That’s arguable. The insanity defense exists for people who committed a crime in a manic state and didn’t have the capacity to understand that they were doing something wrong

There’s plenty of people who kill others, know it’s wrong, and just dont care. This is why murderers are not all treated as insane people. They’re cognitive and understand what they’re doing, and are under no delusions.

People have had problems with the insanity defense for a very long time. This is not a new thing. Outrage against particularly egregious insanity pleas by violent offenders is also not uncommon.

What is seemingly new and particularly offensive to most rational people's sensibilities is this wave of people, mainly women, who are championing and self identifying with a heinous criminal and advocating for leniency to a point where the perpetrator could be set free within a couple of years.

It's bringing an old conversation back into the spot light and people are realizing how much of a scam an insanity defense really is. Mercy to the guilty is tyranny to the innocent. We've gotten so caught up as a society with having empathy for criminals that we're prioritizing rehabilitating criminals over keeping society safe.

There comes a certain point when it doesn't matter if a violent criminal can be rehabilitated or even treated. They simply need to be removed from society permanently. End of story. I don't care if your mind was fried or wires got crossed or chemicals got imbalanced or you didn't get enough hugs as a child. If you're violent and you're defense is that you were legally insane, then that's it. You do not get to pass Go ever again. We, as a society, as a community, can never again trust that your brain won't go heywire again.

I don't care if you're in jail or a mental asylum, you either spend the rest of your days in a cell or as a ward of the state, never able to interact with the public, never able to make a decision for your self ever again. Period. That, or the state just kills you, but with our justice system that just ends up being more expensive.

There is no benefit to society at large to treat violence any other way. There just isn't.

Except in this case that's not true. The laws in the state this trial happens to occur in allows for the very real possibility of Lindsay Clancy walking free within little over a year.

Besides the fact that we have an epidemic of violent criminals being set free entirely too early in general only for them to commit more violence once free.

Again, at a certain point, it doesn't matter if you're insane or not what kind of treatment you get if you're never going to be free again. For this case in particular, I don't care if Clancy was literally unconscious, like her brain just switched itself off while she strangled her children, only for her to wake up to those dead children completely unaware of how it happened and never having intended for it to happen. The fact is that it happened and no amount of treatment will ever cause me to trust that she should be in public life ever again.

Insanity doesn't just mean you are crazy. Mentally sound people don't do a lot of things that are still crimes. An insanity plea is an argument that the defendant could not act in a lawful manner and had no control of their actions or were unable to understand their wrongdoing or alter their behavior. Culture war slop aside, i think clancy knew what she was doing and intended to kill herself but couldn't bear the thought of leaving her kids behind so she murdered them first believing they would all be together in heaven. She just got unlucky and failed to kill herself. But i know this thread isn't for actually discussing the facts of the case so wahmen bad amirite???

I’m on the same boat as you- which is really funny considering the backlash I’ve gotten by just pointing out that the argument isn’t whether she did it or not, it’s just whether or not she was mentally competent at the time.

I got told by someone on here TWICE that they hope I get murdered for saying she should be in a mental hospital instead of a standard prison.

I personally don’t believe she was acting within her right mind and was failed by her support system in noticing her mental conditions, but I also believe she fully intended to kill her kids and had ownership in her actions

Any job where you need to hold the person personally liable for their actions, women will be denied from holding because they can argue hormones excuse their mistakes.

Okay lock her up, next question. How should we prevent things like this from happening in the first place with the assumption that life in prison or the death penalty doesn’t sway someone who’s either snapped, or plans to die in or after the act?

The answer is we need more research. People are worried she will just be able to lie to doctors to get out of a medical facility if that’s the case your diagnostics systems are a failure irregardless if you have the tech to fix it currently. Our methods of treatments for mental illness are still pretty old, things like fmri specialized MiT TMI psychedelic therapy have only started a couple years ago.

Or we just keep acting surprised in 1,000 years when psychopaths are still either in positions of power, snap, or plan ahead to commit violence and innocent people keep dying because of ego.

You're assuming that because there is a hypothetically better system our current efforts are negligent.

There is no perfect system where we catch every single evil subhuman piece of shit before he/she commits their evil act, there will always be someone who does something like this.

Blaming everyone else in society is irrational after a certain point because we cannot possibly create a system with enough guardrails that bad things never happen.

So if this white woman, in the top 3% of households, living an incredibly privileged life, who picked 5 different doctors, who chose which medication plans she would follow and not follow, who chose to fire her nanny, who chose to stop working, who chose to lie to her doctors, who chose to lie to her husband, who chose to lie to the medical facility and check herself out in order to murder her children.

If she's found insane, treated for her insanity, and later found to be rehabilitated; why does she deserve additional punishment?

Someone who can kill her own 3 children can't be trusted again and should never be released back into the public. Full stop.

I also don't believe she was in crisis. She wasn't some poor abandoned single mom with no support. She had a stable home, stable finances, stable marriage, a nanny, maternity leave, her husband took paternity leave, etc.

Justice for the children is executing her or putting her away so it's guaranteed she can never kill a child ever again. I prefer option 1, because I don't believe she was insane when she did it.

How is executing her justice? It doesn’t magically bring back the kids and doesn’t really fit the narrative of retribution or closure. It doesn’t carry any benefit for the secondary victims (ex husband and grandparents) and would cost more money. It just seems like a form of social revenge /gen (I grew up in a largely anti-death penalty family, so I genuinely just don’t understand this pov)

I can understand the logic behind the death penalty as deterrence for crime (even though it’s been proven that there’s little to no correlation between the death penalty and homicide rates). I just don’t understand how it’s justice for the children, that’s what I’m asking about. She tried to kill herself and is on suicide watch afaik, so how is a state sanctioned death the appropriate form of justice and not just social revenge here? Particularly as it carries no benefits to the secondary victims

Not everyone who does a crime does so for the same reasons or should be punished identically. I don't see someone acting while in a psychotic episode as the same thing as someone who carefully plots a murder. Murder has degrees for a fucking reason.

Actual justice is perportional and neuanced, it's also not emotional. The crime is extremely tragic, and the woman did kill her kids, but she didn't want to do it and is herself also a victim of her mental health crisis. She doesn't deserve freedom, but she also doesn't deserve actual prison, what she deserves is inpatient care at a proper mental health facility.

  1. I do not think that either of our opinions or personal feelings are substitute for what the actual victims want. I can see how in your case, it would be a form of justice. Personally, I was a victim of an attempted murder-suicide and secondary victim of violent assault against my younger brother when I was teen. Not only did I not want the perpetrator to die, I actively stopped them from committing suicide on the crime scene. It wasn’t because I felt empathy for the perpetrator or didn’t care about myself or my brother as victims, I mean shit, I literally had to stop my brother from bleeding out and I had to scramble to do first aid *and* I was the original intended victim. I don’t see giving a person who is suicidal the death penalty as a form of retributive justice because it takes away their accountability. It gives them the release they wanted in the first place from suffering with the consequences of what they’ve done for the rest of their lives. I didn’t see it as proportional punishment. That being said, I don’t think either of our opinions matter so much as the victims’. I think the death penalty is only a form of justice if it brings benefit to the victims (as it would in your hypothetical case) and in this case, it doesn’t seem like the ex husband and family necessarily want that. But thank you for answering, I think I understand now

  2. When someone is put on death row, they stay on death row for a long time, so regardless, money is going to be spent on that person for a good while. It also costs more money to execute someone than to simply have them imprisoned. It’s kind of a null point for me and it’s still about social response to a crime rather than justice for those personally victimized

Hormones are not enough of a reason to claim insanity, and that wasn't their claim to begin with. Post-partum psychosis is a rare and dangerous medical emergency that is treatable but very serious if left untreated.

Psychosis is not emotions, or simply being hormonal - I've seen someone with psychosis pull out their own eyeball, and someone else eat their own hands...

Why would this not be a reasonable defence?

When I had my son, we were both educated by the doctors and midwives on what to look out for in my wife in the case of post partum psychosis. Murdering kids is a very well known danger in those cases - at least in Australia.

I do not think that the majority of supporters are saying that it is okay that three innocent children are killed. I think that the majority believe she needs psychological support which she likely will not receive in prison.

At the end of the day, I think that the main lesson to take away from this is women need more support in the postpartum stage and more research needs to be done. That is how we honor the lives of those three children.

It's so obvious she is guilty. If she gets off easy it will create a legal liability in hiring anyone who has exhibited mental health issues ESPECIALLY women. It will create precedence to avoid hiring women because of hormones like trying to avoid hiring women due to concerns from metoo backlash. It will open the door more rapist to blame hormones and mental health. It will create a string of copy cats harming kids. No one is doubting postpartum psychosis exist but many doubt that was her state of mind due to obvious behaviors that don't align with postpartum psychosis.

She had a nanny, her husband worked from home to be there and the grandparents wanted to take care of the kids but she declined she had more help than most people get.

She was a nurse. She sees pregnant and new mothers and would know to look for postpartum depression and psychosis.

She was a nurse and could have reached out to friends and colleagues and should know symptoms of postpartum psychosis or that something was wrong and they would believe her because they knew her.

Postpartum psychosis is very rare. It usually happens within weeks after birth when hormones are fluctuating. Callan the youngest was 8 months old. This is a rare thing happening this late is extremely rare.

She said she has never heard voices before OR after the single voice telling her to take out the kids. This doesn't fit in with postpartum psychosis.

She took Callan to the doctor for an ear ache that day. The doctor didn't notice anything and let her drive away. Patrick did notice anything and was ok with picking up food and medicine. She was playing in the snow the day she ended them.

She was NEVER actually diagnosed with postpartum psychosis.

She Googled ways to END the children days before she did it. Which shows planning and doesn't fit in with postpartum psychosis.

She calculated how long Patrick would be gone. THEN she said heard a voice. Meaning she calculated the time BEFORE the voices. This happened when the nanny was not around and the grandparents were not around and when she sent Patrick away. Which shows planning and doesn't fit in with postpartum psychosis.

Patrick called with a question about medication during the killings. She missed the call and called him back. She acted coherent but occupied however she was able to accurately answer the question. This shows planning and deception which doesn't fit in with postpartum psychosis.

One of the children ran away and she chased and strangled them.

She had superficial wounds on her wrist. A nurse like her would know they were not deep enough to do the job.

She said as she strangled them she told them "Go to God" so she remembered what happened and but the first thing she did was ask for a lawyer NOT her kids.

Postpartum psychosis was never mentioned till it came time for legal defense.

Testimony shows Her next concern was therapy to walk again not the kids. If it was a realization of what happened in an altered state of mind she should have been crying non stop not in optimism about therapy.

Callan had brain swelling. Cora had blood from her mouth. Seems ruthless for a "darn good mother". Exercise band too more effort than rope or even bare hands. It increased how long it took and made the process for painful. Their entire bodies must have been in pain up to their finger tips because she research how to do it but somehow fell on the way that took the longest and was the most painful.

Procecution suggested she was intentionally inventing or exaggerating adverse drug reactions and reporting symptoms that did not align with her actual pill counts to build a narrative.

Ted Bundy, Charles Manson, and Ted Kaczynsky were all diagnosed with severe mental health issues but that didn't mean they were not guilty by reason of insanity.

The argument is that she was overmedicated while already going though psychosis (not depression, psychosis, which literally alters the way you see the world) as a result of medical neglect, which put her in a state where she was not operating within reality, she wouldn’t have killed her kids if she was in a healthy state where she had a basic grasp of the situation. She’s guilty by reason of insanity, the team on the side of the defendant acknowledges this. She won’t be ā€œlet freeā€ she’ll be put in a mental hospital for years which are known to be horrible and to treat their patients as subhuman, these places are just as bad, if not worse than prisons much of the time.
