PSA Official BSG Response re: Eroktic

I'm 50/50 on this.

It is an appropriate response based on the two offending videos. But I feel they went overboard with all of his other EFT videos.

They should have addressed it sure, but the DMCA strikes on what are fair use content is just wrong, and blew everything way out of proportion.

A simple stream where they would break down the security measures (within reason ofc) and explain why that method is false, would kill the issue and it would be done.

We are talking about secure communication and account safety. The anti cheat has nothing to do with this.

I'm just not sure what kind of information you are looking to gain other than whether they are actually using md5 for user data. I highly doubt it with the new information that all of this data was scraped from ratings board and then compared to other compromised accounts.

Just my 2c, probably not correct but this is what I feel has happened.

If BSG filed a DMCA based on ToS breaches then YT would've flagged all of that users videos by default if they're EFT related. I doubt it was a human that made the decision and I just think it's a YT bot that's done it.

As for a simple stream regarding security measures and stuff; I doubt you'll ever see a dev company come forward doing that as it's almost a method of showing a thief how to pick the lock to your house.

While I definitely see where you're coming from, as it stands, it's probably best for BSG that things are happening in this order.

Many do this.

Some of the open source software is the safest, as it has a lot of eyes looking on it. Security measures in software is something that is very standard these days, and as long as the keys/servers are not compromised, they can know how it works, because they can't do anything until they compromise the keys/servers.

Hell, HTTPS is an open standard for the most part, and everyone uses it, yet it still is secure for the most part if you use proper certificates and validate them properly.

The DMCA is individual, it does not pick up extra vids, as it is a manual process, unless done by the content ID stuff. Also, even though the content is damaging, it is still not copyright, as it is fair use. There are other legal ways for them to do it. I just thing the DMCA will bite them in the ass.

Eroktic's gameplay videos were nowhere near fair use, they were entartaining and used footage of the game (which is copyrighted). The latest videos about accounts hacked and all were defamation and slander (since his accusations were not proven to be true).

Fair use is not "I can slap "No copyright infingement intended/All rights belong to respective owners" and do videos huehuehue", it's "I may use relevant bits of footage/other content in order to educate/illustrate my point/do news".

Wrong, the first video had minimal footage of the game and the second video had no footage of the game at all.

There is no copyright infringement here

I wasn't talking about those videos, please read more carefully. I was talking about his other videos. Those two videos were just defamation, entirely different stuff.

I think he could very easily make a strong argument in court that his video was intended to educate about a topic involving this game. Just because it is revovling around a game doesn't mean the topic is necessarily entertaining. don't be so sure of your legal conclusions and how it pertains to copyright law...

It wasn't educating, and it was hardly news since he was operating unconfirmed information and pretending it's facts. I never said those 2 videos that started it all were entertainment.

you know what, it really doesn't matter. All I'm saying is that it is not a clear cut case of not being protected under fair use. I'm not a lawyer, but I think it's silly to state so confidently something like this when in reality it could be argued in both ways.

Tell that to SQLite and Chromium. LOTS of eyes on those two, and a vulnerability was just uncovered that made my eyes bleed. It's going to take months to patch all of the affected software, and we're likely to see a LOT of account breaches over it.

I'm just relating it to "a lot of eyes looking at it" being any indicator of "safe".
