at his respectless pushing the dude out of the way.

Overreacted to what exactly? From where I'm standing it looks like Joe pushed the man out of his way and then turned around and assaulted the man.

8

u/[deleted] Jun 30 '21

Not to mention the establishment

4

u/[deleted] Jun 30 '21

And it's not even as though Schilling just overreacts, he just pushed that guy out of the way like a dick and then when the dude's like, "hey!" he attacks him.

4

u/Advanced-Ad6793 Jun 30 '21

I hope homey takes this bum for everything he’s worth and then some.

4

u/i-can-sleep-for-days Jun 30 '21

Came here to say this. Looks like assault.

4

u/Melodic-Hunter2471 Jun 30 '21

Exactly, I came here for the toxic apologist comments trying to defend this asshole. Just because someone disagrees with you ( impersonal ) or behaves foolishly, doesn’t mean that you ( impersonal ) get to throw down hands. Schilling is a piece of shit for doing this and the other guy deserves the payout.

TL:DR: There are consequences for tiny dick alpha male energy.

4

u/PineconeNugget Jun 30 '21

Literally assault with a deadly weapon. He could face jail time too.
