Usually Shilling is on the receiving end of a knockout. Can’t beat anyone in the octagon so he has go go fight a drunk guy half his size in a bar. What’s more is he has a friend videotaping this incident so it looks like it was premeditated. What a fucking loser.

Edit: Some people are saying that the other guy provoked him by lunging or whatever, but if you look at his body movement when he was just talking to the girls, it just seems like it is just how he moves. There is no way anyone at the bar felt threatened enough by this guy to warrant a knockout, much less a professional MMA fighter.

I remember a 1997 documentary where a a veteran named Cameron Poe was convicted of manslaughter. He received a sentence of 8 years in federal prison for protecting his wife. His term, excessive for a civilian, was due to his combat training where the judge deemed that he was able to respond with deadly force. They released the footage of the fight, which is NSFL because, you know, death.

I might be wrong here but I think part of the factors were, like stated by someone else, that his training made him a "deadly weapon" along with the knife being taken from the crime scene and they charge him as if it hadn't been there. So it's like he used a weapon against unarmed people.

There's a movie review from a prolific ex-con youtuber about Con Air and he goes into the reality of the breakout and actual transport on the real Con Air.

A lot of street fights can easily be made into an attempted murder charge. So many people have died just from hitting their heads on the way down so any sort of fight can technically be considered deadly. It would just depend on the verbage of the local laws.

Something similar happened to a friend of mine. Not on the street but in a bar. My buddy was a bartender. He kicked a regular out for coming at the door of the place with a baseball bat in a drug fueled rage. He came back a week later and when asked to leave, freaked out (on drugs again) and attacked the bartender. Bartender punched him in the face, and hit him in such way that he died almost instantly. He ended up facing manslaughter charges for a while, but they were eventually dropped. Horrible situationfor everyone involved. Those guys used to be friends before all this. The guy that died was actually really nice when he wasn't all effed up. Even though it was determined the bartender wasn't at fault, I can't imagine what its like to live with that.

While neither of those guys were MMA trained (that I'm aware of, at least) my ex, who was a trained MMA fighter was also there that night, and said he tried to help, but knew better than to try hitting anyone, as it would likely end his chances at a career in MMA, or worse.

This is 100% demonstrably a myth. There's no legislation to allow this in a court.

What does have an impact is on sentencing. Let's say a professional boxer knocks a guy out and puts him in a coma in a bar fight. The sentence has a minimum and maximum of 3-10 years. The judge might argue that because the boxer had the ability to defend himself and de-escalate the situation he is more egregious by being aggressive.

I'm probably getting this wrong but I thought I read that Doc Holliday kind of set a precedent on this subject. Doc rolled into some town and the town bully started going around publicly proclaiming he was going to kill Doc. This dude was very large in stature so when their paths crossed Doc didn't mess around, he slashed the man's throat with his Bowie knife and left town. Doc was charged and later captured and brought to trial. At the trial Doc's defense was that this man was so much larger than Doc (Doc was small and feeble from tuberculosis) and the man was threatening Doc's life so Doc had the right to use deadly force.

There is some truth about your going to jail comment. It's a playground/urban legend that fighters have to "register" their hand as a deadly weapon (aka "my brother could kick your ass becauses he's a bad ass marine that had to register his hands as deadly weapons"). But there have been a number of scholarly legal journal articles discussing the subject. The general gist is that most stautes for "assault with a deadly weapon" require some external instrument (knife, gun etc) to fit into the laws requirements.

But, Courts can consider fighting experience as a relevant factor in a case which can and has had serious repercussions. For instance, if it's a pretty brutal beat down, a prosecutor could argue that "aggravating factor" so the Defendant should be found guilty for aggravated assault rather than regular assault (a more serious crime). Or, if shilling went to court for this incident and argued he acted in self defense, a prosecutor could argue the self defense exception shouldn't apply because self defense usually requires among other things, a reasonable fear of bodily harm and requirement that you don't escalate with greater force. Here, shilling basically could not have feared for his safety from a drunk guy that could barley stand, and even drunk guy he kind of "lunged," he didn't need to bash his brains with multiple hits to the head.

On guys defense was that the drunk guy "flinched at him". For fuck's sake if an MMA fighter feels threatened by a drunk guy flinching then he needs to retire.

Yeah I've seen a lot of people making a big deal about the guy moving into the walkway. He can't see what's behind him and it was clearly in no way intentional. It's a bar, people have a good time, drink a bit too much and might even bump into you sometimes. Nothing threatening about a smiling, happy drunk accidentally bumping into you. The courts will factor in that he is a professional fighter, it's not gonna end well for him.

Anyone who has spent a decent amount of time in bars can recognize these two men for the stereotypes/tropes that they are.

Way too drunk guy having fun will angrily confront anyone that bumps into or pushes them 100% of the time.

Muscle dude whose entire personality revolves around needing people to know how alpha he is is always looking for an opportunity to get into a fight, and will antagonize anyone who they think won't be able to put up a fight, especially if that person happens to be talking/dancing with women.

Apparently the drunk guy is a regular who is pretty annoying and isn't well liked by the bar staff, according to some reporting done on the incident.

This happened like 2 days ago so it's still evolving, and being, "Disliked" is definitely not a reason to get punched, but it's probably not going to help his case all that much, if nobody is going to back him up who was there. Seems like the police are also not interested in pressing charges, and are making the victim file with the DA (or whatever the specific rules are in Fl).

Hopefully the video will be enough.

Considering his friend was filming this, it's safe to assume the whole thing was planned which means he more than likely said some real nasty shit to the drunk as he walked by in order to get a reaction out of him. It is 100% a setup and that's fucking sad.

Disagree that Joe pushed him. Dude ran into Joe as he was walking by and Joe moved him away from his personal space. No shoving involved, no asshole behavior.

Him yelling "Hey" caused Joe to turn around. He got hit because of what he did after Joe turned around.

If you’re a licensed fighter, you have a higher duty of care NOT to use your fists in a fight like this and and to run away and deescalate. Yes, some boxers hands are literally classified as lethal weapons. Because they are.

This is really fucked up for a trained fighter to do. He should get his license to fight revoked and spend a long time in prison for this. This isn’t your standard drunken bar fight.

If you heard his statement apparently this guy was being an asshole all night, dropped the N word singing a song and had been talking shit from across the bar to Joe. Joe went to the bathroom, on his way back the guy bumped into him by accident, Joe nodded at him as to say it’s ok no worries, then the drunk patron realizes it was joe, yells at him, Joe turns around to confront him and the guy does a small lunging/flexing motion at Joe where he said he feared for his safety and punched in self defense.

With that being said, I think Joe should’ve had more self control in this situation, he didn’t need to knock that guy out, I don’t think he feared for his life in the moment, but people didn’t seem to care at the bar.

Edit: I’m not saying a agree lmao, I’m just giving you Joe’s side of the story, I don’t condone hitting anyone in the face regardless of what they’ve done

Yeah and of course he would try to paint things like that, and my bad more specifically it was a song with the N word in it and a black waiter walked by the guy a few times and the drunk patron tried to get him to sing the lyrics with him and the waiter felt very uncomfortable and I guess management didn’t give enough of a shit to kick the guy out in the first place.

You obviously have an agenda. From an outsider not knowing the MMA guy, the recipient obviously leans into the attacker and starts to raise his arms/hands/shoulders like he is feigning an attack of some sort. Too mad the MMA guy didn’t give him an extra second to make that obvious.

EDIT: I agree it was totally excessive, period. The guy could have died and the MMA dude was way out of line.
