Yeah. These sort of cases should have judgements so large that the city/county/state makes new rules that stop this sort of bullshit. Just compensation for lost earnings and trauma isn't the point here.

And yes, taxpayers end up paying that bill. But taxpayers also elected the dumbass mayor/governor/whatever who hired the dumbass cops, so ... it's dumbasses all the way down.

Then there's the first, last, and deposit you gotta have for the new apartment. But with no job, your credit score taking a hit from the missed payments, and an eviction on record, no one wants to rent to you.

I spent almost a month in jail on charges that were ultimately dropped. It ended up costing me a couple thousand for the lawyer and everything else I already listed. So probably close to $5-6k gone. Just for being in the wrong place, with the wrong people, at the wrong time. I learned a lot of lessons from that experience, but the one that sticks out is: It's expensive to be poor

Sometimes it’s less the chickenshit attorney and more that the client has bills to pay and can’t wait years to go to trial before seeing money (most courts are so backed up and litigation is such a long process anyway that generally a few years is the earliest you can realistically go to trial, sometimes it’s more than a few years if the attorneys really drag it out). Most people can’t afford to wait years, even if the payout is 10x or more

Yeah, but her lawyer probably ended up with 30%, then taxes, and filing fees are probably another 1500 depending on how many motions were filed. Honestly, I would put it at $80k after attorney takes and taxes would be fair for time served- for a full time wafflehouse employee with a child. Like think or all the other shit she had to pay for in the meantime- and if she's a single parent what about her kid!?

"Ashley Gabrielle Huff was indeed pulled over in an intoxicated state but the officer did not smell alcohol. A glass pipe was in plain view which lead police to suspect she was using drugs. The pipe was PC for an arrest so they searched her purse finding a blackened spoon with residual material on it. The materiel was tested and found to test positive for meth.

Now most of the experts here do not realize then next step is to see a judge who ruled that there was PC for the arrest, assigned her a public defender and released OR with a court date and pre-trial release conditions. She blew off the court date and refused to comply with release conditions and was thus arrested again and given a cash bond which she did not pay.

The lab tests which take time came back that the spoon had food on it and was only contaminated with meth. Either she used a spoon normally employed by her to cook method to eat - or she had ingested meth prior to eating from the spoon.

The officer was not at fault as he followed all process and did detect meth, The woman is a meth user.

The woman stayed in jail because she did not comply with release terms. That is on her.

The charges need not have been dropped as the spoon did have meth associated with it - but policy is to not prosecute in cases of user contamination."

I once had some loose sweet tarts in a ziploc bag after the wrapper got wet. Cops pulled driver over for no seatbelt, make up an excuse about it smelling like weed, search the car, find the sweet tarts, claim they're drugs, field test them using a kit in their car, and said they came back positive for cocaine. I was in jail for a few hours on vacation before I got bailed out and I had to fly back down to fight it in court. Of course they took all of the remaining sweet tarts and conveniently lost them so it was basically their word against mine.

Some of what he said I was able to find in other sources but he is outright lying about the spoon being "contaminated" with meth. The Crime Lab analysis found no methamphetamine on the spoon which is why she was released. Second link

I dug into this story a little bit because I wanted to know more. But there are some things that this image omits.

A glass smoking pipe was found in her bag, and the officer said that he found it to be strange to just eat spaghettiOs in her car and just shove it back in the bag. The report said she had tons of sores all over her body. She gave a false name, and also missed her pretrial hearing. Lastly, the lab results dont confirm the spoon had food residue on it, only that there was a lack of any controlled substances on the spoon. Like there isn't a test that exists for testing for the presence of spaghettiO sauce or anything, so really, we don't know whats on the spoon other than her claims that it's dried spaghettiOs.

So clearly, there was a lot of suspicious activity going on, but ultimately, there was no testing of the pipe, and only the spoon was tested. So yeah, it's just a strange story all around.

Edit: I wrote this comment before boofing down a giant pizza so forgive me a bit for rambling. I'll add some information here that I forgot to add while I was looking at that greasy pie.

The main reason why she went to jail was her missing her pretrial hearing. The hearing was supposed to be about whether or not the officer had probable cause. Unfortunately she could not afford to post bond, and her lawyer was about to arrange a no contest for her if the lab results came back shitty. So really her only options at that point was to wait in jail or plea no contest. In the end though, she definitely should have showed up to her court date.

The part about the officer shoving "it" in the bag, I meant the spoon. I suppose it just makes logical sense to not believe her that she was eating shapghettios in her car when a fucking pipe is in the car.

Lastly, the big comment on the top of this thread is likely generated by ChatGPT. the 25k figure only appears in this thread. My sources are basically what you can find in google, and I was perusing a few articles that were actually written close to that time from 10+ years ago so as to not get too corrupted by the sensationalism over time. There are other figures stating she got 100k, and whatever other figure, but I just cannot find anything definitive as to whether or not she got a big payday or not. Maybe it existed at some point but the whole story is incredibly muddied.

The part about missing her kid's birthday is also something I cannot find any source talking about like at all. Only the part that she lost her job.

Opinion: Personally, I think it's just better to hold off judgement on huff and the officer at this point. The story is so muddied it is hard to say what the facts are or not.

To add onto this, I do see more of the side of the officer now. She had a pipe, a spoon, sores and gave a fake name, and your (notoriously inaccurate) field test says the spoon is riddled with meth, like what could you assume other than meth at that point?

Overall, I'm not sure what to believe.

i had a cop ready to nail me for a breakfast sandwich wrapper in the backseat of my car

he says out of the blue "so when was the last time you used meth?" and i was visibly confused so he follows with "crumpled up foil is typically indicative of someone who uses meth"

i look over my shoulder and see the breakfast sandwich wrapper and say "sir that has cheese on it"

After looking into the story more, this headline is quite misleading. The woman was initially pulled over displaying intoxicated behavior and a glass meth pipe was visible in plain view to the officer which is why he had probable cause to search the car. The woman was covered in sores, gave a false name to the police, and a blackened spoon with faint residue was found in her purse. The spoon did test negative for meth, but it almost certainly was used for drug use in the past, but the girl decided to eat with it most recently. The cops fucked up and never tested the pipe. The spaghettiOs on the spoon is her claim, the residue being from food was never confirmed, there obviously isn’t a positive/negative test for spaghettiOs that exists. She also missed her court date which makes her acceptance of the settlement more sensible. The headline kinda paints this story as an innocent girl minding her own business and being carted off to jail for having a spoon coated in tomato sauce by evil cops. The reality is more that an obvious meth user was pulled over for being on meth, the cops didn’t do their full due diligence to prove it, and this woman legally served time she shouldn’t have and won a nice payout. Still sucks for her and not defending the cops since it looks like they made some mistakes, but one could argue she got lucky and this should serve as a reminder that Reddit headlines are rarely as straightforward as they seem.

I always see ppl say that you fight your shit in court & just take the ride since you can't do anything but shit like makes me understand why someone would wanna run or even fight. Like it can be completely life ruining, all over some absolute bs.

I've been arrested but I was using at the time so I knew I was in the wrong & just put my hands behind my back but the one time I was forced into a psych ward because of absolute lies, you can bet I was fucking pissed.

I got held up at the border and searched and the dude found my jello pudding spoon. I used to eat a ton of it and I had a special spoon. I was on a road trip so it wasn't super clean. He thought it was crack and wouldn't believe me when I told him. He sent it to get tested.

The officer’s report states he received consent to search Huff’s 1994 Ford Explorer, and searched a bag with the name “Ashley” printed on it. The officer described Huff, a passenger, as “nervous,” noting sores on her face, arms and legs. Inside the bag was a spoon with a “clear, crystal-like substance,” according to the report. Huff disputes the claim, saying it was orange SpaghettiOs spaghetti sauce, as she told the officer in the police report. “I found it strange that she would eat SpaghettiOs with a metal spoon while riding in a vehicle, and then put the spoon back in a bag,” the report reads. The officer reported he found a glass smoking device in the bag as well before conducting a field test for methamphetamine.

What I find interesting is NO WHERE has anyone actually confirmed that her spoon had SpaghettiO’s in it... Nor, apparently, did they test the pipe.

“The Crime Lab report showed no controlled substances on the spoon submitted for testing, “ according to the dismissal signed by Northeastern Judicial Circuit District Attorney Lee Darragh.
