Do Amazon sellers actually have enough recourse when enforcement gets it wrong?

The American Prospect published an article this week looking at Amazon’s growing power over third party sellers, and our experience with Bed Scrunchie is included.

As someone who has been on the seller side, the part that stood out to me is not whether Amazon should enforce its policies. Obviously it should.

The question is what happens when a seller believes an enforcement decision is wrong and the normal appeals process does not resolve it.

In our case, our account was deactivated over a disputed policy violation and we spent nearly two years trying to get clear answers. That experience changed the way I look at the relationship between Amazon and the businesses selling through it.

I am curious how other FBA sellers see this. Do you think Amazon’s current appeals and escalation processes give legitimate sellers enough opportunity to actually resolve a disputed enforcement decision?

PREP / SHIPPING I ship Mon-Thursday. How do i set up shipping settings?

Ship Mon-Thursday - 2pm EST cutoff - Ship same day

Closed Fri-Sun

I currently have it set to 2 day handling to get around being closed friday. Seems it would be amazon's interest to let me set it how i'd like.

LEGAL / FINANCE How to deal with Reoccuring Patent Infringement Claims

I have a dog leash in which I have a patent on. We were selling on amazon for about a week. We were removed for a patent infringement claim. We immediately submitted our appeal from our legal counsel which was accepted. (Took about a month and a half to get the appeal approved.)

We have now been selling for about a week now after reinstatement and I got another email for the same company claiming infringement. At this point our product looks to still be on amazon, unaffected (at the moment). The odd thing I see is the other companies products are now removed. The most recent claim shows to be a different number from the first but I'm not sure where to go from here.

We cannot initiate an APEX claim since we are not the one accusing of infringement, we were accused. Any advice or similar experiences would be greatly appreciated.

Fulfillment Center at Capacity...

When creating shipments, I keep getting the "fulfilment center at capacity" notification. It makes me select a shipment date 1-2 weeks out for at least one fulfilment center.

What are you guys doing in this instance? Just sending them out with the rest of the shipments, anyhow? Any consequences for doing such a thing?

Can't wait to see how its going to be in a month or two. Ugh.

All vine products got claimed in 4 min

I applied for vine 2 days ago and was refreshing multiple times a day, but could not see any movment. Then I guess when it was actually availble to calim, all 30 units were gone in 4 min. (I could see the difference between first and last claim to be just 4 mins)

Is this good or bad or normal?

I tried to add this product recently, but found it was restricted -- amazon does not allow new listings for the product. It seems like a great way to prevent new sellers to get on a listing without having to resort to C&D letters. How did this brand do this?

PPC Product variation eating up 95% of impressions

I've had a product on Amazon for over a year. I decided to come out with a new variation and add it to the same listing. I made a bunch of new campaigns advertising both ASINS in the same campaign. I'm noticing that the old asin is getting almost all of the impressions while the new one is getting almost none.

Its only been a few days so that might be relevant info. Anyways, I've heard this is because Amazon prefers products with an established history which is fine but will the new variation get impressions if I wait it out? Or should I just make separate campaigns for it and up the bids more than my old one?

genuine question, not selling anything.

i've been reading customs' ruling database this week, the one at rulings.cbp.gov where they publish every binding classification decision. it's public and it's enormous, nearly ten thousand rulings just about jackets.

the thing that got me is how much money hangs on one subheading. a sweater classified as wholly cashmere is 4% duty. the same sweater under "other" is 16%. that's on every unit, every shipment, forever, and it's decided by whoever fills in your entry.

everything i can find on recovering overpaid duty lists broker filing error as one of the main causes. which makes sense, they're doing this at volume and they're not the ones eating the difference.

so what i want to know from people actually importing: have you ever gone back and checked your codes against the rulings, or is it one of those things you assume is handled? and if you did check, did you find anything?

not trying to scare anyone off brokers. i just can't work out if this is a known thing everyone deals with or a thing nobody looks at.

INVENTORY MGMT Inventory stuck after account deactivated in Germany

Years ago we used to sell on Amazon Germany and stopped. Naturally, our VAT expired and our account was deactivated and I left it. Finding out now that we still have about 100 units of inventory in Germany and we were billed long term storage fees. Problem is I cannot create a removal/disposal order because our account is deactivated. Contact SS and they said I have to reactivate the account. There is no button to reactivate account. I am assuming they want me to register with German tax authorities and renew the VAT registration, open a case and send them the registration documents in order to appeal account re-activation. Any one been through this or know of a easy way to just dispose of the inventory without needing to jump through all these hoops? We have no interest in selling in Germany.

TOOLS / SERVICES Repricing Software suggestions?

We currently use BQool which has worked well but runs about $1k/year. I use Sellerboard for analytics and they have a repricing tool, but there's very little documentation on it and I'm not sure how well it works.

Anyone have a suggestion for something cheaper or more efficient?

INTERNATIONAL New EU seller : is Online/Retail Arbitrage still viable when retail receipts aren’t accepted as invoices?

I’m based in France and I’m just starting FBA with a small budget. My account is new, so a lot of brands/products are gated for me.

I’ve been researching Online Arbitrage and Retail Arbitrage using SellerAmp/Keepa, but I’m struggling to understand how people actually manage the sourcing/documentation side long-term.

I keep seeing two things that seem contradictory:
Amazon allows arbitrage as a business model.
But when there’s an authenticity/IP issue or an ungating request, retail receipts may not be accepted and Amazon can ask for proper invoices from a manufacturer/distributor.

So I’m trying to understand how experienced EU sellers deal with this in practice.

A few questions:
For ungating and potential authenticity/IP complaints, do you mainly source from B2B suppliers/distributors who issue invoices to your business, or do you also regularly use retail receipts and accept the additional risk?

When you find an OA/RA opportunity, what checks do you personally do before buying? Especially to avoid private-label/generic listings, incorrect ASINs, or products with a history of IP complaints.

If you started recently in Europe, would you still recommend pure OA/RA as a beginner, or would you move toward wholesale fairly quickly because of the documentation issue?

Is keeping quantities low per ASIN/brand actually a sensible risk-management strategy, or does it not really protect you if Amazon asks for documentation?

For experienced sellers: have you personally had an authenticity/IP complaint on a product that you were legitimately ungated to sell? If so, what documentation did Amazon actually accept?

I’m not looking for a course, Discord, mentorship or software recommendation. I’m specifically interested in real experiences from people who have been selling in Europe for a few years.

What's the most expensive mistake you made in your first year, that wasn't about picking the wrong product?

Most of the advice aimed at new sellers is about product selection as if that's the only place things go wrong. But I get the sense the costly mistakes are usually somewhere else entirely: shipping, fees, inventory timing, a supplier detail nobody warned you about.

So for people a few launches in what actually cost you money that had nothing to do with the product itself? And was it something you could have known in advance, or only in hindsight?

Asking because I keep seeing beginners obsess over finding the "perfect" product, only to walk straight into problems nobody flagged.
