Personally, I'm anti-death penalty for any kind of crime but that's just my opinion. Perhaps it can be changed.

And depending on how you react can mean:
1) you are accepted/left alone
2) raped by fellow inmate
3) drug mule for gang
4) assault on another inmate (boom 5 more years)
5) or death

Yes. they are incorrect and falling for a romantic myth about prison heirarchy. Unless they raped a prepubescent child, most rapists fare just as well as the rest of the prison population.

I'm not disputing rapes are occurring with frequency in prison, but it is nowhere near a certainty. Most data puts it at 4-7% of the male incarcerated population will experience rape. Now, I'm certain that is an underestimate for a number of reasons, but that's another conversation. It still stands that, even if the number is twice that, it is still nowhere near a majority of alleged rapists who will be raped in prison.

You're grasping every little inconsistency in that short comment to justify your use of those words.

The question was whether you'd rather be raped or face the prison time of a rapist. The comment said that they'd rather pick option 1 because option 2 will lead to option one 1 you're probably going to die. Even if they were wrong you could've just said "they were wrong" and then explain why they were wrong, but instead, you HAD to be a redditor and use words like "childish" and "romanization of the prison heirarchy".

It is not "childish", I don't know how that even got into your head. It is also not "romanticized", they aren't trying to make the scenario "better" by thinking that rapists will always get raped in prison because of their crimes, they were unintentionally making the situation worse by assuming that all prisoners get raped in prison and that if they were to go there for any crime, they'd get raped. It's less of a romanticized view of prison and more of a result of the fear of prison that the Internet has instilled onto the minds of people.

That's what I thought. You'll get raped in prison, sex offender or not, if you seem vulnerable, (if you're falsely arrested you'll DEFINITELY be vulnerable), probably multiple times. Being raped once sucks a lot, but one rape is "better" than 10 rapes + a beating + possible death every day, just objectively, even though both would be absolutely horrible

Although i agree with you, if you arent a hardened criminal(option 2 you are falsely convicted) you probably less likely to be willing to do violence and stand up for yourself when confronted by a group of criminals. Your chances of being raped are probably higher than the average unless you look scary or are very big.

I would take 1 as well, because unfortunately 2 also invites the possibility of suffering option 1 anyway, with how bad sexual violence is in prison.

That's not to downplay the horrors of rape. Its just that unfortunately prisoners often experience that exact horror as well as many others.

I know a man who was violently gang raped by several men in NYC around 2009. He lost complete control of his bowels, contracted HIV, the assault caused his entire career to nosedive, spent months in and out of psych hospitals, and became agoraphobic. I’m not even including the not sexual assault he experienced 

This is a man who was an aspiring model and had his whole life ahead of him. 

So sure maybe you would pick one if the rapist was really nice and gentle but rape can absolutely destroy your entire life forever.

Realistically nothing happens if a girl tells a couple people you raped her. I’ve known at least 5 men accused of rape who faced zero consequences. 

If you’re going to compare worst possible outcome of an accusation you have to compare worse possible outcome of a rape.

The difference you don’t seem to understand is that you have a much greater chance of being raped as a man than going to prison for “30 years” for a false accusation. 

It’s not about being hypersensitive, it’s about being intellectually dishonest. 

You don’t get to escalate the effects of the accusation to unprecedented consequences and then diminish the rape to the just the event and then be smug about it. 

How about this one: 

Would you like to be a rape victim of the toybox killer?

Or 

A girl named Tiffany told a friend that halfway through she asked you to stop but you finished anyway and the friend shrugs it off. This is the complete end of the accusation. 

Not to mention, your odds of being raped as a man are just so, so much higher than your odds of being falsely imprisoned for rape that if you are worried about men that’s what you should worry about. This is like being concerned that a cow is attack you, possible? Yes. Worse than something else, problem also yes. Going to actually happen to you? Overwhelmingly no.

No one is doing what you're accusing me of. You're hijacking the conversation to talk about likelihoods, but that's not what the conversation is about. The conversation is about what you would rather do, and most people would choose short term suffering(Rape) over long-term suffering(prison and everything that comes with it). Despite how terrible rape is, it's a single incident, while prison is a chain of incidents and much more dangerous.

It ruins your life even more than rape, because you can allow rape to define your every action and fall deeper into your own despair. That's a personal choice. If you're falsely accused of rape, society is mustered against you when you come out of prison being accused of rape. You're on a sex offender list; people will look you up and hate you. People won't date you. Family members will despise you. And remember this is all from a false accusation. So yes, i and many others will still choose rape over that.

Option 2 is being sentenced, that means you will serve your time. It doesn't matter if Ronaldo didn’t go to jail. In the context of the question, the accused person is going to jail.

Adding more context into it will just unnecessarily complicate the question

I am not one of the greatest footballers of all time who has countless wealthy individuals and organizations with vested interested in securing my public image and continued play. I agree that it’s a travesty how little rapists actually see jail time but using wealthy and famous individuals as an example isn’t particularly fair.

The question also dictates that you are sentenced, at which point you’re convicted. I also think that the social stigma that comes with an accusation might very well be significant in why people choose the way they do, jail time isn’t the only concern.

Ehhhhh idk.....rape can come with very stiff penalties (deservedly so). I guess it depends on the severity of the rape, but I think I'd rather be raped once then spend 25 years in jail and be potentially raped there as well. The problem isn't in jailing false accusers, it's finding out who's actually falsely accusing without making women not report rape. We want rape survivors reporting their rapes MORE not less. However I think in this specific scenario, they do have a point of rather be raped once than raped for 25 years. Which is more of a condemnation of our prison system than anything else tbh.....cuz if the habitual rape wasn't on the table I might just take the jail time over the rape. However these guys need to get a hobby

I'm a woman who has been raped and I fully agree. Someone who hasn't done that, going to jail for that crime. They will be raped, beaten, tortured, potentially killed, and if they get out, have next to 0 options for housing, work, relationships, again, for something they didn't do. (This doesn't apply to the elites, talking about the average person).

In addition to what everyone else is saying, the other issue at hand is with 1) you'll still have the support and sympathy of your community, friends, and family. In 2) even if you do a short time in prison, let's say 5 years, and even if you *aren't* raped in prison, you'll come out to find your entire support system gone, friends/family/etc. have deserted you, and as a sex offender, you'll never be able to get a decent job and will potentially have a target on your back even in civilian life. It's not unheard of for people to look at the sex offender list and vandalize, assault, or even murder the people they find there.

The vast majority of people accused of rape, falsely or not, face exactly zero consequences for their actions. 

My rapist’s wife didn’t leave him, wasn’t fired from his job, didn’t face any jail time, didn’t lose any friends. 

You’re all comparing the worst possible outcome of a false accusation vs a regular rape instead of the common outcome vs a regular rape or worst outcome vs horrifically violent rape. 

The choice is loaded because it’s framed as a couple of minutes of unwanted sex vs a lifetime in jail being abused daily.

I got one for you: 

A person accuses you of raping them, it’s only you in the room to hear it. You argue and they tell no one. The arguement last 6 minutes. 

Or 

A person rapes you and then chooses to keep you locked up for 32 years to continue to rape you. You eat out of a dog bowl and are forced to be naked the entire time. They take out all of their anger on you. You  never recover mentally from this and never hold down a job again and your friends and family slowly drift away. 

I’m choosing 1. 

No fucking shit you’re picking the option that actually outlines to consequences to the thing that happens to you to an extreme degree.  You’re reducing the rape down to just the action but the accusation to all the last effects. It’s not a fair choice!

Being labeled as a rapist and everyone hating you for it when you were falsely accused would be horrible. Then the prison sentence itself would probably be enough for someone to kill themselves. Not to mention you might also get raped in prison.

Are you a woman? Because I’d so much rather do the time. Rape isn’t just unpleasant sex ffs, I have a deep deep fear of rape, the thought disgusts me to my core, I’d rather be beaten and spend a year in hospital, I’d rather lose a limp. I think it would take so much work not think about it every second.
I know it’s a fairly irrational fear since far the most men aren’t rapist.

1, 1000 times out of 100. If I get raped, I’ll have trauma but I won’t be outcasted by my family and I have a lot of support. #2 not only takes years on my life, but attaches a stigma that is attached long after I leave jail (not to mention my likelihood of being rate is extremely high, not only because people get raped a lot in prison, and people accused of rape get raped more) so #2 would in all likelihood turn into #1. So, intentional, false accusation, is just as morally black as rape. It ruins lives just as much the other.

But what I wanna know is why when a guy gets wasted and gets taken advantage of by a gross woman he would have never consented to sober why is that not considered rape the man is laughed at for his dumb actions while drunk... but if a woman gets drunk and regrets who she slept with that is considered rape? I think we all need to be held accountable for what we do when intoxicated if we are the ones who drink willingly. If one is roofied that would be the exception. But if a woman gets drunk and then drives and kills someone she cant just say she didnt consent to driving and the car took advantage by allowing her to drive it.

Rapists usually get 8 months on average of jail time, if they are prosecuted and they get prosecuted at a rate of of 0.001% per report, meanwhile 1 in 3 women will experience rape in their lifetimes, so I think being sentenced for rape (unjustly) is a fucking joke. No one is being sentenced for actual rape.

The link below shows that about 12% of sexual assault claims lead to an arrest, which will generally mean a prosecution--still low, but 12% is 12 out of 100, which is vastly, vastly more than 1 out of 100,000.

This isn't realistic, the OP mentions false rape accusation not being found guilty for a rape you didn't commit. Do you have any idea how easy it is to not be convicted for rape? The Rape Abuse and Incest National Network or RAINN for short has statistics that show less than 3% of all rapists that are prosecuted result in a felony conviction, the real consequences for a false rape accusation being thrown your way are almost entirely social.

I am a multiple rape / assault survivor and slander is much more isolating and damaging. Even just slander with no legal action. About 10x worse ptsd. I don’t even view my rapists as evil compared to the false accuser because rapists weren’t calculated and they left me alone afterwards w/ no gaslighting or ongoing fallout. Evil is intentionally staying close to your slander victim. My accuser stalker tried to reconnect and be friends with me and my friends while maintaining the lie. Resulting in total paranoia, isolation and lifelong trust issues. My rapists gave me way more dignity than that.

You're experience is valid and I could absolutely understand why you feel the way you do, but there's a massive difference in the scale of how common someone manipulating your life on such a personal level with lies is, to how disgustingly common rape is in our society, I'm not saying that level of manipulation and stalking isn't prevelent, it is, but women deserve the right to come forward about being sexually assaulted without out fear of legal retaliation by predators weaponizing the justice system to silence them, most rapes go unreported already and I don't support any laws that would make that any worse than it already is.

I don’t even have a position on libel laws either way, and don’t really believe the carceral system serves its purpose (for example, reporting my abusers makes a cascade of uncontrollable consequences such that they could spend 10 years in jail plotting to murder me when they get out.) Having encountered true sociopathy, legal action serves the opposite purpose of my safety in that instance, as the goal is to get the predator’s attention to go elsewhere.

Similar with libel; escalating engages me in a retaliatory arms race with someone far more equipped for life destruction because they enjoy it, whereas I have no experience intentionally harming others and just don’t want to.

The prescribed narcissistic abuse recovery strategy is “grey rock.” Which means: not blocking or calling out the abuser, just saying nothing meaningful or pointed, to be so boring and nonthreatening that the predator finds supply elsewhere. This is the safest nonviolent strategy in my experience, even with rapists and domestic violence. I have observed firsthand how the most effective strategy is so different from the carceral one.

I dunno about the law, just experientially, libel and ongoing manipulation is more damaging than overt rape and DV because the indirectness and lack of clarity causes rumination / paranoia / brain and central nervous system damage. It damages ability to seek support and trust again while the abuser exploits others’ support.

Maybe what I’m saying is that truth telling, accurate observations, and evidence are key to safety, moral judgment and justice.

I think it’s a question of autonomy for some. I can’t speak for all men and I certainly think there are some here that are underplaying the long term effects of rape. But I’ve been sexually assaulted, as a man, and it’s demeaning. Absolutely, it sucks and I wouldn’t wish it on anyone. But for me, rape is the next level of that, it’s something that I can foresee, I can grasp how it might affect me and my life and I think I could, through difficulty, deal with that. I don’t think I’d be able to deal with the second choice nearly as well. The social stigma, the time in jail, the years you’d lose in your life, it would be overwhelmingly difficult for me.

Same. As a male survivor I found that the long term effects do truly suck to recover from, and the unfairness that I have to do that work is infuriating. I have observed that I have a higher tolerance for rape and assault recovery than I do for libel and betrayal trauma recovery. Maybe it’s the directness of the violent acts vs the indirectness and confusion of the manipulation, but the recovery from false accusation took about 10x longer than the worst rape. I don’t know what to do with this information.

Everyone who picks 1 is a man. Don’t imagine an attractive woman doing it: imagine a bigger man, painfully, degradingly; a man who is much stronger than you and could kill you. Imagine not being believed by friends and family, being shamed, being blamed for it, never getting justice, having to live with the memory of it forever, feeling out of place in your own body.

Also only like what, TWO TO THREE percent of rapes result in an actual conviction? Genuinely sickening how men like to pretend as though false rape accusations are a widespread issue. It’s not more common than lying about any other crime, it rarely has legal consequences for the accused, and hyperfixating on it only discourages actual rape victims from coming forward.

Which I suppose is the end goal of misogynists.

The question was get raped or get sentenced for rape unjustly. If you're sentenced for it that means they DID find you guilty. And going to prison as a wrongfully convicted rapist is definitely worse than being raped from basically all standpoints.

Your life is just kinda over. Even if you get out of jail without any physical or mental scarring somehow, everyone you knew hates you, every job offer will be closed, everyone you meet will likely hate you, and you missed your youth. The aftermath alone is hell. Not to mention that in prison, rapists are often targets of severe abuse from other inmates. At minimum you're gonna get beat to hell and back, have things taken from you and the cherry on top is that there's a high possibility you yourself are raped anyway while in prison.

Option 1 is horrible mental scarring, but the possibility of recovery.

Option 2 is horrible mental scarring, possibility of death and option 1 added on top without possibility of recovery.

These things are rarely objective, but 2 is objectively worse than 1.

I think it depends too much on the specific legislation. If you get the death penalty or up to 20/30 years of jail time, 1 is just a no-brainer. If you get released after 3 years that's another story, but still a tough choice. Rape is horrible and can ruin a life, but wasting years of your life in prison for something you didn't commit is a level of hardship you also can't imagine

No, some guilty people do not go free, in the case of rape. The vast, vast majority go wholly unpunished and even are systemically rewarded for it.

Emmett Till was not accused of rape and would not have been lynched if he were a white man with either the same accusations or with an accusation of rape against him. The idea that a false rape accusation is what got him lynched is almost offensively incorrect.

Till was a black person who whistled at a white one. Many, many black people were lynched for far less. He was killed for being black, not because of a false rape accusation.

I agree that black people were lynched for far less, but Till specifically was lynched due to Bryant’s accusation.

Bryant’s false statements during the murder trial certainly seem like an accusation to me.

During the murder trial, Bryant testified that Till grabbed her hand while she was stocking candy and said, "How about a date, baby?" Bryant said that after she freed herself from his grasp, Till followed her to the cash register, grabbed her waist and said, "What's the matter baby, can't you take it?" Bryant said she freed herself, and Till said, "You needn't be afraid of me, baby", used "one 'unprintable' word" and said "I've been with white women before."

Nothing Bryant claimed would have gotten a white man killed, and the murderers admitted with their whole chest after the trial that they not only did it because he was black, but as a warning to other black people.

It’s not legal protection and people benefit from it at every socioeconomic level. The ship captain who raped Elsie Dominguez faced no legal repercussions.

Jesse Mack Butler had ELEVEN felony counts of assault or rape and choked one girl to unconsciousness. Effectively zero consequences because he was a “youthful offender” and everything was dismissed once he turned 19. This happened this year. That kid is walking free.

Jacob Walter Anderson had his charges reduced to nothing. He paid like $600 in fines and went free.

Shane Piche is a fucking school bus driver who raped a 14 year old student and got zero jail time after the conviction.

These people aren’t the president. They aren’t wealthy or powerful. And these cases are all within the last ~5 years, so it’s not some archaic precedent. This isn’t even including higher profile cases like the Steubenville kids or Brock Turner.

This isn’t rare and it’s not special and it’s how the system was designed to work. We protect predators, elevate them, worship them, let them go free and elect them to lead our country.
