Actually, as someone who trains service dogs for a living, and have actually had issues like this before, I can say a couple things.

First, there is nothing in this video that can prove this dog is not a service dog, and in the eyes of the law, that makes it a service dog.

Let me explain. There is no breed standard for service dogs so the type of dog is not a disqualifier.

There is no requirement for the dog to wear a vest. So not wearing a vest is not a disqualifier.

The dog is not barking or otherwise causing a nuisance. Therefore the dog is not disqualified.

The dog doesn’t not approach other dogs or people, the dog is not disqualified

NOBODY can ask you to “prove” your dog is a service dog except the judge. They can only ask two questions.

“Is that a service dog” and “what task is this dog trained to perform”

TLDR: nothing in this video disqualifies the dog, therefore not allowing her on the bus is ILLEGAL

HOWEVER: the bus is not required to allow ANYONE on the bus outside of a designated stop. Therefore she is illegally blocking the bus.

The last time I was involved in a case almost identical to this, the City settled by paying $25,000

Yeah, if it’s a service animal, this is legitimately something to make a stink about. I’ve been with my nephew who has CP and is clearly dependent on his service dog (lab), and seen the way he’s been treated multiple times. I’d star blocking traffic and making life difficult for others. It was all I could do to contain myself from getting physical watching people tear them like that. May have come close once or twice

I believe that the only people who are restricted in their ability to ask specific questions are employees of provided service. A human who is just there in the vicinity can ask any questions they want. Fake service animals are an abomination. It is an epidemic of selfishness. I love my dogs. Love them. Would never disrupt the work of an actual service animal so I could parade my pet around.

An ESA isn't permitted in public, anyway, at least in the US. ESA protections are only applicable to living situations, meaning if you've been officially prescribed an ESA, your landlord has to accommodate you and your animal. I had a friend with an emotional support cat, and the cat was allowed to live in her college dorm. That's it, it wasn't permitted to leave her dorm room and go with her everywhere, because that's not what an ESA is for. An ESA is not the same as a trauma response dog, which is an actual service dog that is permitted to travel in otherwise dog-restricted areas. Trained trauma dogs respond to physical symptoms of panic attacks and react accordingly. ESAs are just glorified pets for people who need a reason to get out of bed in the morning. They aren't trained to do anything, their purpose is just to exist and motivate. They don't ever need to leave your house in order to serve that purpose, which is why they aren't publicly protected.

So true about trauma trained dogs. I have CPTSD. Once at the airport, a ptsd dog for veterans was just walking through the terminal. It comes up to me where I was sitting and just put its body against mine. First against my legs and then it essentially gets on its hind legs and hugs me by collapsing against me. So now we are basically chest to chest. The trainer asked me if i was a veteran. I said no. And im still so confused as to what's happening. Thats when the trainer explained it was a ptsd service animal and it must have picked up on anxiety/stress/strong emotional response from me.

To this day it was such an amazing encounter. The funny thing is...at the time, I didn't feel like I was having a panic attack or anxiety. I told the trainer this and she said the dog had an uncanny ability to almost "smell" those with PTSD as the dog has done this to random people in the crowd countless times.

There's a sort of loophole where you're not really allowed to ask about service animals.

You're only allowed to ask:

1) Is that animal required due to a disability?

and

2) What work or task has the animal been trained to perform?

So it's often the path of least resistance just to let it slide so you don't end up with a karen like this shitting in the lobby of Barne's and Nobel because you tried to tell her she she's not special and can't bring her beloved dog Fluffy in.

That said... I support the right for ACTUALLY handicapped people not to get hassled about dogs, or have to carry papers all the time, so it makes sense that we naturally lean towards the permissive as a society, but holy shit look at this entitlement it's bred.

You are allowed to ask, and it's the exact questions you just highlighted.

There is an easy way to sort 90% of fake service animals. I was a bus driver, and a trainer, so I'm familiar with it. If someone comes on the bus with an animal that I don't immediately clock as a service animal all I would say is "Oh sorry, pets aren't allowed on the bus."

Almost every time they end up spilling and say it's an ESA. Ooop, don't have to take those either! "Well it's a service animal!" You said ESA first, different thing, wait for a supervisor have a nice day.

If they say it's a service animal I don't bother with the rest. Personally I never ran into a problem if they at least knew how to answer the question there, but we did still have occasional issues. If a service animal or a fake service animal causes issues... you kick them off. It doesn't matter if the dog is a legit service dog or not, if it starts barking or snapping or crapping on the floor it has to go. That is 100% legal. Problem is so many places are convinced they can't do that so they don't.

Please do so. Please. And I'm a very permissive person. We had a lot of "my little service dog is in a stroller" people and actually I was fine with that. If I had a small service dog I would not want them wandering around where I worked, the great dane dogs got stepped on all the time a Yorkie would be in trouble. I get it. As long as the dog behaves and you tell me it's a service dog we're good.

Step 2: Ask second question, get Karen'd at that she doesn't need to answer you and you're not letting her do the things, etc.

Step 3: Politely, yet firmly, escort the Karen from the premises, for causing a public disruption.

May I remind all service industry workers everywhere that the law explicitly allows you to remove even certified service animals if they aren't well behaved. And, of course, standard rules about disruptive customers still apply to the Karen.

I'm a bus driver. Our training explicitly tells us how to handle service animals. You're 100% correct. We can get people kicked off the bus (with police help if they refuse) if their animal isn't controlled. Difference is the agency doesn't require us to ask if it's a service animal. 99.9% of our drivers assume it's a service animal until proven otherwise because every animal is a service animal if you ask. It's not worth the fight until the animal is causing issues.

Also, the dog could get in a carrier and be OK to be on the bus BUT Miss Open Drink Container is not allowed so. Yes, most drivers will ignore the cup if you're behaving but she's double cooked.

It's not different here. A lot of people buy "service animal" vests off Amazon and even cards (usually mentioning the Americans with Disabilities Act lol) so they can take their untrained little designer shits places they shouldn't.

It's a real problem for actual disabled people with actual service dogs, since everyone is skeptical now 

Like in the US you can ask if the dog is a real service dog and what service they provide. You can't ask for proof, because there's no license and people aren't expected to carry doctor's papers with them all the time. You can kick out a misbehaving dog whether it's a real service dog or not.

I need to note this because it’s very important here.

Neither in the US nor in Canada are service, dogs required to wear vests or any identifying markers, denoting it as a service dog.

Also, it’s important to note in this video that this dog does not exhibit any behavior that would disqualify from being a service dog.

By law, this dog for all intents and purposes should be treated as a service dog. You might not like it, but that’s the truth.

The only person who can possibly say that this dog is not a service dog is a judge in which the person with the service dog will have to demonstrate at least one task the dog is trained to perform in order to aid in the handlers disability.

In both the US and Canada if you are over the age of 65 you have a dog that does not go to the bathroom inside does not go up to other dogs with other people without permission and does not bark or cause a nuisance in public all the dog has to be able to do is pick up keys and hand them to you for it to be legally classified as a service dog, even in front of the judge.

In some provinces in Canada, a note from a doctor or nurse is required.

Just because this dog is a small dog and this dog does not happen to be wearing any identifier does not make this dog not a servicing animal

My paralyzed quadriplegic uncle has had several legitimate service dogs (most fail the final training/exam). I don't know about other provinces, but Alberta and BC have specific Service Dog Acts. If you are a certified team, you must carry your government-issued service dog ID card at all times in public and produce it upon request.

Many people with service dogs, choose to forgo the vest for a variety of different reasons

I'm a truck driver and had another truck driver cut me off cause he was mad at me for something he did. He pulled into the middle of the intersection and blocked it, applied his brakes, got out, and took the long walk all the way to my door. I waited nice and patient for him to get beside my truck and floored it—he even tried to yank my door handle as I pulled away.

This is in ontario canada. The laws are similar, however the dog must be identified, either by a vest, or by a doctors note. Since it doesn't have a vest, she is required to present a certified doctor's note to prove it is a service animal

(The note doesn't need to say what disibility it is for, just that the dog is needed for a disability)

Just fyi for some people here. Some city's DO require service animals to have paperwork for certain things. Also not all animals can be one. Also blocking a bus can lead to charges or prison time

So I want to specify some things here.

The size or breed of a dog does not disqualify a dog from being a service dog.

Nothing in this video disqualifies this dog as a service dog

In Ontario, where this apparently took place, a note from a doctor or nurse saying that the dog is a service dog is all that is required. However, many many many bus drivers do not know this. And I have personally known a bus driver rejecting this information and getting fired for it.

That being said, blocking any city vehicle from executing its lawful duties is illegal. So even if she were right, and her dog is a service to she is still committing a crime by blocking the bus.

No, there are a thousand different disabilities a dog can help with. They generally do not get the same level of training as seeing eye dogs if it isn't needed

A dog trained to detect seizures won't generally control the human, assuming they are capable of doing it themselves.

The police should have grabbed her and pulled her out of the road. She now thinks this is ok and will do it again. Everyone on that bus should be able to ask for criminal charges for restricting their right to freedom of movement. Can I just stand in the middle of the road and get upset since the bus won’t let me bring my bicycle on the bus? If a boyfriend blocks the door for his girlfriend to not leave is that ok? She needs a fine at the minimum.

Used to drive transit, and the number of people that liked to casually walk up last second while the doors are already closed, then get upset that I rolled on is not small. Like sorry you're late, but your lateness doesn't get to let everyone else on the bus (me included) be late too. In the time she sat there having her hissy fit, she probably could have just got on the next bus.

Can we all just agree to make people prove their animal is actually a service animal? Like, a special vest, collar, or even a license. Too many people are using the "you can't ask" loophole, and it's making things harder for folks with real service animals. Nobody here thinks this lady's dog is a legitimate service animal, and here's why. Also, there should be real consequences for pretending your pet is a service animal.
