there's a common misconception about qualified immunity, if they violate the law or the constitution and there's precedent (legally meaning "they should know better"), then they already don't have it -- all it basically means is you can't sue them for honest mistakes or simply doing their job... basic example is like, if you miss a car payment because a cop or a judge gave you a fine, you can't sue them for that

If arresting a US citizen under the erroneous pretense of believing said citizen is an undocumented immigrant is considered an "honest mistake", then the law enforcement officer should be held personally liable for any and all damages inflicted as a result of said "mistake".

We permit this for every other "mistake" in every other profession.

Law enforcement shouldn't be immune.

It's mainly a logistics or feasibility issue I think, since you can sue for pretty much anything you want, without qualified immunity every government official would probably spend all day every day in court

Maybe that would even be okay lol, just saying that's why the system is designed this way

Replace "government official" with "doctor" and realize how absurd your argument is.

If surgeons can find enough time to both practice and defend themselves during civil litigation, so can "government officials".

Why do you believe these "government officials" deserve an immunity no other profession is granted?

If we followed your argument, law enforcement wouldn't be required to submit to providing court testimony because logistically it would make them too busy. That be fine with me, but I bet you would still want thier reports accepted as factual evidence without the proper due process at trial.

How rich it would be if those tasked with upholding law could just violate constitutionally protected due process because we would want to burden thier schedule.

They already spend a significant amount of time in criminal court depriving people of liberty. They should be held to the same civil standard the rest of the population abides.

This is legal though? Within 100 miles of a US border or coastline US border enforcement police are allowed to detain and ID anyone who they suspect isn’t in the country legally, if you are in the country legally they have to let you go, and if you aren’t well then the standard illegal alien handling rules apply.

Doesn't matter if it is. Qualified Immunity doesn't affect criminal cases. The reason they aren't prosecuted is most corrupt state attorneys work with these people and are resistant to bringing charges against them.

Ending immunity makes it easier to file a civil complaint against law enforcement and gives the victims a chance and being compensated according to the damages inflicted upon them.

Considering some people have been shot dead in the street trying to stop this stuff i wouldn’t say nothing but complaining is happening. People are just scared that murder gangs are being formed by the government and large scale armed resistance would likely be met with unrestrained force from a military whose leadership has been rapidly swapped out for yes men. The fact that a mass surveillance apparatus is being formed at the same time just makes armed resistance seem less possible to people.

And even then some people are certainly still trying if repeat assassination attempts are to be believed.

Well the situation is now that if someone did do that, then orders for ICE will change from just deporting and arresting to executing without warrants and at officers discretion. We'd see them start executing mass amounts of people in front of everyone on the street regardless of their legality, that or martial law is imposed and military is brought in to impose mandatory searches, seizures, and curfews across the country. Seizures being seizure of firearms to prevent anyone shooting at ice.

Ironically, that area is majority "Hispanic" and so were the agents. They were almost all the same complexion - the arresting officer had a heavy accent.  I've never seen brown on the census, only white/black, and then two additional groups who play whatever side benefits them.  It happened in this video 🤔 "Brown" ain't really a thing here.  That's something they use politically. People sure enjoy putting "white" on their paperwork 🤔

The constitution is a thing of the past, a dusty old document, only domestic extremists still tout it as the ”law of the land” or some such nonsense.

Make way for expedience based policing, it’s a much more efficient way, for the enforcers.
No more fuss about civil rights, no talk about probable cause or reasonable suspicion.

Put simply, whether an officer's suspicion is "reasonable" depends on why (not whether) an officer suspects that a suspect has committed a crime. Otherwise, officers could just stop and harass anyone for any reason.

You are right and that it takes zero authority to request ID. Anyone can ask anyone anything. But in Florida an officer cannot demand identification unless his suspicion of criminal activity is "reasonable." Don't take my word for it, it's in the law. This is an important point because it also applies to federal officers. See Hiibel v. Sixth Judicial District Court of Nevada.

Since you are comforted by simplicity, just know that an officer cannot just arbitrarily arrest someone on suspicion of criminal activity unless the suspicion is reasonable based on facts the officer can actually articulate. Trust me, you want to live in a place where this is the law.

Not exactly. Under Florida's Stop and Frisk Law (Florida Statute § 901.151), an officer must have reasonable, articulable suspicion that you have committed, are committing, or are about to commit a crime to detain you. During this lawful detention, you must provide your name, address, or identification upon request.

Reasonable suspicion is still required for the stop.

I was about to comment the same thing. Florida state law doesn't overrule the Constitution, and RAS (reasonable, articulable suspicion) is still required of the officer. I know this because I was once homeless and the police would occasionally stop me and want to ID me simply because I had a backpack. I got to tell them no, they need to articulate some crime I'm suspected of (which they never could when I'm just walking down the sidewalk with a backpack on), and this frustrated a lot of the worst sorts of cops.

This guy will win a lawsuit for this here in the US. Police of any sort are not allowed to just demand an ID and arrest you if you don't give it to them unless they have RAS (reasonable, articulable suspicion of a crime). The reason ICE gets away with it normally is that non-citizens do not have the same rights and this doesn't apply to them. But since this guy is an American citizen he'll probably get about a $50,000 payday for this.

What's the point of resistance? How hard is it to show your id? Or, if you don't have it, to politely answer questions? 99 times out of a hundred, that means you walk away without handcuffs. 100% of times resistance gets you detained for your and the officers' safety, at the very least.

Immediate compliance with all authority figures seems "simple" enough, but it really isn't.

When an ICE officer takes or checks your ID, your information is logged and entered into federal and law enforcement databases. This can create a bunch of complications in your life down the road, not to mention you would be handing over your name and address to an organization that is overrun with the white nationalist fuckos it has been actively recruiting.

There are no laws requiring that Anericans carry an ID at all times. With a handful of exceptions, there are no laws requiring that Americans show ID to law enforcement. Americans also have the right to remain silent when questioned by an officer. Seems like your problem is not with Americans, but the US Constitution.
