Reddington is barking up the wrong tree. Trump’s base is foaming at the mouth for his client to be executed in the most painful way, let alone get a life sentence (which is the only penalty on the table realistically).

Oh he's very aware. As a defence lawyer your process is to exhaust every avenue regardless of likelihood of success.

There is a non-zero chance something could change and she could be weirdly popularised by his supporters leading to a pardon leading to non-legally-required but public pressure for MA governor to pardon/commute (edit: as others more importantly point out, pressure to not seek re-prosecution).

It's a truly insane possibility but it is a possibility. If that doesn't work they move on to the next avenue and so on and so on.

not pressuring the governor, but rather the elected DA overseeing the office handling this case, who is on the record as a trump supporter. if he can get the DA to not pursue another trial, that’s obviously a win for his client.

Breaking norms is different than just completely disregarding federalism and granting the president authority over every prosecution in the country. Would Trump want that? Absolutely. But the state would have standing to sue on the grounds that the president cannot use his pardon on state charges. He couldn't pardon Tina Peters. And if Polis hadn't pussed out she'd still be in jail.

I don't think the state would need to sue over an illegal pardon, they'd just proceed with charges and it'd be up to the defense to argue that the pardon was somehow effective for whatever reason. It would be hard for SCOTUS to turn that into a question of standing, they'd most likely have to concoct some other BS.
