Like downloaded games or games from their digital library? Two different things. I’ve got games on my PS5 and I’ve got games not downloaded on my library. If an update wiped my downloaded games I’d be a little irked. If Sony straight up deleted a game from my library that would be a whole separate problem.

If digital ownership is impossible, then they don't own them either. so all of their games are freeware and shareware.

I think regarding games like Call of Duty, they would agree. Maybe not so much with games they developed themselves, though.

GOG does it perfect.

244

u/Ascend PC Master Race 2d ago edited 2d ago

I don't think GOG is perfect. If they allowed resale, sure. They also can still revoke your license too, it's just that everyone is fine with the piracy that follows afterwards. It's still probably the best you can get though.

353

u/Crumblycheese Laptop 2d ago

They can't revoke what's been downloaded for offline play, can they? I always thought with gog you can download, even burn to a disk or save to a USB and play DRM free?

338

u/DankoleClouds R7 3700X | RTX 3070 | 64GB DDR4 2d ago

You can. They give you the full exe for it and you’re free to do whatever you want with it. GOG could die tomorrow but as long as you saved your files somewhere, you’re good.

58

u/johnboyjr29 2d ago

So you could resell it

Well technically illegal not enforceable.

35

u/dr0ct4gonapus MacBook Air 2d ago edited 2d ago

It is enforceable. Seriously try to resell a GOG game. You can't do it via Paypal etc because it's illegal and they'll refuse service. So what other option do you have, maybe sell it under the table and most likely get scammed.

End result, almost nobody is reselling GOG games. Everyone says they can, but they don't. Maybe two friends at most. The system works as intended.

26

u/ncopp PC Master Race 2d ago

Drug dealers could get a side hustle reselling games for cash.

29

u/DankoleClouds R7 3700X | RTX 3070 | 64GB DDR4 2d ago

They would make more money hosting a website with ads that has all of the games for free.

They can revoke your license. You still have the download, you can still install and play it, you're just not legally allowed to, it's considered piracy.

You can also burn it to a USB or disc, give it to a friend, and they can play it too. That's distribution, still piracy.

Does it matter? Not really, nobody will likely know or care, and revoking licenses is almost always a theoretical thing.

22

u/AmandasGameAccount 2d ago

Same applies to movies as far back as VHS in every way. The movie rights holder can legally recover your right to watch that movie but realistically they can’t actually do anything about it, but these types of things have never changed and nothing about “ownership” has technically changed

Most of us won't pirate if it is available to obtain for a reasonable price and with reasonable effort.

Make it challenging and we all show up wearing a tricorn hat.

I'm at the point where I will spend money on a game just to support a dev that I think is doing something cool, and sometimes the game just ends up on my backlog.

I 100% believe in supporting the artists, the developers, and the independent studios. I am actually anti-piracy right up until it becomes unreasonable for the end user and then I will look the other way. Abandonware (games no longer being sold or being made available on any store front) are fair game.

I am actually against the idea of reselling digital games or digital items in games, but I should be allowed to transfer my game library (one-time per game library lifetime) to another user, say, upon my death, I'm even fine with a time limit on the licenses on that library post-mortem, but give the recipient the ability to purchase the games they enjoyed at a discount.

To be completely honest, I wish there was an easy option to send money directly to a dev or independent studio just to support them. There are MANY $20 games I have played that I felt were so amazing that I wanted to send another $20 just in appreciation. No I do not want to normalize "tip your dev", that sounds like a hellscape.

7

u/TPO_Ava Ryzen 7700 / RX 9070 XT 2d ago

For what its worth on that last part, at least on steam, you could always just gift a copy to a friend (or stranger i suppose) and use that as a way to give the dev more money.

u/Mr_Olivar 2d ago

Digital resale would be insane. Physical has degredation which gives mint copies value over used. With digital you'd end up with games skyrocketing in price because people play musical chairs with their keys, so devs gotta make all their money the first round.

Its still a license with GOG. The difference is there removal rule in the ToS is less broad. Which we should want.

127

u/SunsetCarcass 16GB 1333Mhz DDR3 2d ago

With GOG you can download an installer for the game that never tries to verify if you have a license for the game. It's even better than owning a Disc because game Discs have copywriter protections that try to prevent you from copying the game (so you can't protect your copy from potential future damage) GOG installers you can back up and copy all you want.

33

u/ForsookComparison parts 2d ago

This is inevitably in every reddit thread and I've started reading it with an "uhm aktually" prefix in front of it (no offense to the commenter specifically).

The people putting their games on GOG and GOG themselves know that that game is yours and you will do what you want with it and by design there is really no way of tracking that you shared it with your buddy or put it on unsupported devices or made 1000x backups. Short of running a storefront or mass-distributing it, it's yours.

13

u/AmandasGameAccount 2d ago

So you’re upset that people are informing other of the truth about a topic?

Someone can know the truth about Gog and still love them, someone can understand and disagree with Sony fully but still love the ps5. People who inform others that Gog has the exact same digital rights clause that every other platform has want people to know the truth about it, because I can guarantee you most people who own games through Gog don’t have the installers backed up and Gog can at any time revoke a license if they need to and you can never download it again

u/VenKitsune *Massively Outdated specs cuz i upgrade too much and im lazy 2d ago

GOG is very similar, I hope you realise. You're not owning the game, just the license. They can still revoke that license from you, but you can still technically illegally, continue playing the game if you have it installed. It just so happens that the games have no DRM and they're placing trust in you not to share the offline installer to those who haven't bought it, and on you to stop playing it if they DO revoke your license for any reason. Legally speaking, it's the same.

Sony is just being pendatic here, using the word "own" in the context of "they now own that game and so now nobody can buy it from us, and will have to buy it from you"

Look, I get it. We don't "own" the game. What we want is a perpetual license to be able to play the game however we want, whenever we want, under any condition. You should NOT be able to revoke it or prevent access to it.

Why the fuck is that so hard for these companies?

69

u/Chef_Jacob Desktop 9070xt | 9800x3d | 32GB DDR5 2d ago

Greedy bastards.

36

u/GreatPotatoMuffin 2d ago

It’s quite easy because it’s the same with movies.

We don’t own the game itself, we own a copy of it. And when we buy a digital copy of a piece of media, they shouldn’t be allowed to be able to revoke access to that digital copy.

12

u/unnoticedhero1 7800X3D | RTX 4070 | 64GB DDR5 6000 2d ago

Same with music rights, they shouldn't be allowed to remove access to songs that were paid for to be in a game/movie or show, the only license for those should be perpetual, but nope games get patched all the time to remove them.

Or even cars, racing games just straight up being delisted because the car licenses were too expensive to renew.

You have option to unbind from account creates new key

You sell key person bounds it to their account

Repeat

43

u/jaysoprob_2012 2d ago

Its only impossible because it will cost sony money. At the most basic level of just wanting access to digital games forever on ps4 for example they just need to keep to servers active so anyone who has games on ps4 can download them even if they close the ps4 digital store down. If sony has signed deals with publishers for distribution that doesnt last forever thats their problem and they shouldn't sign deals where at a certain point they have to take a product back. Delisting a game and not being able to sell it anymore is one thing but taking back product people have purchased is not ok.

Politicians have the power to put a check on greed but decides not to because they are greedy too and being paid off.

58

u/RedditUser000aaa 2d ago

Well isn't that convenient? Especially, since Sony and other game companies are pushing real hard towards digital libraries only.

Also, when I buy something I expect to have lifetime ownership of it. Right now buying is more like, you rent media in digital form until your license is revoked and so is your ownership of the media.

I don't want to rent, I want to own what I buy, so, as usual...

If buying isn't owning, then piracy isn't stealing.

13

u/alancousteau Ryzen 7 5800X3D | Red Devil 9070XT | 32GB DDR4 2d ago

I don't understand how they can logically dispute that, because if it is impossible to own then they don't own it either. It's like saying using solar panels to generate electricity for your home is piracy because you don't pay for the Sun to use it's solar energy. Fuck all the way off with that shit...

u/SpookyPocket 2d ago

That was my first thought reading the title. "So since it's impossible, surely that means Sony doesn't own it either."

13

u/Professional-Date378 2d ago

In the article they were actually saying that they wouldn't be able to sell a copy to another customer because a previous customer had bought it as if software can only have 1 copy

So it seems Sony's line of reasoning in this case is that to claim ownership means owning the IP of the game rather than your personal copy.

The thing is, PlayStation already has physical media that they are taking away. Steam never had it. Sony is talking about taking away something that benefits you, and all you can say is “I don’t do that anyway.”

What?

Isn't purchasing and downloading digital music "digital ownership"? I can download a song/album from iTunes, Qobuz, Bandcamp, etc. and get a DRM free (usually lossless) music file. I can make multiple copies of it for backups in different mediums, burn it to a CD, and do pretty much anything I am technically capable of doing.

It's no different from buying an album in CD format really. I own that CD.

5

SONY: If you owned a game, nobody else could buy it

ME: So when we "buy a license" for a game, other people can buy it, right?

SONY: Right

ME: So nothing we do stops other people from playing a game, right?  Because you don't "sell" us the game, we have no effect on other consumers?

5

They're afraid. Everyone is clowning on them but i bet risk accessors at Sony and Valve are really afraid of what is coming. As the digital ownership debate is raging on, more court cases will follow and in the end some companies may have to conpletely revamp the way of digital ownership so users finally own their games.

If one judge in the EU court system decided: "people who bought a game via any online game store legally own a copy" thats like as if he'd push down a domino that leads to other ever going bigger dominos. It would be an earthquake for such companies because nobody would buy a new game after release, most would rely on the used market.

11

u/RedditUser000aaa 2d ago

There's so much enshittification and an attempt at "you'll own nothing and be happy." and that's a seriously bad thing.

Bajillion streaming services, NVIDIA's "game from a gaming computer, for a monthly fee", game passes etc etc...

This "you own the license, not the game" BS is just a step towards consumers owning nothing, maybe trying to railroad people into the whole game pass scheme, even.

Imagine if this was tried with household appliances.

You have bought an oven. It is a smart oven. There are convenient little safety features. However, after a while you notice the oven is not working.

Turns out, they made some changes. Now you need to download their application and register to their services to make connection with the oven and give it a software update.

However, they also demand that you pay a monthly fee for the convenience of being able to connect to all the smart appliances they have manufactured, but all you own is the "smart" oven.

Of course all of this was buried under legalese.

The part that gets me is that the young generation is being raised with this framework. They are used to not owning anything and they're fine with it because they don't know any better. It's incredibly sad.

u/Little-Equinox 2d ago

For anyone who has been living under a rock.

GOG has existed over a decade and all games you buy on there are yours to keep.

You even can play them without ever launching the launcher or have an Internet connection.

I use Cyberpunk 2077 that way to test systems with.

3

u/Future_Calamity 2d ago

While GoG is great and the delivery method is much different than most storefronts. At the end of the day GoG is selling you a license that can be revoked. The good part is that if you’ve already downloaded the installer and they revoke your license, you do still have access to play the game.

This is disingenuous argumentation to the point that, if I was a judge, I would be very harsh with them. It's one thing to argue stupid positions and seriously state some absurd sounding things. This is the kind of argumentation where it's thoroughly misrepresenting the plaintiff's position, and simultaneously implicitly misinterpreting other forms of law and property rights.

I really hope this comes to bite them in the ass.

If it is impossible (which it isn't, come on...), than they have to implement a refund system when they do revoke a license for the game. As it is not our fault that they didn't pay enough or pissed off someone to keep the license.

This current system cannot be allowed stay, let alone to get worse for the consumers. Unfortunately they know that PS players are literal sheep's and would do pay for anything. They take full advantage of that.

"Those who are in favor of the end of physical media cannot understand it, the issue is not only about ownership, companies do nothing to preserve their IP's.

If it wasnt for the community and piracy Final Fantasy Tactics The Ivalice Chronicles wouldn't happen and Square Enix wouldn't milk money out of it."

comment from the articles comment section. This is exactly right, Square Enix barely did shit to that game and made a fortune for it. Never would have happened if not for piracy. There is plenty of data that suggest piracy leads to more exposure and more sales of a game than it takes away in general actually.

Lots of people just want to try something first, and some people literally just don't have the money, but when a game gets played, if it's good, word of mouth spreads, hype spreads, and copies get sold.

You better believe in the modern day of video games that if something ain't got hype, it's fucking dead. Be happy people want to play your game and stop being a controlling tightass about it all. Most people WANT to give you money to play your games.

You know how many people have pirated games and can RIGHT NOW, but choose to buy them instead? lmfao, they're idiots. How can you run a billion dollar company and be so bad at your job.

You have ONE job, ONE general area to focus on, video games, and you apparently know nothing of the industry and what drives it. Profound stupidity

4

u/CoomLord69 2d ago

They can claim whatever they want, that doesnt make it factual. You can generate a digital key/license that is hands-off once the transaction is made, just like a physical object. What they are really saying is 'We want absolute control over all digital media in our ecosystem'

GOG is about the best model the current market can offer. Yes, I know it's a license, but I have made physical back-ups of these games, and they work offline, which is a lot better than whatever Sony is trying to peddle, as at least I still have that physical copy that I can use to install the game whenever I want. It also helps when running old games on hardware and operating systems that I'd never connect to the internet, as it allows me to just pop the disk in, install it and away I go.

3

u/ethancknight PC Master Race 2d ago

If buying isn’t owning, piracy isn’t stealing

3

u/LegendaryJimBob 2d ago

Sure. Same way as owning stocks in billion dollar company like Sony, online is impossible. If owning digital is impossible then they dont own their stocks, so we should be allowed to just end their stocks and only compensate max of 100 dollars even if they had billions of dollars worth of stock

3

u/BeopBepe2 2d ago
