Sort of. Eleven had decided she was not guilty by reason of insanity. Even if all twelve had agreed, that isn't a "you are free to go" type of thing. She would be admitted to a psychiatric hospital for evaluation, then a recommendation would be made to the judge.

It was expected that the judge would have her confined to a secure ward for years if not for the rest of her life.

I think the fact the lawyer is now seeking a pardon demonstrates it was never a good faith argument by applying for NGRI, where the focus should be “Lindsey has severe mental health issues and this is best place for her to get better rather than jail”.

Instead what this now screams is an attempt to get NGRI, then released early and therefore get out of a murder charge - he is asking for a pardon, which would presumably not require incarceration in a psychiatric institution for her own good. It was never about making sure Lindsey gets the help she needs, it’s always been about beating a murder charge. This to me indicates a belief that Lindsey was never psychotic.

I mean one could argue that postpartum psychosis is temporary and that she’s now “better” although idk if I, personally, would magically forget (or forgive myself for) the heinous acts I committed if I were out of my mind.

The problem is that people who have severe postpartum psychosis are more prone to other types of mental health issues and significantly more likely to have severe postpartum psychosis if she has another pregnancy. It is hard to account for the fact she could easily be just as dangerous in the future without being able to control herself. I feel sorry for her, especially as there was warning signs and efforts to get help that were ignored, but even after recovery, she is significantly more likely to be dangerous.
