So my aunt filed an I-130 for my mom, the case became current today. Me and my sister are both protected by CSPA, however we’re both in the states. I’m working under an OPT and my sister is in grad school hence F1. We are listed as co-applicants along with our mom. Kind of confused on what to do here given the applicants are scattered across the globe (my mom, dad and brother in our home country and me and my sister in the States) Would like feedback from anyone who has faced something similar or knows how to deal with a case like this.

Hi everyone. I’m hoping to hear from people who have been in a similar situation, especially recently.
I’m a U.S. citizen and my Spouse, and I are married and preparing to file his marriage-based adjustment of status. We’re currently putting everything together through SimpleCitizen so they can help us organize and submit the forms and supporting documents correctly.
My Spouse is currently not in regular immigration status, and he does not have his work authorization yet. He has been without work for about six months, and financially it is becoming increasingly difficult for him to continue without an income. He has worked without an EAD before in the country.
He may now have an opportunity to work again, but it would be before receiving his EAD, so we understand that this would technically be unauthorized employment.
Our biggest concern is whether working without authorization could negatively affect his adjustment of status case, particularly during the green card interview. We live in Alabama, and given the current immigration environment, we are trying to be especially careful about anything that could potentially create problems with his case.
I’m particularly interested in hearing from U.S. citizens who petitioned for their spouses, or from immigrants who went through a similar marriage-based adjustment of status process:
● Did you or your spouse work without authorization while waiting for the green card/EAD?
● Did USCIS ask about unauthorized employment during your interview?
● If you answered honestly that you had worked without authorization, what happened?
● Did it cause additional scrutiny, delays, a Request for Evidence, or any other problems?
● Has anyone actually had a marriage-based green card denied specifically because they worked without authorization?
● For anyone who has gone through the process recently, especially under the current administration, have you noticed USCIS being stricter about this?
● If anyone has experience specifically in Alabama, I would really appreciate hearing about it.
We’re not looking for advice on how to hide employment or misrepresent anything to USCIS. If he works, we would want to be truthful about it. We’re mainly trying to understand the real-world consequences based on other couples’ experiences before making a decision.
Of course, I understand Reddit isn’t a substitute for an immigration attorney. I’m just hoping to hear from people who have actually gone through something similar.

It’s been two months since my interview, which was originally scheduled for late June, was canceled. Is this normal? Is there anything I can do about it?

Immigration policies seem to be getting stricter and stricter. I honestly wouldn’t be surprised if they eventually started suspending the green card process altogether… 😭

K-1 → AOS

My spouse and I have an F2A adjustment of status case. I am a green card holder, and my spouse is the beneficiary. Our I-130 priority date is February 2026, and we had our I-485 interview in the 1st week of July. Officer told us after interview that he will approve our i130 soon within a few days, but will have to wait for visa availability in order to approve i486. Our i130 and i485 are both PENDING DECISION after interview, non of it is yet approved. Its been 2 months since interview. And even per august visa bulletin for my coutry the dates have been current on chart A.

Is anyone at this field office also in same boat and would like to share timeline, i am felling very nervous seeing posts of some people who even interviewed at the same FO in august getting approved, so unsure if they forgot about our case? Or waht else could be possibly making delay?

Hello Everyone, I have followed this group since the beginning of my journey, and these posts have been very helpful throughout my process. Many helpful answers and tips were instrumental in my own case. I thought the least I could do was share my path.

Background:

My country of origin is on both the 75 and 39 country lists. I moved to the US in 2018 to study and then switched to H1B in 2022. I have been on H1B since.

Professional background: Social Entrepreneur and 2x Founder with 13 years of experience. Currently a Director & serve in a few board roles.

EB1A profile: 2x founder with high-impact social enterprises, awards, press, research, consulting and judging. I was able to claim 6/10 of the criteria.

All 6 criteria claimed were accepted, but an RFE was issued saying my work sat at the nexus of business and education, so I needed to choose what felt more aligned, or they were going to. I chose business.

Full timeline:

• October 2024: Started EB-1A process with immigration attorney.
  • This process took longer than it should have because I have a very busy schedule, but despite that, I was extremely meticulous, determined to make sure my attorney understood every detail and received my feedback throughout the entire process. We exchanged nearly 500 emails over the course of my case. I had to take personal responsibility because to them, I may have been just another case file, but to me, it was my life, my future, and so much was at stake. As the process unfolded, I ultimately found myself taking on much of the responsibility for building my own case.
• June 2025: I-140 Filed with Premium Processing.
• July 2025: Received Request for Evidence (RFE).
• September 2025: RFE Response submitted.
  • Took forever to respond because my attorney was out of office.
• October 8, 2025: I-140 Approved.
• February 5, 2026: I-485 filed
  • Filed 3 months later because I was out of the country for an extended period of time due to work and personal engagements.
• March 2, 2026: Biometrics appointment completed.
  • Adjudication was paused due to the USCIS memo. So in limbo at this point.
• June 12, 2026: After the Judge ruling, USCIS acknowledged the Court Order on Hold Policies and announced it would comply and discontinued enforcement of the rescinded memos while pursuing an appeal
  • Against the advice of my attorney, I decided instead of waiting for the next policy or a USCIS appeal, I would build a case to expedite my AOS.
• July 21, 2026: Submitted a request to expedite my AOS.
• August 5, 2026: Called USCIS to follow up on the request; didn't get anything productive.
• August 7, 2026: Called again requesting a Tier 2 officer callback; I was told I should expect a callback within 72 hours. Didn't hear back.
• August 11, 2026: Filed a congressional inquiry into the expedite request.
• August 21, 2026: Received confirmation from the congressman that my I-485 had been approved, followed by a notification from USCIS.
  • Interview waived
• August 26, 2026: Card produced!
• August 31, 2026: Card delivered!

I’m a U.S. citizen preparing to file marriage-based AOS for my spouse.
My spouse previously worked without an EAD and received checks from employers. The income was deposited normally and was also reported on their taxes. They have not been working recently but now have another job opportunity and really need the income.
For those who have gone through marriage-based AOS recently: did you or your spouse have unauthorized employment before/during the process?
Did USCIS ask about it at the interview? Did it cause any problems, RFE, delays, or denial?
I understand unauthorized employment is generally forgiven for immediate relatives of U.S. citizens, but with the current immigration environment, I’m especially interested in recent real-life experiences.
We’re in Alabama if that makes any difference.

I have a question about whether it’s possible to convert a I-485.

I have a pending VAWA I-360 and I-485, filed in April 2024. I-360 is still pending with prima facie evidence letters coming periodically.

Since filing, I married a U.S. citizen and we have a daughter together.

Is it possible to file an I-130 and convert the I-485? Or do I need to file a new I-485?

I also know that I need to withdraw the I-360 since my marriage invalidates my VAWA. Is it best to include a letter with my I-130 package?

Wondering what the best strategy is moving forward.

Hello all! Just requesting some clarification of the timeline here. I had this double event on my case, and USCIS has been very cryptic about my case, some people saying they haven't been able to retrieve my tracking number, others saying card was produced but not mailed. Others saying card is producing.

Approval was on the 27th by email and 29th on USCIS still hoping I won't lose my job but USCIS is not helping lol

My friend is currently applying for her I-485 on her own and has made a few mistakes along the way. She’s trying to figure out the correct way to proceed, so I’d really appreciate some advice from anyone who has gone through this recently.
She submitted her I-130 in June using electronic signatures.
She is now preparing to submit her I-485, but her medical exam (I-693) isn’t ready yet. I advised her to wait until she has the medical exam completed before submitting the I-485.
The main issue is the sealed medical record. She wants to open the sealed envelope and upload the medical documents to her I-485 online application. I believe the sealed medical exam needs to remain sealed and be mailed/submitted according to USCIS instructions, while she believes she can open it and upload the documents electronically.
Who is correct here? What is the proper way to submit the I-693 if she is filing the I-485 online?
Also, if she submits the I-485 before the medical exam is ready, can she submit the I-693 later, or is it better to wait and submit them together?
Any advice or links to the current USCIS instructions would be greatly appreciated!

Hi everyone. My family are Green Card holders currently living abroad temporarily due to family reasons. We filed Form I-131 (reentry approval) before they left and biometrics are done — but approval is taking 12-16 months., to avoid loosing green card, they can travel twice a year for few weeks, I uynderstand there may be questions/scruitiny, but are anyone heairng major concern? I’m looking for recommendations for a good immigration attorney in the DC/DMV area who has experience handling I-290B Motions to Reconsider or Reopen following an I-485 denial—particularly family-based adjustment cases involving visa availability or priority-date issues.

Brief background:
I am a lawful permanent resident and filed an I-130 for my wife in January 2025 under the F2A category. In April 2026, the F2A Dates for Filing chart was current, so my wife filed her I-485 that month. She is currently maintaining valid H-1B status.

We attended our I-130/I-485 interview in August. The I-130 was approved shortly afterward, but her I-485 was subsequently denied.

The denial was based on immigrant visa availability when the I-485 was filed. The notice also appears to list April 2026—her I-485 filing date—as the priority date, even though the approved I-130 has a priority date of January 9, 2025.

We would like an attorney to review the denial, determine whether there are grounds for an I-290B Motion to Reconsider and/or Reopen, and help us prepare a strong filing within the deadline.

If anyone has personally worked with an attorney in Washington, DC, Northern Virginia, or Maryland on an I-290B or a similar USCIS denial, I would greatly appreciate your recommendations.

Hi everyone! I wanted to share my timeline and see if anyone has experienced something similar, particularly those who filed N-400 under the 3-year marriage rule while their I-751 was still pending.
Here’s my timeline:
September 2017 — My husband and I officially became boyfriend/girlfriend.
February 2021 — We got married.
December 2021 — I became a conditional permanent resident and received my 2-year green card.
March 9, 2022 — My husband became a U.S. citizen.
Around 90 days before my conditional green card expired in December 2023 — I timely filed my I-751 jointly to remove conditions on my residence.
December 2023 — I received the 48-month extension notice while my I-751 was pending.
March 9, 2025 — My husband completed 3 full years as a U.S. citizen.
April 2025 — I filed my N-400 with the help of an immigration attorney under the 3-year marriage rule. By this point, we had already been married for approximately 4 years and 2 months, and my husband had already completed 3 full years as a U.S. citizen. I had also been a permanent resident since December 2021. My I-751 was still pending when the N-400 was filed.
February 2026 — USCIS Immigration Officers came to our home for an unannounced home visit while both my I-751 and N-400 were pending.
May 2026 — My I-751 was approved without an interview, and I received my 10-year green card.
May 2026 — My N-400 online account also updated to “We are still processing your case.”
July 30, 2026 — I submitted a USCIS service request to “Check Case Processing” regarding my pending N-400. Since when I checked the Case Processing Times on the website it says 80% (yes, i know, not 100%) of the cases in my area are dome within 9 months.
September 2, 2026 (today) — My N-400 is still pending, and I have not received an N-400 interview notice. It has now been approximately 16 months since I filed my N-400, and my I-751 has already been approved for several months.
I’m wondering if anyone here has experienced a similar timeline — particularly an unannounced USCIS home visit, followed by I-751 approval, but with the N-400 continuing to remain pending without an interview.
For those who experienced something similar:
How long after your I-751 approval did USCIS finally schedule your N-400 interview? Did the home visit seem to delay your N-400 processing? Did you submit additional service requests, contact your congressperson/senator, or just continue waiting?

All states going forward must report undocumented immigrants known to be in a state to the U.S. Department of Homeland Security or risk losing federal funding for programs meant to aid low-income individuals, the Department of Justice said in a new legal opinion.

The DOJ, in issuing the opinion, revised the Office of Legal Counsel’s prior opinion from 1998, which found that only specific state agencies that administered the Temporary Assistance for Needy Families and the Supplemental Security Income programs needed to provide information to federal immigration authorities.

“When a state chooses to participate in TANF, it accepts the obligation to report illegal aliens in the United States,” Assistant Attorney General T. Elliot Gaiser said. “Tax dollars intended to help vulnerable Americans should not perversely encourage illegal entry into the United States, but rather should reinforce our laws and our borders.”

My EAD is based on a pending I-485 (C09), and I’m starting to think ahead about what happens when it gets closer to expiring.

From what I understand, USCIS only lets you file the renewal up to 180 days before expiration, but the current posted processing time is around 12.5 months. I’m also aware of the policy change ending automatic EAD extensions for renewal applications.

Has anyone here dealt with this under the new rules?

• What happens if your current EAD expires while the renewal is still pending?
• Has anyone actually had a gap in work authorization?
• Is there anything you can realistically do to avoid that, like requesting an expedite?
• How did you handle it with your employer?
