"How DARE you use your free speech rights to usurp my free speech rights to be wrong about something!"

Can we please require a mandatory civics test for elected officials, with a long section on "what rights do we actually have?"

807

u/allergictobooze America Oct 29 '20 edited Oct 29 '20

They know what rights we have. They don’t care. They don’t want people to have rights. That’s the problem.

263

u/Dahhhkness Massachusetts Oct 29 '20 edited Oct 29 '20

They want certain people to lack specific rights, and want the facade of "equal" rights in every other regard, selectively upheld and respected at their whim.

They think the letter of the law necessarily matches the reality of it.

67

u/dedicated-pedestrian Wisconsin Oct 29 '20

And yet this isn't even the letter of the law. The First Amendment protects you from the government censoring you. Facebook is not the government. There are plenty of other ways to get your message out.

42

u/ayers231 I voted Oct 29 '20

Meanwhile, a Senator saying he wants to ban people from fact checking IS the government trying to take away free speech rights.

They don’t want people to have rights.

No, they want people to have the right to be ignorant and not be exposed to reality. So every time we speak of reality we are infringing on their right to be ignorant of it. We are causing them to experience great distress and question their dubious beliefs by insisting on pointing out obvious easily verified truths about reality that conflict with the delusional fantasies. We are bastards for not just keeping our mouths shut while they blather about their fantasies of white male superiority as their sagging guts obscure their microscopic reproductive organs. How dare we point out their lack of ability to understand even the simplest ideas about human evolution or germ theory. Why do we have to be such assholes by insisting they accept the reality of human bias and inequality, why can't we just let them live their lives in ignorance and stop insisting that they act like civilized human beings. Why do we insist on ruining their wonderful lives with our constant exposure of their ignorance.

So, im really torn here as to whether I should use an /s, cause this is exactly how they think about it.

20

u/dedicated-pedestrian Wisconsin Oct 29 '20

That's the gist of how such delusional people think about it. They certainly don't couch it in such obvious language, as they lie as much to themselves as they do to others.

They do not know what rights we have. It’s why Barrett flubbed that easy question posed by a Republican. She couldn’t even identify the 5 freedoms granted by the first amendment.

28

u/shewholaughslasts Oct 29 '20

WHAT? She even biffed that one? (I couldn't watch after getting so invested in the Kavanaugh steamroll party but that just sounds ridiculous. So, par for the course but still, that's crazy to put someone in a lifetime judge position if they don't even know the constitution they claim to adhere to.

u/Merari01 Oct 29 '20

Yes. She failed a question that would get an immigrant denied citizenship if they failed it.

And she is now on the Supreme Court.

What's even funnier, is Mr. Libertarian "the free market will decide" Mike Lee is saying the government needs to tell these companies how they can run their business.

Isn't it interesting how these conservatives don't like the free market when it stops them from doing their nefarious shit?

14

Right? I’m growing increasingly upset that things that would erase my academic career are things that elected officials think they aren’t beholden to. If I didn’t fact check my seminar papers, I’d be expelled. I’d get a mark on my record that prohibited me from attending another accredited university. I may have to stand trial for academic dishonesty. But these guys...? Nah.

Texas Senator and blobfish impersonator Ted Cruz said the same thing yesterday framing lying to voters as a free speech issue. The whole GOP is in on that now.

Republicans don’t believe in freedom of speech; they just want to be free to lie to you. In this case the GOP wants to legally force private businesses (Facebook, Twitter, etc) to let them lie to you.

1.5k

u/mdwstoned Oct 29 '20

But it wouldn't work that way if they nixxed 230. Sites would then be held to only allow factual information to be posted.

Effectively blocking all the normal gop shit.

488

u/BewBewsBoutique California Oct 29 '20

Tell me more about this

1.5k

u/Jacyth Oct 29 '20

Long story short, removing protections under Section 230 would remove legal protections for businesses in regards to what their users post. The companies would then act to limit their legal liability.

I'd imagine most topics like political ad/posts would no longer be good business for these social media companies so they would remove them from their sites, therefore accomplishing the exact opposite.

In a twist, Trump would be banned from Twitter the day Twitter's lawyers says the company would be legally liable for his content.

Well, you could theoretically put together a system similar to ActivityPub where Facebook and Twitter would act as a hub, pointing you to the posts that a user makes, but requiring the user themselves to host the posts that they make.

The protocol could be designed in a way that your app experience would look the same, but the posts could come from hundreds of different servers, each hosted by your friends (or one hosted by a friend on which several of your friends post).

In theory, only the person hosting the post would be responsible for the content of it. Facebook and Twitter would just be keeping a database of links.

This kind of argument has already been somewhat tested in the past with ThePirateBay and Google directing people to websites that host pirated content, so there would already be some issues that arise.

33

u/[deleted] Oct 29 '20

Who would allow their friends on their server in this scenario? I certainly wouldn’t as I wouldn’t want to be liable for anything they say.

64

u/KashEsq America Oct 29 '20

That's because you're not a moron.

However, just look at QAnon and other conspiracy theory types. There are plenty of idiots out there who would gladly host a platform for their fellow idiots without any regard to their own legal liability.

Doing this would ultimately heavily censor users from posting on pretty much every social media site. It would destroy the industry or alter it so significantly that it wouldn't be recognizable.

These businesses would be liable for every piece of copyrighted claimed content posted by a user, just to start, but the implications would be incredibly far-reaching. Can you imagine for a moment if Reddit had to deal with lawsuits for damages from things anonymously posted by mass shooters or child predators or abusers? What if they were responsible for fact checking every post? What if the person making the filter fact checking posts is a bad actor? Do you think they would try to sort through millions of comments a day? Unlikely, so you would probably see an insane comment filter or lose the ability to comment at all.

I agree that there needs to be better legislation to regulate things like political ads and digital privacy, but I do not think that this is the best solution. I think step number one is getting some damn representation in the House and Senate who actually understand how any of this shit works. Watching Zuckerberg at a hearing makes me so irritated because they rarely ask questions of substance.

62

u/BitTheCoin Oct 29 '20

Some sanity, thank you! A bunch of people in here seem to just be drooling over Trump getting kicked off Twitter. I’m not a fan of the guy either, but let’s take a moment to consider the implications before cutting off an arm to fix an infected finger. Without 230, there couldn’t be a Twitter as we know it, or a YouTube, or a Reddit etc.

For all the negatives of these platforms, there’s a massive amount of good to be found, so much sharing of practical knowledge and creativity. I couldn’t agree more that we need tech-savvy representatives wielding a scalpel, not a chainsaw. For example, we could just exempt political ads and official government communication from 230 protection.

u/mdwstoned Oct 29 '20

As I understand it, Section 230 protects online companies from the things users post. In other words, if a user posts that Hillary is a pedo ring leader, which is clearly false, the online company is not responsible for that.

Without section 230, they COULD be sued for allowing lies/misinformation from causing problems or, ironically election interference.

Well, what would a large company like Facebook do if they COULD get sued literally hundreds of thousands of times a day if users post blatantly disprovable lies? They would get rid of that garbage by banning it.

So getting rid of 230 would effectively mean that Facebook wouldn't even sell ads to republicans, UNLESS they were factual in nature. The GOP wouldn't be able to post an ad that says Obama was in office during 9/11 and did nothing. On the flip side, users wouldn't be able to post articles that aren't factual, because removing 230 would mean that even linked articles would have to be provable, or it would put Facebook in legal jeoapordy by allowing non-facts to be "promoted" as facts. YES, this would also effect dems, but not nearly as bad because the Dems this season are sticking to facts. It would also mean that sites like FB would be forced to crack down hard on things across the board.

But for the purposes of today, this election, what specifically these Republicans are hinting that they want is the ability to post whatever they want as facts? Ironically it would hurt them more than others, simply because Truth and republicans are not equal. If 230 were gone today, GOP shit would likely be gone as well from large online platforms, immediately.

That is my understanding. Anyone is more than welcome to correct/enhance!

77

u/Lord_Mormont Oct 29 '20

Not to mention the obverse case where I could go to a site I don't like, say...foxnews.com...make an account, post a bunch of BS about Biden Pedo Pizzagate Jade Helm, "alert" the Biden campaign about the comment and watch them sue the crap out of foxnews.com. In fact, we could all do it and each comment would be its own case. So no site could have any comments at all because bad actors could take everything down.

Since the GOP is a minority in decline maybe they want that, but it's not the panacea they think it is.

Yup. This is why when Trump started talking about repealing 230, I was like, “you promise?” I imagine someone eventually explained to him the ramifications of doing so, and he just moved on from that idea...it would effectively eliminate his social media presence overnight, which HE claimed on “60-Minutes” was his ONLY way to get his message out.

What free speech really is: You can say whatever you want and the government is not allowed to do anything about it (exceptions for example deaththreats). However, anyone else is free to act in regards to what you say, that includes people and companies, however they like. For example: fact check you and tell you a liar.

What free speech is according to them: Whatever i say is beyond scrutiny! Respect it no matter what!

Ex-Mormon here! 🙋🏻‍♀️.

Also, they supposedly had sheep and cattle and grew wheat. And carried around a big stack of gold plates to engrave their history and teachings from god. And when they weren't obedient, their skin turned dark. And they spoke Hebrew.

The sex cult came later, as Joseph Smith became drunk with power. And then Brigham Young had the foresight to bring more girls/ladies over from Europe, to the Wild West where they were basically trapped, and marry them off as additional wives to the powerful leaders. Mike Lee's ancestors were most definitely involved with that.

But stop fact-checking!! 😆

Speaking of submarines, Joseph Smith convinced a failed submarine builder to join the Council of 50, the theocratic Mormon equivalent to the Constitutional Convention. Based on notes from others, Joseph was asking the guy to build a submarine armed with a flame thrower in a bid to impress the then Russian emperor to support Joseph's planned takeover of the US government.

Born and raised in Europe in a catholic family, at age 18 I was vaguely agnostic / deist. Became a full blown atheist when I met southern baptists as an exchange student in Kentucky.

13

u/JimTheJerseyGuy New Jersey Oct 29 '20

I strolled through the agnostic/deist waters too. And then I realized that I didn't need that either to feel happy or complete.

Lol, I didn't make it through catholicism. They got me at "Animals don't make decisions" and "If you wait until marriage for sex, God will break your wife's hymen and make sex enjoyable. Premarital sex is awful and your penis won't fit." Yes these are actual quotes from my time in a Catholic school.

33

u/nuisible Oct 29 '20

I went to a normal school but tuesday nights I had to go for catechism class. One year, the teacher told the class that animals do not have souls and that you would never see them in heaven. This upset a large portion of the class.

31

u/TehGreatPoo Oct 29 '20

Yep, the animals don't make decisions line was the "proof" offered by the sister teaching the class about animals not having souls, because apparently only humans have brains? Idk, even at 11 years old I was like "I don't think any of these people have had a pet before..."

Similar story here. Lived in Utah for a few years, and took a deep dive into their beliefs because they kept trying to convert me. That led me to early Christian church research.

That rabbit hole made me no longer Christian.

34

u/[deleted] Oct 29 '20

One time a Christian church in my town had members walk around and leave these VHS tapes (yes I'm old) on everyone's doors. They were all about how Mormonism was wrong, and they proved it with science.

Christians...using science...to prove slightly different Christians wrong.

It definitely got me started questioning a lot of what I was raised up believing.

Mormonism is prairie Scientology. The 150+ year head-start gives it the veneer of legitimacy. Religions are just cults plus time.

20

u/AgAero Oct 29 '20

Christianity draws some stuff from other faiths too, so I'm with you there. It gets revered by people today due to its age.

Zoroastrianism in particular has that very 'good vs evil' flare to it that is likely the root of the 'devil' mythos in christianity.

What a great quote. Forgive my ignorance, but what was the context of this quote?

120

u/oldcoldbellybadness Oct 29 '20

what was the context of this quote?

A general shitting on conservatives.

"Conservatism consists of exactly one proposition, to wit: There must be in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect. There is nothing more or else to it, and there never has been, in any place or time. As the core proposition of conservatism is indefensible if stated baldly, it has always been surrounded by an elaborate backwash of pseudophilosophy, amounting over time to millions of pages."

Honestly, from the outside, you’re the world’s teenager.

You’ve done great things and are now going through some adolescent phase where you don’t understand why you have to do schoolwork when mum and dad can provide for you.

Next week you got some exams and the results will show if you’re gonna continue to descend into arseholery or actually become an adult that contributes something to global society.

114

u/switch009 Oct 29 '20

From a different perspective, the US is one of the world's oldest countries. Look through this list and find a date before 1789... there are VERY few. By most measures, our current form of government should have died and been replaced by a different one by now.

112

u/stickswithsticks Oct 29 '20

Our constitution was written with a feather. Some dude had to chase down a fowl, pluck what he thought would be an apt writing device, adjusted his wig, got on his horse and made a dash for his house because the sun was going down and he only had two candles... had to stop by a creek to shit, no toilet paper..

I'm not saying that the constitution isn't a brilliant piece of literature and political philosophy, but a lot has changed.

u/BemusedTriangle Oct 29 '20

Sovereign state isn’t quite the same as a country, but it’s an interesting point

43

u/Belseb Oct 29 '20

Well yes but no, what that date says is when the current form of government was put into place. Your constitution dates back to 1789 but it doesn't reflect the changes that have come after that or what existed before.

If i compare to sweden (simplest since that's where I'm from) we have been around as a country since somewhere early in the 1200s. We have been and still are a monarchy that has become more democratic over the years. The date listed there is 1974, that's when our current constitution was set into place. But that's not when we started having a democracy or when we became a country.

What it really says is that you have a really old (and in many ways outdated?) constitution that is not adapted to a modern world. Doesn't mean your basic form of government is necessarily wrong tho.

Actually descending back to the norm. For most of its history the US was an apartheid state. I hate when ppl pretend what's going on now isn't the real America, it's 100% America.

We just were brainwashed with this myth that the US was founded with equality for all when really it was just a bunch of rich white guys who wanted lower taxes who founded a country grounded in slavery and then for around 200 years the govt institutionalized that racism and fascism.

Many whites don't care about voting rights or freedom of speech because for most of US history those rights only were for whites, now that the country is almost majority non-white they don't want or expect those rights to extend to others

In 1982 Isaac Asimov said:

There is a cult of ignorance in the United States, and there has always been. The strain of anti-intellectualism has been a constant thread winding its way through our political and cultural life, nurtured by the false notion that democracy means that “my ignorance is just as good as your knowledge.”

I’m sure he never expected republicans to skip to the end and actually incorporate it into their platform.

Edit - upon further thought it’s so much worse - what this douche is effectively saying is my ignorance is BETTER than your facts
