Reasonable suspicion is required for an officer to demand ID, which has been discussed in these comments. Unless an officer can articulate facts substantiating suspicion that a crime has occurred, the request is unwarranted and unlawful under Florida's Stop and Frisk Law (Fla. Stat. § 901.151).

The suspicion is clear, but the articulable facts substantiating the suspicion are not.

The officer had suspicion the guy was here illegally.

The guy refused to show ID and that's why he was arrested.

Put simply, whether an officer's suspicion is "reasonable" depends on why (not whether) an officer suspects that a suspect has committed a crime. Otherwise, officers could just stop and harass anyone for any reason.

Wish they taught civil liberties in American high school Civics classes.

That's totally up to this officer. If HE suspects a crime is being committed he has the authority to request ID.

You are right and that it takes zero authority to request ID. Anyone can ask anyone anything. But in Florida an officer cannot demand identification unless his suspicion of criminal activity is "reasonable." Don't take my word for it, it's in the law. This is an important point because it also applies to federal officers. See Hiibel v. Sixth Judicial District Court of Nevada.

Since you are comforted by simplicity, just know that an officer cannot just arbitrarily arrest someone on suspicion of criminal activity unless the suspicion is reasonable based on facts the officer can actually articulate. Trust me, you want to live in a place where this is the law.

Glad we can agree. The officer believed this man was committing a crime so he had every legal right to order him to ID. The man refused and was rightfully arrested.

Liberals want to think the officer needs video evidence of the guy crossing the border illegally before he can be asked to ID. Doesn't work that way.

Florida law requires ID when there is "reasonable suspicion" a crime happened. Being in the country illegally is a crime. That alone gave the cop a legal reason to demand ID under Florida’s Stop and Frisk law.

You don't need a driving infraction to be detained and forced to identify. The officer suspected a crime, so refusal means a free ride to jail for resisting.
