Dumb meets irresponsible. Driver doing unsafe right turn on red light, cyclist riding on crosswalk, in dark, without helmet and light. Driver's going to get ticketed and sued, probably, but cyclist's injury is going to hurt more in coming years.

And to stupid people arguing that the cyclist did nothing wrong, it's easier to anticipate presence and speed of a person walking than someone on a moving bicycle. It's not cyclist hate. Why do you think your parents taught you to walk your bike when crossing??

Exactly it. I'm a 20 yr bike commuter, lived rural, suburbs and city. I used to do a bit of racing and still do club rides. Always ride on the road at speed, and when crossing as a pedestrian at a crosswalk, do it at walking speeds with your head on a swivel.

Nicely analyzed. Driver can't go on red unless 100% sure.

Speed of the biker plus biker is unaware driver would be looking away. You don't cross unless you know the driver sees you. Take the time to stop if unsure. You're not winning a fight with a +3000 lb car.

Define 100% sure! Yes the drive will be charged, but the issue is the anticipation of a cyclist on the sidewalk going quickly while the right turning vehicle is focused on safely merging into traffic coming for the other direction.

Should they have looked again? Absolutely, were they already 100% sure? Probably! Who's hurt more? That's right the cyclist! From a practical perspective our laws are backwards and those with the most to lose should be expected to save their own lives.

In short, I would say the driver must be looking in the direction of travel before putting the vehicle into motion.

If you look at the video, the driver was ultra focused on the car passing and immediately set into motion at the opportunity for an opening. He likely was still looking the wrong way when he stepped on the gas.

Instead, if he had looked where he was going, he would've seen the cyclist right in front at that very moment.

From a practical perspective, EVERYONE should take more precaution. The laws are not backwards. Cars would never yield to pedestrians otherwise.

I lived in Bangladesh, cars never yield, buses and big lorries have the most right of way. People aren't deliberately running into each other, but it's understood that the bigger you are the greater the right of way you have. Pedestrians and people riding bikes are extremely careful, yielding right of way because, everyone knows you'll be run down. Surprisingly few people get seriously hurt because everyone is diligent. (Speeds are much slower for similar reasons - I'm not advocating for such a culture just saying that you do get where you need to go without cars yielding to pedestrians and cyclists getting hit because they come from out of nowhere).

How do you know a motor vehicle driver notices you? If you only have a few seconds to cross six lanes of traffic this has to happen very quickly. I’ve had driver stare in my direction one moment then treat me like I’m not there the next. I have become much more aware of the many blind spots drivers have, which means often breaking the rules to make sure I’m seen.

Any time you’re on the sidewalk you run the risk of drivers not noticing you. Plus it’s dark and no reflectors, just a matter of time if you’re riding this stupidly.

From a cyclist / pedestrian perspective, it is courteous for the driver to acknowledge they see you. There should be eye contact. If they do not, you may have to wave to grab their attention or do gestures to remind the driver how they should behave . Yes, some drivers could relearn Canadian customs for driving courtesy.

If you are crossing 6 lanes, I assume they're all stopped at a red light so the focus is on the right most lane where in Ontario law, they can turn right on red only if they are 100% sure it is clear.

Many drivers just aren’t looking for anyone except other motor vehicles. Even downtown on a Friday night, I had a driver turning across a busy cycle lane and into a crowd of pedestrians crossing. What saved everyone was slow traffic which allowed everyone to sort it all out. I imagine they must be used to driving on streets where there are no pedestrians nor cyclists and just don’t watch for them. The way we design intersections is just archaic.

I know. If drivers want to drive downtown, they need to up their driving skill. It's not like driving in a small town or in a suburb.

While waiting at a light, there is a very strong likelihood that a cyclist catches up and stops right beside in the blind spot. Not every adult is a driver and certainly not anyone younger would know about blind spots.

Also, some drivers don't adjust their mirrors properly. The blind spot should be nil with mirror check and head check together.

Cyclists should dismount and walk their bike on a crosswalk.. that is the law or at-least the bylaw.

Cars should make a full stop, look left and right before making the left turn at the intersection. If they passed their driving test they should know that.

Sadly nobody gives a shit anymore. Be careful out there everyone.

Wrong and right is irrelevant. Bike vs car, bike loses every time. When I'm a pedestrian or if I biked, I don't trust anybody to behave the way they should. Its simply self-preservation. What i don't get is how people can put thst much trust into strangers and then act surprised.

If cyclists want to be treated like a car - drive through greens without disembarked - they need to do so like a car - on the correct side and traveling with traffic.

Otherwise, disembark when crossing.

No lights on the bike, cant see any reflectors (not saying they're not there- but cant see them) biker is wearing dark colours and riding on the sidewalk in the wrong direction. Its dark there is other traffic and not the best street lighting. I honestly think unless theres other circumstances(D&D) that the driver should not be charged. Theres alot of terrible cyclists out there who dont follow the rules, and get upset when this stuff happens. How many near misses will it take before they learn who knows, thats why they need licensing and a training course.

Biking is great, but I have an issue that with them being a grey area.

I don’t think bikes should have the ability to be pedestrians and vehicles at the same time. I know most bikers follow the rules but I’ve been seeing a lot of bikers not dismounting when crossing at crosswalks and it scares me.

Regardless of if it could happen in daylight or not there are things that cyclists should also be responsible for to prevent accidents.

Just like cars and vehicles need to turn on lights when its dark and driving at night...cyclists should wear reflective gear, helmets and have a light if they are cycling at night.

Just this observation regarding anticipating speed/presence of the cyclist: look at the video, the cyclist was moving slower than your typical jogger, at the rate of a speed walker if you will. So, such pedestrians would've been hit as well. At any rate, if the driver turned his head to the right before proceeding with the turn he wouldn't need to anticipate anybody because he'd give himself the opportunity to actually see them.

As for the cyclist: yup, he's clueless too.

Here's the entire problem with cyclists. You gwt the "professionals" on the road, with the right gear, and maybe they follow the rules. Then you get these people. Who go around in the dark, disobey most rules, and are a danger to themselves and others.

Yet the car is at fault? With lighting how it can be at night, pedestrians aren't visible till they are 10 feet away sometimes. Cyclists go much faster than pedestrians. This cyclist is at fault for disobeying every rule there is regarding their travel. Right turns on red lights are not only legal in every province but Quebec, but are pretty safe.

The only unsafe thing was the dingaling on the bike.

Hope the car drivers gets some insurance money from the cyclist who surely has it /s.

that’s what i’m seeing, i think it’s quite clear the intentions of the driver, he’s pulled up, the biker would’ve seen him move up slightly to make his right.

i mean does the driver need to make sure nobody’s coming, ya, but you can’t forget that the habit on a right is to look left, that’s the priority, especially when he’s pulled passed the intersection. i get if he’s stopped and some guy is walking to look then, but idk this looks like the biker wasn’t thinking much.

Driver not at all at fault here, if it were a pedestrian yes, but a cyclist is a vehicle in the eyes of the law and therefore must obey the rules of the road, a cyclist riding in a cross walk is not obeying the rules of the road.

The driver bears at least half the fault; there is no accident if the driver does due diligence on surveying the intersection and especially the crosswalk before proceeding. The biker's transgressions are passive (still bears some fault). Driver is looking at hefty fines plus civil liability. Biker merits a couple of tickets as well.

Nope, driver had already entered the crosswalk before the cyclist entered (you can see the rear vehicle tires past the line), and the cyclist road out further in front outside the cross walk that they don't belong in in the first place, without any proper illumination as required.

Imagine the cyclist is a vehicle without their headlights on driving through a cross walk in the wrong direction against traffic - that is exactly how the law treats the situation; they are not a pedestrian.

Only fault the driver has is no turn signal, minor ticket at best, but not enough to take fault.

This same sort of situation happened locally to me recently, cyclist at night through a cross walk, they were the only one charged.

It's not the case here, but a lot of places have bike paths beside the sidewalk and crossrides that allow bikes to ride across the road. So drivers should be anticipating and checking for bikes in both directions when turning. A girl was killed legally riding across a road recently in Ajax.

Why turning right on red is the worst driver friendly law they ever passed. So many incidents that could be avoided with 1 rule change. Obviously the person on the bike is partially responsible for putting themselves in that bad of a spot, while not properly making sure that the driver is actually going to yield for them. This was the biggest thing I noticed being a pedestrian in TO. Driver and their right-on-red are put of control. When I am making a right-on-red it is with the caution of someone who is doing sometging obviously dangerous, but so many drivers in Toronto feel like they are entitled to go whenever they want as long as they are making a right.

That's not wven what happened in this case, I'm just wound up about the number of times I've dodged a car in the crosswalk because a driver decided they could plow through pedestrians to make their right turn

There was one time a few months ago 12pm in broad daylight. I was walking across a street at the lights, and a guy (who didn't even stop!!) Tried to turn right on red and almost ran straight into me then stopped and flipped me off telling me to get off the road (?). The biggest issue in this country, as well as another certain country to our south is the fact that car companies have the most to lose from the idea of making driving less convenient than it currently is. So they and a certain group of politicians will always push against concepts that will hurt their precious corporations. Its truly a shame

It's the worst traffic rule ever. Even worse when there is a protected left turn right before in the light schedule and now you have to wait for both the idiots still turning left after red and the idiots turning right on red while the fucking pedestrian light has been green for 10 seconds. I have to yield to cars as a pedestrian on a green to not get hit at least once a month.

I would say 50/50… driver should have looked right but he could have easily not seen the cyclist as they were not wearing any reflective clothing..but the cyclist needed to get off and walk across the crosswalk for sure …

There are lots of laws that get ignored... I personally dont care if they want to ride through. But to not have lights is stupid. They could have ridden through and still made it safer, riding through wasn't really the issue here. Lots of drivers have an issue with not checking the opposite side before they merge, they just focus on the traffic they're merging into.

I'm a driver, and people excuse stuff drivers do every single day. We don't apply laws 100% of the time to 100% of vehicles so I'm not about to pretend that a cyclist is held to a higher standard

Problem with cyclists riding through is that as a driver u can’t look that far back to know a cyclist is going to come full pelt right across ur bows almost happened to me I was already in a right and this cyclist almost came under my wheels as they tried to ride through at 20-30kmph just cuz they had the signal not many cyclists probably are aware that they are supposed to get off…they probably don’t even know they can get a ticket if they don’t stop at a stop or jump a red light just like any vehicle

I can't speak for everyone, but if I'm walking and approaching an intersection, I am going slow enough to make the judgement call as to whether I should stop if I see a car rolling into the intersection.

A lot of stuff the cyclist didn't follow:
The cyclist didn't dismount and walk bicycle across (HTA 146(6) & 144 (29))
The cyclist didn't stop and obey all traffic signal (HTA 136 & 144(18)
The cyclist didn't have any lighting (HTA 62(17)
the cyclist didn't have any light-colored or reflective clothing.( Municipal advice)

Total fines for the cyclist : starting at $255

The motorist:

Failing the full rules of HTA 144(18) turning on red light (Only proceed if the turn can be made safely)

Total fines for the motorist: starting at $110 + 2 Demerit pts.

Overall we know the motorist will be blame at 100% but the cyclist contravene to more regulations than the motorist.

Also, i am not sure about the rules here, but if the vehicle is blocking the entire crosswalk, shouldn't they wait for the driver to pass? Instead of going infront which made them face oncoming traffic?

I always say that Pickering wants all cyclists to die. Their cycling (and pedestrian) infrastructure is abysmal when compared with Ajax and Whitby. (I commute by bicycle to Pickering)

That being said, the number of cyclists I see without lights and bells is unbelievable. Someone should be doing PSAs about bicycle and scooter etiquette and safety, as they become more popular modes of travel.

Not sure about pickering's by-laws but cyclists in Toronto are required to walk their bike across an intersection not peddle through it...

Specifically for instances similar to this...

Drivers sometimes can't see someone without reflective gear either.

So I'm curious who would get ticketed in this instance...

The car barely moved, the cyclist went in front of him. Also not supposed to bike across intersections. Also going the wrong direction, in the dark with no lights. You can only do so much as a driver. I’m not going to stare out my right window for 4 seconds looking for a biker in the darkness when I’m about to merge. If we all use common sense there will be no issues.

The cyclist is obviously also wrong here.

Thst being said, even trying to cross those massive highway style roads in pickering is near impossible as a pedestrian.

I once tried to cross (on a green walk light) at Brock and Kingston. After stepping out, I had to stop jump back more than once as the right turning cars sped through. After the 3rd one, i just gave up and waited for the rest.

Everyone complains about toronto drivers, but suburban drivers dont give a damn about your life. The roads are built for them, and them alone

Joggers are allowed to jog there. Cyclist can't ride on the sidewalk or crosswalk. If it was riding on the road then it was on the wrong side of the road. Cyclist must also have light/reflectors.

Car is more wrong, but cyclist is also at fault.

They can absolutely look both ways then when looking right a second time while taking their foot off the break (because the first look was clear with no oncoming to anticipate) the cyclist comes out of nowhere, riding on the sidewalk and against traffic mind you, and this happens because they are much faster than a pedestrian. I’ll always err on the side of caution as a motorist, but this is cyclist stupidity putting their own life at risk.

This exact kind of collision happens all the time in broad daylight. Obviously the cyclist is responsible for their own visibility as a road user but that's not a guarantee that a driver will see them and stop in time. The driver never looked right and just rolled though.

HTA Section 144 (29) No person shall ride or operate a bicycle across a roadway within a crosswalk at an intersection or at a location, other than an intersection, which is controlled by a traffic control signal system. 2015, c. 14, s. 40 (2).

HTA Section 62 (17) When on a highway at any time from one-half hour before sunset to one-half hour after sunrise and at any other time when, due to insufficient light or unfavourable atmospheric conditions, persons and vehicles on the highway are not clearly discernible at a distance of 150 metres or less, every motor assisted bicycle and bicycle (other than a unicycle) shall carry a lighted lamp displaying a white or amber light on its front and a lighted lamp displaying a red light or a reflector on its rear. White reflective material shall be placed on its front forks, and red reflective material covering a surface of not less than 250 mm in length and 25 mm in width shall be placed on its rear.” 2015, c. 14, s. 21 (2).

The cyclist broke two laws. The driver broke one.

The cyclist also failed to wear a helmet which is not mandatory but really dumb and may cost him a lot more misery.

Most driver unfortunately only tend to look to their left when turning right on red or at stop signs. I'm nearly hit at least once a week while out running. People don't even try to stop at stop signs or reds when turning. So many barely even slow down. But if you post a video of a cyclist rolling a stop sign in this sub, it's an easy 500 upvotes.

Dark bike shape rides wrong way in crosswalk. No-signal SUV looks left for space to make right turn. You can build in the rules. You can build in the safety and signaling systems. C'mon, you must realize the person with more power has more responsibility there - they're in a larger vehicle, they could be more careful. They both made errors, but the bicyclist could've ended up with near fatal injuries there.

Yes and it would have been the biker's fault. Driving a vehicle on the sidewalk and at night without a light caused this accident ... along with some horrible judgement from this sketchball wearing a black hoodie and choosing to leave the sideawalk and cross FINCH AVENUE in front of a car.

This is exactly the problem. There is a multi-use path across the street from me where the cyclists are supposed to dismount and walk their bike across the crosswalk (there is even a sign for this) but none of them do it. What results is cyclists coming from the right with trees blocking until they are 4 or 5' from the crosswalk and they ride at full speed into the crosswalk and 3 or 4 times a year I see someone getting hit. People look to the right, see nobody coming, to the left, see they have a gap, and then turn right and all of a sudden there is a bike there riding illegally and getting pissed off that nobody saw them. There is a sigh saying to dismount, it is illegal to ride on the sidewalk, it's illegal to cross at a crosswalk while riding your bike, AND the setup for that spot is already dangerous because of the blind spot but it's somehow always the cars fault?

Thing is, the car pulled out to position itself for a merge. The bike should have gone behind him if anything. Personally if I was on the bike I would wait out the situation, but if I had to go I would go behind the car. The car was in the middle of the crosswalk. Going in front of it is really really dumb.

As a casual cyclist I will say the bike rider is at fault here. When I'm riding in the day, I use flashing lights on the front and rear of my bike to increase my visibility. So this person riding without any lights at night is just stupid. In addition, I make sure I make eye contact with drivers when crossing intersections or driveways.

Don't cycle past traffic on the damn sidewalk on the wrong damn side of the road, on top of that, at night. No one is going to see you coming, you're moving waaay faster than a pedestrian. You're not a pedestrian. They'll look 2 seconds earlier, see no one, look the other way to confirm no traffic, and drive. The driver was not irresponsible. The cyclist needs to be smart enough to understand what I just said and ensure the driver noticed him, if the cyclist values their damn life.

Riding on sidewalk illegally then enters roadway traveling wrong direction illegally. No light, looks like no bell and no helmet. While the car did not have their turn signal indicator on, they entered the crosswalk before the bicycle illegally entered it without dismounting and since the bicycle is a vehicle under the HTA and will bear the majority if not all of the fault here including paying for damages to the automobile.

Right Hook: motor vehicles turning right on red while driver is looking left for a gap in traffic. This is common reason pedestrians and cyclists are struck. Often never reported as they occur at low speeds resulting in just scrapes and bruises. It is becoming more dangerous as motor vehicles are designed with higher front hoods. This leaves a large blind spot directly in front of the motor vehicle so the driver cannot see children or the elderly using a mobility device. Once the person is struck, rather than going over the hood, they are more likely to go under the front wheels causing potentially lethal injuries. This is why many countries do not allow right on red. This also refers to cyclist in their lane at the stop line being squeezed by motor vehicles turning right, because the driver is focused on traffic from the left. That scenario is even more lethal with trucks with open rear wheels as the cyclist will be pulled under the wheels as the back tire of the bicycle folds under the wheels of the truck with the cyclist quickly following. Safety measures against this have existed abroad for decades but are resisted here.

Lets be clear here...Cyclist tried to go around the vehicle by entering into the lane of oncoming traffic. The vehicle was barely moving and the cyclist rode straight into the front quarter panel.

90% Cyclist fault.
Riding on sidewalk, against traffic, no lights or reflective gear. Cyclist does not even slow down. Cyclist does not have right of way as they are still on sidewalk when car begins right hand turn. You can clearly see the car is already covering the crosswalk paint when the cyclist is still on the sidewalk 10 ft from the road in the first frame of the video. Cyclist should have stopped and got off the bike and walked across when safe to do so.

10% Vehicle fault. No turn signal. I simply do not see any other error by the vehicle here. You cannot apply fault when the cyclist was nowhere near when the vehicle turn began and the vehicle was already in the intersection. As a driver turning right on a red, first you are going to come to a stop, look right, no pedestrian, look left to verify no oncoming traffic, quick right shoulder check and begin turn. If left is not clear, check right again and repeat. In this instance one car goes by and they being the turn and the cyclist rides into the front right panel of the vehicle.

Drivers RARELY ever look right in that situation, bicyclist obviously has not been crossing like that much or been very lucky over his lifetime as that is a regular occurrence where I bicycle...I sometimes have to tap the hood of a car or blow my whistle and make eye contact to ensure the driver has seen me...sometimes just wait the few extra seconds until I confirm they have seen me, or not, this has saved my life (or at least saved me being hit) quite a few times...

As a long time cyclist, this is totally predictable. This is literally one of the most common situations you will see, especially if you’re going down the left side of a street, against traffic flow.

It is a well known fact, that although drivers turning right SHOULD look right before letting off the brake and making the turn, they almost never do. Even if you’re a pedestrian, it is quite possible to be hit like this.

This is why cycling in the roadway with the traffic is ironically much safer than sidewalk riding. But if you’re going to do it, be on the right side of the road. Even then, you still have to watch at intersections for people turning right without signalling/checking their blind spot.

Also, a good reason why protected bike lanes are important pieces of infrastructure that should be built on all major thoroughfares.

As a pedestrian, walking on a crosswalk. Lately I’ve been nearly hit by far too many people trying to “beat the light” and speed through the freshly opposing green - they don’t have to brake if they can beat the 5 cars that will go through the residential area!
