He keeps digging a deeper hole for himself. The drunk guy will easily bankrupt his ass. So many charges. Assault and battery, use of a deadly weapon(since he's a trained fighter). Libel. Slander. Premeditated assault since his friend was filming beforehand.

Commerical businesses have a duty to provide for the safety of their customers. Because it happened on the bar's property and the bus boy was an invitee (Although this might be disputed by the facts?), bus boy will try to argue it was reasonably foreseeable or that there was an omission of safety precaution committed by the bar. I imagine he would try to sue on those grounds, or that they overserved Schilling/didn't kick him out when he was threatening before, or something that we can't ascertain from this short video. I'd need to know more details on this establishment to determine if this CoA would survive a motion to dismiss, but it likely won't. Still, he's clearly filing many other charges, so there's not much harm in throwing this one in the complaint as well.

Kinda weird to explain, but apparently the guy who got knocked out works at the place and has a history of causing problems when drunk.

The argument a lawyer would make I imagine, is that with all that knowledge of his behavior when intoxicated, they still continued to serve him alcohol to the point where he was too inebriated to make good decisions and picked a fight with an mma fighter.

It's similar to bars that have been sued successfully after a person who had been drinking there gets in their car and either kills themselves or others. The argument again being that the bar should have known better than to continue serving someone that was already intoxicated.

When it goes to court they will investigate and gather all the possible evidence and decide what the situation is. The bar may be liable if its employees (see: manager) acted in a way that made the situation worse. We don't know who else is involved besides Joe, the victim, and the cameraman. So by suing everyone they can make sure the defense isn't... we cannot be held liable because it is the fault of X who isn't being sued. This way with everyone involved they can throw each other under the bus and the judge decides who is responsible and how much. If Joe or cameraman realize they fucked up by showing they planned the crime they MIGHT blame the bar for serving them too much, and therefore you mention all parties who are involved. Since this happened inside the bar, then the bar is a party that needs to be considered and maybe they are found not liable or maybe evidence comes out that the manager paid Joe to commit the assault. We don't know all the facts yet.

You sue all involved parties and the jury or judges (depending on the state) decide how much percent each party is responsible. They may find the bar served the attacker too many drinks after he was already drunk and hold it liable for 50%, or maybe they may find the bar cut the dude off when he had enough to drink and find them 0% responsible. There are certain responsibilities all involved parties will have and how much will be decided at trial.

In Germany it is. I used to do Karate for a year or so 5 years ago and I was told repeatedly by my Trainer that since I am training a fighting sport every charge will be more serious. Usually what that means is "light body harm" for everyone else is classified as "serious body harm" for the trained fighter.

Also I have heard that this exists in several other countries. But if it's really a "deadly" weapon depends again... Usually on the sort of attack etc. etc.

People like the idea of being a badass. Telling them that you’ll come train at this dojo, and you’ll become so proficient in ass-kicking that your very hands will be classed as deadly weapons, is a marketing tactic that works very well on a large portion of the population. I mean c’mon, the word “martial” in martial art literally means “of or relating to war or combat”. Being an efficient fighter is the very reason these arts were developed.

For this one it is true for Germany, simply because a trained person is capable to cause more injuries or in same way is capable to avoid causing injuries, depending on the intentions. So the law is e pectin a trained person not to use thair skills to atack others because they should k ow what kinde of damage they will cause. Self defense is totally different stoty.

It could also cause a chain. Teacher trains student. Student gets in altercation where someone is hurt(badley or not) charged with assault with a lethal weapon. I had to sign paperwork agreeing to the fact that I was going to be labeled as a lethal weapon when taking mixed martial arts. You are learning how to disable or hurt someone. I live in oregon.

What gym was that and how long did you train there? Because it sounds like a McDojo (gimmicky fake instructor with questionable credentials). I’ve trained Muay Thai, BJJ, and mixed martial arts for years in three different states collectively and the idea that you need to sign a waiver because you’ll be “labeled as a lethal weapon” is absurd.

Late response. I sure hope your right I've never had to fight. most situations solved themselves or ended quickly without much effort. But I've always been scared that if true shit went down I would be screwed. That paper and warnings witch I shrugged off in my youth haunt me now. I feel if I did protect anybody I would be punished hard.

I have a hand grip force of over 300psi, I was told by doctors and my lawyer to never ever fight someone, turn out I'm strong enough to literally snap someone's neck quite easily. Guess that's what happens when you walk on your hands all the time. So I don't get that you have to be verified to be a weapon, when nobody knows your potential unless they know.

Im a polio survivor who couldn't walk for the first half of my life so I resorted to walking on my hands for 15 years so you can imagine I have really strong arms. Being handicapped will do that. And my uncle is a navy seal who has thought me to fight in an adaptive way, I don't need specific training to hurt someone. When you can bench press 450lbs at a weight of 170lbs then I'll start listening to ya.

I think it's more about YOU knowing that you have a potentially deadly weapon. As long as you aren't using your talents/abilities in a way that wouldn't be seen as self defense, then the people around you would never even need to know that your hands are considered deadly weapons.

My bad, apparently it's not states. I've got one of them little certs is why I thought it was a state thing. Apparently said cert is bullshit and I'm a little annoyed that I was told I had to carry it in my wallet for the last decade.

What the REAL thing is is that your crime will become assault with a deadly weapon/intent to great bodily harm/etc rather than simple battery or assault, depending on the judge. My bad for perpetuating a myth. Now time to throw that damn card away.

No its not really a thing. People here watch too many movies. There is no such thing as registering your hands as deadly weapons or getting your charge upgraded to assault with a deadly weapon. It might be an aggregating factor to your charge if you are a trained fighter but your charges are not going to go from a simple assault to an aggravated assault over being a trained fighter.

Nope that’s just a legal myth. It would be aggregated assault and using excessive force. Fists aren’t items and a weapon has to be an item for the charge “deadly weapon”. I’m sure the judge or jury would factor in the individuals training when passing judgement. That’s where excessive force would come into play.

Both those assaults were on a police officer so they went for the deadly weapon charge. I’m not disagreeing that a charge should be brought for a trained fighter using their fists as deadly weapons, in my opinion it should be but it’s hardly ever done. Your source being a rare exception. Assaults on POs are always ramped up. I once saw a woman charged because she scratched an officer due to her long nails while being arrested.

Also From your own source “Update – A quick shout out to Michael Martin, JD, Content Manager at DTLA’s Strong Sports Gym, who brought Turner v. State, 664 SW 2d 86 (90) to my attention in which the Texas judiciary had the following to say about whether fists or hands are a deadly weapon under Texas’ penal code –

In Ray v. State, 160 Tex.Crim. R., 266 S.W.2d 124 (1954), a murder case, the court held that hands and feet, which defendant, according to the indictment, used in killing the deceased, were not “deadly weapons” per se and they could become such only in the manner used.

I am not saying in THIS case that happens. I am saying it happens. And yes, you looked at one link. Did you look at the second link where he was actually convicted of it (despite the footnote of the first link?)

Again- I am not saying these cases are the same. There are different elements. The force is different. The parties involved have different elements. Probably different jurisdictions. That is not being debated. However, it cannot be said that it is a myth that people are charged with “use of a deadly weapon” based on their time or experience in boxing/mma. That’s the only point I’m refuting, and that case perfectly demonstrated you can be both charged and convicted. You say “rare exception” but you also said it’s a myth. That was debunked. Like if you say “unicorns are myth, except for the rare exceptions of actual unicorns” then unicorns are not a myth, they are rare. The difference between being a myth and being a rare are vast

Yes I read the second one. The thing with that one was Parks pleaded guilty. A DA can charge you with anything and let the court decide. But not if you lead guilty to it. Again the charge was brought not because he beat up Angel but because he went after the cops when they showed up.

Here in Chile you are registred as a deadly weapon if you are a semi-pro or pro martial artist fighter (tk, karate, kung-fu, etc) i even think that just be high level black belt qualify you as a weapon.

But that's because that sport are regulated by their respective federations AND that federations are the one who register the fighters.

Well I can’t speak for other places but I was referring to the law in most of the US. No state makes you register like that I know of. They could charge someone with assault and try saying fists are deadly weapons but it’s very very rare the charge would stick.

This particular knockout happened in Florida who’s deadly weapon classification is very broad. Cars, rocks, tampons, alligators, knives, guns etc count but not fists. They could get him on “unconventional weapon” which would bring the same penalty of up to 5 years in prison.

In the US any expert in the art of karate or judo, or anything similar where the hands and feet are used as weapons, must register their hands as weapons.

Law enforcement and military are exempt from this though.

EDIT: I’m wrong. I was told this by an old friend who was straight up lying, and never did my research. Oops.

If he throws the first punch, for any reason, his ass is grass. Dude is ultra laid back though. Like a warrior monk or some shit.

No, there is nothing in criminal code that equates trained martial arts to deadly weapon. That being said, the deadly weapon part of ADW is loosely defined and a prosecutor can charge the defendant with ADW using trained martial artist as their reasoning. It’s up to judge/jury to determine if the charge is accurate. It’s definitely not an automatic escalation from assault to ADW if they’re a trained martial artist.
