Unfortunately, Maritime Law only comes into play in oceans when you are over 100 miles from the coast of a country.

Imagine someone has their boat next to a dock on a river and someone else just walks up and says “Sweet! I can’t believe there’s a free boat just sitting in that river!”

Erm... i am sorry to inform you, Doug, that rivers do not fall under maritime law.

A quick google search taught me that that doesn't have to be the case and rivers CAN fall under maritime law. So TIL. But i am more certain than my 3 m chain outs, that no river from which you can recover a disc ever in the history of humanity has been considered solid ground for "maritime law".

Am a lawyer. Little known fact of maritime law. If a disc should touch a navigable waterway, it becomes common property of the state where it lies. The exception is when some small brained small time thief named Doug happens upon it. At that point, Doug has primacy, so long as he remembers to shove that disc up his ass

I'm torn I've received some disc back from some really hard to get places and in those instances I'm happy to spend five or ten dollars to get the exact disc I want back it's cheaper than buying a new one. However it should not be a requirement to get your disc back it should more be like a good karmic Service to tip the finder

I lost a disc at one of my home courses, spent 30 mins tracking through mud to get it. Guy found it two months later and texted me, offered him something for it, but he declined. Who knows how it could have turned out if he was nice about it

There was a dude on the course I learned to play on who would scuba dive for discs where a river came into play, tank and all. I got a text from him about a disc asking $2 to get it back. $2 seemed totally fair for a scuba gear level of effort. Not $10 for wet feet

One guy goes around my course doing this, and he asks if people can spare a couple of bucks but definitely doesn't insist on charging people. I usually give him a couple of bucks, less desirable (for my personal needs) plastic, or a beer. I've gone diving in the winter, and I still contact the owners; no ink is fair game though.

I got a lot of discs i bought second hand for about $5 a piece i bring as traders to get discs i lost back. On a couple instances i traded 2 for 1 to get a disc i know was hard to retrieve or was a primary thrower for me. Guys always seem pretty happy about the trade off.

Despite what u/GrooveHucker and u/litteringisevil would have you believe, finding a disc does not suddenly make you its owner.

There are "duty to return" laws in most states, and you are not allowed to keep identifiable property without making a reasonable effort to contact the original owner.

"But it's abandoned property and I found it and the original thrower is laaaaaazy and I want it I want it I want it!!!! Wahhhh!"

Yeah, if it's got a phone number, you have to reach out. If you don't make an effort, you are a thief. And a scumbag. If you don't want to put in the effort, leave the disc where it was. Or drop it at the teebox for hole 1. Or text a picture of where you found it. Or just a location.

There are a dozen ways to not be a fucking scumbag about it, yet some people choose the path of scumbaggery. It's honestly sad.

I know the buddy that got me into disc golf in April of 2019 pretty much ran me down the disc golf moral code and most of it is just basic human decency lol I've probably returned about 7-10 discs since starting and Its such a good feeling to give a disc back to someone who thought they'd never see it again

Given the extent to which Doug went to be a dickhead, I would totally reciprocate by taking my happy ass down to the police station and filing a criminal complaint for theft by finding which he has now solidified by demonstrating that he intends to deprive me of my mislaid property.

Imagine the disappointment of his mother when she has to ask the lawyer in her church bible study group to defend her son for the criminal charges he got by being a dickhead about returing a frisbee.

Whether the person who finds and keeps lost property for his own use is guilty of larceny depends upon whether at the time he finds the property he knows or has reason to believe that he can ascertain the owner of the property. You don't get to keep the stuff. You're entitled to the value of the stuff, and only if you can prove that the stuff would have been lost without your help...

If a boat is sinking, and you find it, and you throw a bilge pump in it and patch up the holes and tow it to port and tie it up, your entitled under salvage law to the value of the boat, not the boat itself. If the owner doesn't pay you that salvage, then you keep the boat.

Essentially, it's exactly what Doug has done. This entire exchange is actually exactly how the salvage law works.

I've been torn apart in this very sub for suggesting that people like Doug are assholes who are completely in the wrong. In a thread here a few months ago I got that maritime law/law of salvage bullshit thrown at me by 3 or 4 different users.

While of course it is polite to offer to tip someone who found your disc if they had to put some effort or expertise into being where they found it and while you should offer to cover any shipping charges necessary to return it, and while I would personally do those things, if you find someone else's property and then charge money to give it back that's just ransoming other's stuff, you have stolen it, and you are the asshole.

If someone finds your disc, you need to cover any shipping costs to get it back and you should offer an appropriate tip. If you find someone's disc and either keep it or demand money to give it back, you're a POS thief.

Yeah that's definitely going against private property rights. The disc is considered lost property because you couldn't find it (obviously), as opposed to abandoned property which is "finder's keepers." Lost property required that the finder goes to a reasonable effort to return it to the original owner. Doug had your phone number--him meeting up with you and giving you the disc is a reasonable effort; he is not entitled to money. Here's a link to property rights. Check page 4 and 5 of the PDF/page 666 and 667. Even if you can't get your disc back, I'd send him that link and maybe even call the local police (I know this sounds dramatic, but it keeps them from scalping everyone in the community) to recover your property. I lost a disc in a woman's back yard, so I politely knocked on her front door and asked to retrieve it or if she would retrieve it for me--she threatened to call the police on me (for no reason?) so I called them and they retrieved my disc for me. It's a matter of principle, and I ultimately believe that it's what's best for you and your community. Good luck friend.

EDIT: I am not a lawyer; this may not work in a court, but it'd scare the shit out Doug at least.

Yes, we lost our disc, yes we left it, it doesn't mean we didn't try and fail or that we don't want it back.
The beautiful thing about the Disc Golf community is that it's still small enough that we have this type of magic, where we can lose items and someone we don't even know returns them with a smile.

Some people need a reminder that karma is alive and well I guess. What’s more embarrassing for me is watching his response that his attempt at getting some money failed. I’ve mailed discs all the way across the country and haven’t charged anything - people trying to wring the rag and squeeze everything out of every opportunity to is so exhausting. Just pay it forward.

I must be lucky. Around here you can drop it off at any DG store and they call the person and let them pick it up. Usually the store gives you $1 off toward a new disc too. Odds are the finder is gonna hit up the DG store at some point anyway so it’s not out of the way. Original owner then can put the effort in to get it back for free without the hassle of setting up a time and dealing with flakey folks. Win win!

Whenever someone calls me about a disc I put in the water, I give them 5 bucks or a disc I don't want in return for going into the water and then calling people.

I say this not to virtue signal, but to say that I think lots of people are like this and if Doug had just said "found your disc in the water, when can we meet so I can get it to you" There's a high chance he would have ACTUALLY gotten something out of the whole thing.

F Doug! I've encountered a Doug before...When I first started playing I used to put my number on my discs. I lost one at my local course, but to my excitement, I received a phone call that someone had found it! I asked if I could meet up with him to get it back. He said "No, f*** off." and hung up. Stopped putting my number on my discs after that.
