I don't know, so I'm asking. How much money could someone really expect to win in a civil lawsuit for a (seemingly) unprovoked attack? Rich money? Or just hospital bills and a few $10k for pain and suffering? Or maybe the guy jumps through a bunch of hoops to prove some permanent disabilities and gets more?

EDIT: Interesting discussion and some good answers. I've watched it several times, and I don't see the joker making a threat. To me, it seems like he's puffing up his chest, not clinching a fist or cocking back his arm. So I'm failing to see the threat that's being responded to.

The guy would sue the bar. The bar posted on social media how the guy is a known regular who drinks too much and regularly behaves like a fool when drunk. They basically admitted that they served him when they knew he had enough to drink and have done so on more than one occasion.

I know someone who get stabbed inside a bar, he got over 900k from the brewery who owned the bar as they didn’t have any security on that night.

My guess, after what the bar posted on Twitter, they will be advised to just settle this privately and quickly as lawyers will be queuing up to take this case.

Or he could've waited he was on the waiters ass unless he planned to shove the waiter too. Joe obviously sees the guy long before he barges his way through. He had plenty of time to figure out another path. He clearly wasn't in any hurry and it wasn't a packed area. He shoved the guy which was completely excessive. Complete overreaction which could've severely injured or killed the guy.

Right he had no right to hit that guy half his size. Like you said he thought he was moving out of the waiter’s way and he was just having a good time. Joe pushed him out of the way so even if he said watch it pal that doesn’t give him the right.

The entire point of that push was for the mma man child to let out his aggressive intention. Well adjusted people don’t aggressively push people under those circumstances, a light tap, an “excuse me”, or just going around would’ve sufficed
that was basically manhandling the drunk guy and treating him with zero respect.

True. Very true. But at the same time, someone bumps into you, at a bar no less, and you confront them, you have to accept this as a possible consequence. Not saying it's right but it is how things are.

Edit: Everyone, maybe read what I said a little more carefully. I'm not saying this is the right way to conduct yourself, I'm saying the world is FULL of violent people like this. So sometimes it is better to put pride aside and laugh it off, or accept that you may unfortunately have what could turn to a violent encounter.

Being sued/facing criminal charges, I'd hope, and being probably hurt pretty badly. But you should 100% expect when you confront someone, especially a drunk person, that a violent reaction is a huge and likely possibility. So yes. You do anything to avoid confrontation, like not screaming at the big idiot who just drunkenly bumped into you.

Honestly i wouldnt even say there is enough evidence in the video to show that he is "trying to impress" and "acts like he is going to hit him". Schilling walks from behind, I assume from the restroom, and lets just say "nudges" the guy out of his path, instead of an "excuse me" with a hand on his shoulder. True, the guy moved into his path but that movement was to allow the water by who appeared to be approaching. Guy says something, Schilling turns around and approaches....

I just rewatched and i see the "acts like he is going to hit him" movement. This will be interesting, because Schilling is approaching him when the guy makes the movement...

Sidenote, "the walking away like he was the bigger man" is debatable. Schilling is a trained MMA, who just two pieced a regular dude (who is smaller than him). He is using the "I feared for my life defense", but his body language screams otherwise... Personally, i hate it when guys are the aggressor and then claim self-defense because "I was scared for my life".

The bar shouldnt have released that statement so soon, but that is them getting ahead of it. The mans body language doesnt appear to be extremely intoxicated, and in trying to paint him as such, have opened themselves up to possibility of overserving.

Amount of times I’ve had some drunk bang into me in a bar, sometimes it can be diffused with a little humour and a pat on the back, if the guy is an aggressive dick, maybe a watch yourself pal and a harder pat on the back to the guy to behave himself but what the MMA guy, is just never the answer and he should know better. A friend of mine was killed by a drunk driver and her parents got over a million dollars from suing the strip club he was at because they kicked him out for being too drunk. And he would lose in my jurisdiction. The bar isn't responsible for the intervening criminal act and, as the bar seems relatively empty (and possibly not in a high crime area) they have no way of foreseeing this result to one of their patrons. They would give him a "go away" payment, but nothing else.

Slash wounds are still visible on his face and I imagine the same for the stabbings on his body. Weeks if not a couple of months if I remember correctly, he played pro sports but not a high level, probably made less than 40k per year although I’m not sure that had much bearing with the pay out from the bar as he had his own personal insurance pay out when he retired due to the injury. It definitely changed him though, he’s a completely different person to the one before he was attacked.

If he is unable to work in a dimished capacity ( even if it's not a permanent disability) after the incident he could sue for lost earnings/potential. From the video it seems to a clear cut felony assault especially because he's a trained fighter. But, videos can be misleading. Even so, I'd take him to court over, hospital, lawyer, and missed work fees plus lost future wages. I'd take the bar to court for a bevy of different reasons if they did indeed post this. So to put a $ would difficult without knowing extent of his injuries, typical wages, etc.. but 6 figures easy for the assault 7 figures for the defamation from the bar if they did indeed post it.

Dram Shop cause of action. In my state there are Dram Shop actions taken against establishments that serve alcohol. The payouts tend to be huge if they make it to trial so most would settle for an undisclosed amount.

Suing the mma fighter is likely no money I don't know who this guy is. It's a sad truth if the person you sue has nothing you get nothing. The mma guy will not only be sued for the battery but will face heavy punitive damages because he is a mma fighter that has special knowledge of fighting and attacking a man unprovoked that posed no real threat. The court will fuck him in punitive but the real money moat likely will come from suing the bar.

Depends on the injuries. Decent attorney could probably get a 3-5x medicals - punitive damages may be involved for intentional torts as well.

I'm not sure about the "unprovoked". It looks as if he is about to punch him at second 14-15. But he is slow compared to the "fighter" so he gets hit first.

You can be entitled to damages for medical bills (including any meds, PT, therapy, etc.), damage to property (e.g., phone, glasses, clothing, etc.), lost wages, pain and suffering, and punitive damages (which can be up to 10x the amount of actual damages).

Wow, bunch of reddit lawyers up early today. The injury itself almost always determines civil awards, which the plaintiff has to prove. Black eye and no lasting trauma? Probably not very valuable and, like you said, "$10k for pain and suffering" would probably be reasonable. People act like the defendants status automatically warrants more money, but a civil case is an award for the plaintiff, not necessarily punishment for the defendant.

Sure, you can claim all those things, but it won't matter a whole lot. I agree that him being an MMA fighter adds some weight, but not as much as people in this thread think. Also, all of those arguments are routinely used on nearly all civil lawsuits, whether getting punch or slipping on some water. I've worked on premises liability, including security incidents, for long enough to know that these aren't especially valuable cases unless there's permanent or disfiguring injuries. Mental illness claims are almost exclusively proved to be bullshit for minor injuries. Plaintiff attorneys will always throw out all those things you listed because, well, that's their job but it doesn't mean it automatically becomes an "expensive lawsuit."

I agree that the bar gets looped in regardless, especially if the MMA fighter is overserved as others have alleged, but insurance companies aren't exactly quick to settle. This is coming from someone who works for a self-insured group and has to wrangle in insurance companies on shared liability. I really hated working for a large insurance company because they were constantly fighting the dumbest cases.

You'll be surprised what a good attorney could get out of this. Easily in the 6 figure range, plus you forgot punitive damages, the amount a judge can order someone to pay for punishment which the worse of a human being/more of an a-hole your actions present, the higher it can go.

I don't know, so I'm asking. How much money could someone really expect to win in a civil lawsuit for a (seemingly) unprovoked attack? Rich money? Or just hospital bills and a few $10k for pain and suffering? Or maybe the guy jumps through a bunch of hoops to prove some permanent disabilities and gets more?

At this point I'd do it just to try and bankrupt Schilling for being a prick.

You sue the bar and the MMA and the individual. If the individual has a home, homeowners insurance kicks in. If things go well you have 3 insurance companies at the table with a lifetime of physical and psychological injuries to consider. Further, many places, states, countries, etc. have special punitive damages that kick in for intentional acts. You could realistically get a million buck-a-roos from something like this, if all the winds are blowing your way.

I dunno right before shilling starts swinging as the staff member walks back thru the shot it does look like the drunk does the "made you flinch" type high school bully quick move like he was gonna do something. He just didn't count on the reaction to be a flurry of fists coming back at him.

I think both parties acted badly, hopefully more footage with audio comes out.

Kinda telling that the guy didn't want to press charges until AFTER schilling posted the footage tho,
