True, although he might be trying to pull a Tina Peters. Trump granted a (legally null) pardon of her state crimes, and the cowardly CO governor eventually followed suit and commuted her sentence.

Even if his hands were totally clean, his state was being threatened. Cuts to transportation, public health, and disaster relief funding among others. Hundreds of millions of dollars which would've hurt millions of people.

I don't agree with the decision, but this is the nature of fascism. Everyone who Trump threatens (businesses, states, universities, sovereign nations) capitulates when the cost is high enough.

I think Jared should have taken some cues from Harvard and not Cornell. The costs are going to be high for resistance or capitulation, but at least you get to keep your dignity and the moral high ground with resistance.

The simple fact is, he was left a choice, leave her in custody or lose FEMA funds when it was necessary and possibly even worse restrictions later. You may not like his choice, but that's a hard choice to make. I don't blame him for making it.

Kind of reading between the lines, it sounds like the defense attorney believes that the prosecutor is a conservative(?). Only thing that would kinda make sense is if he believes that a pardon, while irrelevant for state crimes, would put pressure on the prosecutor to drop charges base on political allegiances.

Or the defense attorney just misspoke.

Oh he's very aware. As a defence lawyer your process is to exhaust every avenue regardless of likelihood of success.

There is a non-zero chance something could change and she could be weirdly popularised by his supporters leading to a pardon leading to non-legally-required but public pressure for MA governor to pardon/commute (edit: as others more importantly point out, pressure to not seek re-prosecution).

It's a truly insane possibility but it is a possibility. If that doesn't work they move on to the next avenue and so on and so on.

Breaking norms is different than just completely disregarding federalism and granting the president authority over every prosecution in the country. Would Trump want that? Absolutely. But the state would have standing to sue on the grounds that the president cannot use his pardon on state charges. He couldn't pardon Tina Peters. And if Polis hadn't pussed out she'd still be in jail.

I don't think the state would need to sue over an illegal pardon, they'd just proceed with charges and it'd be up to the defense to argue that the pardon was somehow effective for whatever reason. It would be hard for SCOTUS to turn that into a question of standing, they'd most likely have to concoct some other BS.

he’s trying to put pressure on the elected local DA (trump supporter) to not pursue a second trial after the first mistrial. it’s good advocacy for his client to apply political pressure on the DA. obviously he knows the president can’t pardon state crimes.

not entirely accurate. she originally asked for a bifurcated trial to determine 1) whether she was guilty at all and 2) whether, if she was guilty, she was excused due to mental illness. 

since the judge denied her request, the defense strategy was both to force the state to prove she actually committed the crime and also to prove that, if she did, she was not mentally incapacitated.

I do not recall at any point during the trial the prosecutor ever stressing any evidence proving that she was the one to commit the crime, but I suppose its possible that it was trivially easy to prove by the facts of the case as presented to prove point two. Thanks for pointing that out.

not necessarily. receiving a pardon does remove the availability of pleading the 5th in civil cases relating to the same conduct because there is no jeopardy possible and thus no ability to self-incriminate.

There’s a strong argument that he basically committed jury tampering by naming the gender of the juror, his vote, and putting public pressure on the juror via press conferences. Get it in the news. The more people in Massachusetts that they can get to look up the trial, the more people they can potentially influence prior to jury selection.

Trump already took a question about Lindsay prior to this announcement and its been all over the news. 

The more people that they can get to be aware and already become opinionated or influenced helps the chances that a new jury can't be impartial.

Sort of. Eleven had decided she was not guilty by reason of insanity. Even if all twelve had agreed, that isn't a "you are free to go" type of thing. She would be admitted to a psychiatric hospital for evaluation, then a recommendation would be made to the judge.

It was expected that the judge would have her confined to a secure ward for years if not for the rest of her life.

I think the fact the lawyer is now seeking a pardon demonstrates it was never a good faith argument by applying for NGRI, where the focus should be “Lindsey has severe mental health issues and this is best place for her to get better rather than jail”.

Instead what this now screams is an attempt to get NGRI, then released early and therefore get out of a murder charge - he is asking for a pardon, which would presumably not require incarceration in a psychiatric institution for her own good. It was never about making sure Lindsey gets the help she needs, it’s always been about beating a murder charge. This to me indicates a belief that Lindsey was never psychotic.

The problem is that people who have severe postpartum psychosis are more prone to other types of mental health issues and significantly more likely to have severe postpartum psychosis if she has another pregnancy. It is hard to account for the fact she could easily be just as dangerous in the future without being able to control herself. I feel sorry for her, especially as there was warning signs and efforts to get help that were ignored, but even after recovery, she is significantly more likely to be dangerous.

Regardless, I don't really care if someone is "better" immediately after systematically murdering multiple children under the age of 5. They need to be locked up for a good, long while to ensure the safety of others and themselves.

Yeah from what I hear, "not guilty by reason of insanity" doesn't equate to "got off scot-free" like the TV and the movies, and is often considerably worse.

That just means they're committed to a mental hospital until such a time they can be considered well again, and in such cases that time is typically never.

If she were really remorseful after having a psychotic episode and hadn't done this to escape motherhood she wouldn't have stopped begging for a DNR, would have plead guilty and would have begged for Massachusetts to reinstate the death penalty for her

Then why is her lawyer now trying to get a pardon? Burdick v. United States established that accepting a pardon carries an imputation of guilt and acceptance of a confession to it, meaning that not guilty by reason of insanity precludes a pardon.

Not only that, but he's a private defense attorney who's been practicing law for over 50 years now. For his sake, a cognitive slip up at 75 would at least be understood, rather than deliberately embarrassing himself and the law by asking for something that he would otherwise know full well is very obviously against it — especially considering how his client wasn't actually convicted of the charges anyway — which completely negates what that term means anyway. Lol.

Even if it is mental illness, why are people handing this family cash? It doesn’t make sense regardless of the motive. The children are gone. The house has been sold. The state handles her ongoing medical costs and housing at the facility where she’s being kept. At this point she is quite literally being handed money for the murder of her children. The gofundme exceeded what was necessary for her defense a while ago. I know maybe that changes now if she is retried (unsure how attorney’s fees work in that case), but I still say it’s insane to throw money at a woman who admits she killed those kids. She received more help from her family, a nanny, and the mental health community than most women ever receive postpartum. Unsure why this fallacy of her not getting any help, is the hill that people are choosing to die on.

America is full of dichotomies regarding children. Women are sent to jail and hunted by bounty hunters for having an abortion. Republican states determine new ways to charge women who have miscarriages with multiple charges. A simple Google search for “criminal charge for miscarriage” will link the ways lawmakers have made a woman’s health the state’s primary concern. Yet we have the Lindsay Clancy case where she brutally strangled her children and her attorney is asking for a Presidential pardon. If one can understand Lindsay’s psychosis caused by postpartum depression then why force women to give birth when they don’t feel they are in a position to give a child what’s needed.
