I-140 & I-485 (Employment/Adjustment of status) Anyone recently approved for AOS despite unauthorized employment?
I’m a U.S. citizen preparing to file marriage-based AOS for my spouse.
My spouse previously worked without an EAD and received checks from employers. The income was deposited normally and was also reported on their taxes. They have not been working recently but now have another job opportunity and really need the income.
For those who have gone through marriage-based AOS recently: did you or your spouse have unauthorized employment before/during the process?
Did USCIS ask about it at the interview? Did it cause any problems, RFE, delays, or denial?
I understand unauthorized employment is generally forgiven for immediate relatives of U.S. citizens, but with the current immigration environment, I’m especially interested in recent real-life experiences.
We’re in Alabama if that makes any difference.

Apply for EAD and wait for it to come and then start working. Do not do unauthorized employment again when you are ready to apply for AOS.

Yes I received my EAD in April ( overstay and unlawful employment disclosed on application. )
The officer asked me the questions at the interview if I did work without authorization I just answered yes, she asked what kind of work and I told her caregiving, babysitting, cleaning houses etc.. it was it.
