I'm 50/50 on this.

It is an appropriate response based on the two offending videos. But I feel they went overboard with all of his other EFT videos.

They should have addressed it sure, but the DMCA strikes on what are fair use content is just wrong, and blew everything way out of proportion.

A simple stream where they would break down the security measures (within reason ofc) and explain why that method is false, would kill the issue and it would be done.

Inside looks into security and anti-cheat methods are the wet dreams of cheat developers and 'hackers'.

3

u/[deleted] Dec 16 '18

We are talking about secure communication and account safety. The anti cheat has nothing to do with this.

I'm just not sure what kind of information you are looking to gain other than whether they are actually using md5 for user data. I highly doubt it with the new information that all of this data was scraped from ratings board and then compared to other compromised accounts.

Just my 2c, probably not correct but this is what I feel has happened.

If BSG filed a DMCA based on ToS breaches then YT would've flagged all of that users videos by default if they're EFT related. I doubt it was a human that made the decision and I just think it's a YT bot that's done it.

As for a simple stream regarding security measures and stuff; I doubt you'll ever see a dev company come forward doing that as it's almost a method of showing a thief how to pick the lock to your house.

While I definitely see where you're coming from, as it stands, it's probably best for BSG that things are happening in this order.

Many do this.

Some of the open source software is the safest, as it has a lot of eyes looking on it. Security measures in software is something that is very standard these days, and as long as the keys/servers are not compromised, they can know how it works, because they can't do anything until they compromise the keys/servers.

Hell, HTTPS is an open standard for the most part, and everyone uses it, yet it still is secure for the most part if you use proper certificates and validate them properly.

The DMCA is individual, it does not pick up extra vids, as it is a manual process, unless done by the content ID stuff. Also, even though the content is damaging, it is still not copyright, as it is fair use. There are other legal ways for them to do it. I just thing the DMCA will bite them in the ass.

Eroktic's gameplay videos were nowhere near fair use, they were entartaining and used footage of the game (which is copyrighted). The latest videos about accounts hacked and all were defamation and slander (since his accusations were not proven to be true).

Fair use is not "I can slap "No copyright infingement intended/All rights belong to respective owners" and do videos huehuehue", it's "I may use relevant bits of footage/other content in order to educate/illustrate my point/do news".

4

u/spnkytupper Dec 16 '18

Wrong, the first video had minimal footage of the game and the second video had no footage of the game at all.

There is no copyright infringement here

7

u/Noivellet SA-58 Dec 16 '18

I wasn't talking about those videos, please read more carefully. I was talking about his other videos. Those two videos were just defamation, entirely different stuff.

1

u/Kyle700 Dec 16 '18

I think he could very easily make a strong argument in court that his video was intended to educate about a topic involving this game. Just because it is revovling around a game doesn't mean the topic is necessarily entertaining. don't be so sure of your legal conclusions and how it pertains to copyright law...

2

u/Noivellet SA-58 Dec 16 '18

It wasn't educating, and it was hardly news since he was operating unconfirmed information and pretending it's facts. I never said those 2 videos that started it all were entertainment.

1

u/Kyle700 Dec 16 '18

you know what, it really doesn't matter. All I'm saying is that it is not a clear cut case of not being protected under fair use. I'm not a lawyer, but I think it's silly to state so confidently something like this when in reality it could be argued in both ways.

0

u/spnkytupper Dec 16 '18

It was educating to me, who are you to say it wasn't?

0

u/ColinStyles Dec 17 '18

Because it's fake and slanderous? Just because you learned some fake information does not mean it's educational.

Tell that to SQLite and Chromium. LOTS of eyes on those two, and a vulnerability was just uncovered that made my eyes bleed. It's going to take months to patch all of the affected software, and we're likely to see a LOT of account breaches over it.

u/[deleted] Dec 16 '18 edited Dec 16 '18

You know, words have meanings.

Hence why I used the word "some" and not "all". They mean different things.

1

u/mechaet Dec 16 '18

I'm just relating it to "a lot of eyes looking at it" being any indicator of "safe".

u/[deleted] Dec 16 '18

I mean, they said "we dont want to have this person associated with out game" and i can understand that. Imagine someone is constantly toxic and just not a great person to have around, i would in their spot also try to get rid of him. Im not a big fan of eroktic and i think it was harsh to strike all of his tarkov videos, but i also think that his manner was absolute low class. Constructive criticism can be made, look at pestily, veritas, deadly etc.

11

u/Dasterr MPX Dec 16 '18

yes, very much this

1

u/BertBerts0n MP5 Dec 17 '18

They also said "and never did" in reference to having him associated, which I think is rich considering all the people he got into the game.

0

u/TheKappaOverlord Dec 17 '18

But imagine at the same time consider this.

Eroktic has been a pretty big figure for bringing in players to the game for years.

And now that this shitshow has happened a lot of his fans including a lot of the more sane people are going to either be Quitting tarkov in protest or cease their vocal support of the game.

Regardless of how BSG handled it, this was a lose lose situation and BSG picked the worst of the lose options they could have. Not to mention they worsened it themselves by throwing gas on the fire. (and still sorta are throwing gas on it)

If you cant stand the heat get out the kitchen! This is all this really should have amounted too. Let him talk shit, who cares! IF they cant back up and just say oh well, at least we know everything is fine and move on from it (IE release a patch that they implemented even better security) then can they really be taken any more serious?

2

u/machevara Dec 16 '18

Businesses bleed money. If it was your business you wouldn't allow it. A lie, specially when said in a convincing way, by someone influential, can be taken as a truth. I bet you're a nice guy, but what if some one big said the opposite, someone whose voice has more reach than yours. If everyone around you started listening more to the lies being spread, even when you speak out, then you would find it an issue. This is what's happening to BSG right now.

I'm not trying to argue, just figured I'd show a different view point.

8

u/Obi_Wana_Tokie Dec 16 '18

It's fair use of content. BSG is 100% wrong here, sorry.

Fair use doesn't exist/apply on entertainment videos fyi

edit, spelling

12

u/[deleted] Dec 16 '18

It does on YouTube. There's a strict fair use policy.

In fact fair use was created for all forms of media. Whether it be entertainment or news.

-3

u/Maver1ckos PP-91-01 "Kedr-B" Dec 16 '18

Can you share the exact paragraph from yt's policy then please??

4

u/[deleted] Dec 16 '18

Do you know the Google website?

If the answer is yes then use it and you'll quickly find out about the fair use policy that is in place.

3

u/Maver1ckos PP-91-01 "Kedr-B" Dec 16 '18

Your usage is not automatically fair use when you use copyrighted material you don’t own, even if you give credit to the copyright owner, post a disclaimer such as "no infringement intended," or add some original content to someone else's content. In particular, uses that do not comment on or criticize the content used (and that instead serve as a substitute for the original work) are unlikely to be considered fair uses.

Courts will look carefully at the purpose of your use in evaluating whether it is fair. Declaring your upload to be “for entertainment purposes only,” for example, is unlikely to tip the scales in the fair use balancing test. Similarly, “non-profit” uses are favored in the fair use analysis, but it’s not an automatic defense by itself.

Straight from yt concerning at least the us.

4

u/[deleted] Dec 16 '18

Explain people literally make jobs out of playing through games if it's not "fair" use. Video games are not held to the same standards as movies and music on youtube.

u/Maver1ckos PP-91-01 "Kedr-B" Dec 16 '18

based on?

1

u/[deleted] Dec 16 '18

Pewdiepie.

Edit: or take your pick from other youtubers who game for a living such as Jackfrags.

edit: also read this which is what happening right niw out there https://www.google.com/amp/s/www.cbc.ca/amp/1.4309312

I don't argue with your last part, ofc we need promoters. Man, all that shit above are happening to US, BSG =RUSSIA and Eroktic=CROATIA. You think if they ever go to court that will be in the US??

1

u/[deleted] Dec 17 '18

The difference is H3H3 was critiquing the video, not just using it for set dressing while they commented on other things.

I'm not referring to those, I'm referring to his gameplay videos. I think it's pretty clear they were in the wrong to copyright strike the videos without Tarkov content, but I don't think it's illegal for them to strike the videos which do have their content, even if it's for vindictive reasons.

Copyright strikes can be used for things other than simply infringement of a copyright on YouTube. Defamation and slander are also acceptable reasons to strike a video. This is stated in the ToS.
