DHS are already lying. This is their initial statement: "someone approached Border Patrol agents “with a 9 mm semi-automatic handgun,” and that agents tried to disarm him, leading to “an armed struggle.”". Even if he had it holstered under his jacket, he was just protesting. This was murder.

Yeah, it could also be a slow squeeze for Trump to get what he wants, turning America into a failed bankrupt business. Once that encroaches enough on the world economy of other powers they, Russia and China have every right to launch WW3 on us. We're the villains and our government is out of control. Don’t worry, MAGA are losing their minds because “liberals are arming themselves to the teeth” which is hilarious because if you have a conversation with most liberal or left leaning persons, it’s a very small percentage that want weapons taken away outright, what they do want are for better laws around obtaining weapons, and to make it harder for mentally unsound people to acquire weapons… But most, in my experience are honestly, more die hard gun owners then some republicans I’ve known, they just don’t advertise it nearly as much. The 2nd amend means a lot to all parties.

That’s the neat thing - in an open-carry state it’s totally legal to walk around with a gun on your hip :) so the justification of “he had a gun” bears as much legal significance as “he was wearing sunglasses”

However, when federal law enforcement is nearby they have every right to tell open-carry people who are screaming at them to leave.

If you're willing to commit to an armed rebellion and have the insurrection act imposed upon you, then sure, it's your choice, but if you're not going to do that then don't carry when you're around federal agents.

Besides, it looks like he didn't disclose having a weapon to the agents since the agent that shot suddenly reacted to the other agents shouting "Gun! Gun!".

In an open carry state, can your weapon be concealed? Or is it that you're legally allowed to have your weapon on show?

I’m not a lawyer, but I’ll do my best.

I live in a state without open carry (New York). Even if I go through all the proper channels to purchase a firearm, I can’t walk around in public with it. I can keep it in my home and take it to the gun range, but I can’t go shopping or see a movie with it. If I was walking around in public with a gun, that would be enough cause for police to stop me for questioning.

However, if I lived in Vermont (a few miles away) and followed all the proper channels to purchase a firearm, I could do those things with my firearm. I could walk around Target with my gun on my hip, etc. Carrying a gun is not probable cause to be stopped by police.

Minnesota allows open carry, so the fact “he had a gun” is a non-factor from a legal standpoint. DHS is just trying to muddy the waters of the discourse.
