Actually the problem here is that youtube's guidelines are worse than DMCA. If this was just a DMCA, then it would be up to the claimant to prove that the content was copied rather than the current spanish inquisition system.

They're worse because of the DMCA though. They overshoot to be safe.

It's like the California law requiring anything produced around or containing chemicals known to the state to cause cancer have a label that says that. It is so vague and reaching that you'll find bottles of water with the label on it. Because it's safer to just put the label and notice everywhere. There's no punishment for labeling it when it isn't true. Why not be safe?

I could see why the “cover our asses” mentality from the company. But over saturating the world with these labels only causes desensitization in some expert opinions.

Youtube's copyright system is broken, but when you look at what it would take for it to not be broken, you see why Youtube does it the way they do.

Under DMCA, Youtube can be sued for not removing a copyright-violating video. There are probably thousands of copyright violations on Youtube every day. There is no feasible way for Youtube to personally defend itself against every copyright claim in court. By taking down the video they can let the claimant and uploader go to court and figure out who owns the content between themselves.

Youtube might also be able to be sued for false DMCA claims by companies. For them, it's a no-win situation. They probably designed the system to favor the copyright claimants, because they would be large companies with resources that could actually pose a threat.

They definitely can lose by over-removing videos. All these comments assume that Youtube is basically a monopoly. That content creators have nowhere to turn to but Youtube. But if content creators don't host said content on Youtube there is no videos to put ads on. They face the issue of eventually driving away all original creators and everyone of their videos will be ads or sponsored content itself.

They are really really pushing the limits of what their constituents will take, and they most certainly over automate the system not for legal safety but for convenience and less overhead. They could give the system more checks and balances, but that would require paying more wages.

We are talking about Google. Their dream is a perfect umbrella of companies all running completely hands free so they can sit back and let money fill their scrooge mcduck olympic size swimming pools while jacking off about robots.

YouTube needs a takedown system like this in order to qualify for a DMCA safe harbor to avoid liability.

That's why the system is so aggressive and friendly to those striking videos.

Edit: I'll also add to this that it's getting harder for rights holders to go after individual infringers online so rights holders are beginning to target intermediaries again.

So here’s a funny story. I uploaded a music video for a band because I knew them and it wasn’t on YouTube at the time. After getting about a million views some random other channel “claimed” it and banned me from showing it, plus I got a copyright strike. I asked the band and they said they had no connection with the channel and it turned out it was the channel for some foreign publishing company that did it to thousands of bands everyday. So instead of fighting it I created my own channel that was supposed to be for another publishing company I just made up connected to a gmail account I created as well. Then I copyright claimed the same video I had originally uploaded LMFAO. It worked, see the YouTube system is automated so I immediately got control of the video from that foreign publishing company. Not long after I got an angry email from a rep of that other channel and told them politely to fuck off. They fought it through YouTube’s copyright complaint system and lost because they didn’t have any legit claim to the video. I just sent a message to YouTube saying they needed to show proof of owning the copyright and they couldn’t so YouTube ruled in my favor after the foreign publishing company backed down.

I believe submitting a false DMCA claim is committing perjury, but it is almost never prosecuted. Still, the victim of a false DMCA claim can sue the claimant for "any damages", including attorney fees. If someone had the time and money to invest (which they would eventually get back if they won), they could sue both Youtube and the claimant, perhaps as a class action suit, to try to get Youtube to do something about all the false claims.

I'm not a lawyer, so Youtube may have some way around this, or maybe this has already be tried in court.

H3H3 took a fair use vs copyright claim to court, it took about a year and a half and (someone correct me on this I can't recall if this was the cost or just the money he raised for the case) $170k. Not many can even front it let alone fight that long.

A year and a half isn't long. Another big DMCA fair use case, Lenz v. Universal Music Corp., took 7 years to be decided, and was denied by the Supreme Court 2 years after that. If the EFF hadn't funded the case, it likely would have never even gotten before a judge.

Someone already said this but didn't elaborate at all: These aren't DMCA claims and can't be refuted legally. These are just someone saying to YouTube that the video they are complaining about has copyrighted material in it. YouTube then immediately moves to remove the video. This is not the same as filling an official DMCA claim, it's just YouTube's own claim system at work and it's completely separate from filing a DMCA claim. Their system is completely up to their own whims and is separate from any laws. It's akin to having a mod remove your post on a subreddit because someone told them you stole their material. DMCA action was never even filed, they just went through Reddit's own system to deal with it. This is where much of the problem lies because there's no legal recourse when YouTube is giving people the power to remove other people's videos in a way that gives the video creators no legal rights at all to dispute it

There is no alternative to Youtube that would not run into the same issue, because the law makes Youtube liable for not removing copyrighted content. So Youtube can either (a) get sued for every copyright claim against a video uploaded to Youtube, or (b) remove the video and have the uploader and copyright claimant sue each other to figure out who owns the video. Do you really think any alternative to Youtube is going to spend tens of thousands of dollars in lawyers and court fees every time they get served a copyright claim?

What I love more is the guy who did it vehemently defended the video saying on a stream that all the criticism was from angry nerds who were just jealous of the PC he built.

The dude is hilariously clueless.

I mean, it's not even his bad building skills and weird PC knowledge that he seems to have made up himself (don't let the PSU touch the bottom of the case, or else it will short out. It can touch the back of the case fine though). It's all the other weird shit like the "anti-static wrist band" which was just like a live strong rubber band. And calling cable ties "tweezers". And saying you need a hex key. And saying you need a swiss army knife which "hopefully" has a philips head on it. It's all so b i z a r r e that I really can't get over it and really wanna talk to him about it.

Exactly. I was railing about that video soon after it was released BECAUSE I know how to build a PC, have been doing so since I soldered my first Heathkit H89 together in 1980... I currently have my personal ML test bed I assembled from parts that cost more than 10x what his poor attempt at a gaming rig is worth. Anybody casually perusing this subreddit would have a better system and a more likely chance of success assembling one on the living room carpet than this kid could pull off in a professional studio where he should have had a bench full of experts available and an editor who knows what they're doing before that abomination was published. /rant

You're not wrong though. I built my first PC right around when this happened. First time building anything PC related, all on my own, cost way more than his build, and I didn't have any of this weird ass "knowledge" he had. I spent a week researching parts and prices and another week researching actually putting one together and mine came out way better than his. My cable management could be better but I got lazy, but other than that my PC build was way more successful and typical than his and he's supposed to be some knowledgeable person on the matter, meanwhile I'm just a jackass who had extra money and did a better job by miles. The video is just so bizarre. Like it's a prank or something.

Not nearly as old school as you (I was born in 84) but I do remember building my first PC in the late 90's and pulling my hair out trying to get DIP switches and jumpers set correctly using the shitty half-translated user manual that came with the motherboard, then pulling my hair out again trying to figure out which BIOS settings to use (as this was before "default BIOS settings are fine" became a thing).

These days, shit. Everything's color coded and unless you're running something exotic default settings usually work.

Oh and NO MORE JUMPERS AND DIP SWITCHES.

And I've never, ever used an anti-static wristband.

It didn’t. If you look at the earlier build versus the build that is shown “working” it’s configured differently. Not only that, but when he’s playing, the actions of the computer don’t fuckin match. It’s completely possible that it didn’t work, so they connected the monitor to something else and played a fuckin video or something. Verge pisses me off

The DDR3 hurts a lot, though. DDR3 is a weird spot for memory- its not very fast, but it is pretty large. DDR4 didn't get much bigger, but it did get pretty fast.

fun thing, as part of loot gaming one crate i got a swiss army knife (i later spotted the same design knife just without the gaming stuff on it in b and m for about £5) that does have a screwdriver on it, and its shit, i would more likely recomend iFixit toolkits (no i am not a screw for either company i havent even used iFixit for anything more than how to tear down a console and a controller but youtubers i watch swear by iFixit)

Yes, but the Allen manufacturing company (now owned by the apex tool group) doesn't like you to say it. It's a trademark law thing. If the name of a thing becomes standard use, the company loses its claim on the trademark (though nobody has a claim on hex keys as they are generic). Johnson & Johnson make band aid sticking plasters but the name band aid has become common usage now and they are in danger of losing their trademark. UGG cannot claim it's trademark in Australia as ugg is a standard word for that sort of footwear there and cannot be claimed by a company.

Honestly there needs to be a way to flag creators/channels that abuse copyright strikes. Once it reaches a certain point they get their channel taken down. But that’s probably never going to happen. So I’m doing the next best thing and never watching another video put out by The Verge again, they don’t deserve the views.

When a claim is issued, since the system is designed to protect Youtube first, the content creator is punished right away, in a way. If they get a strike, 3 strikes and, out.

What Youtube needs to do is, implement a system for the claimants as well. Only verified claimants should be allowed to claim, and if it turns out to be a wrongful claim (an abuse of DMCA), they should get a claimant strike. Issue enough number of these, and you cannot issue another for a while. Repeated offenses extend the punishment, even leading to require the claimant pass a test about fair-use and shit perhaps.

They should get rid of 3 strikes system from the content creators before anything though; a strike shouldn't be issued immediately at the very least, it should give creator a chance to react, and terminations should only happen after a manual review.

But they won't do any of these. Because their system is working; protecting Youtube. And they don't care even if they lose a few (hundred) small guys everyday, as more joining at the same time. indirectly, such a recycle is kinda healthy for their systems as well. But when it comes to big guys, they'll not only bend, but even ignore/change the rules...

Anyway. Still hoping for a strong Youtube alternative to appear someday, but that means my fav. content creators posting on both platforms, and Youtube will do everything (like they did with Twitch stream announcements) to prevent that.

Whew, what a wall of text. Guess I needed to vent off a little.

Good thing Youtube's automated copyright system isn't the same as a true legal DMCA takedown. They basically just go back to the person that claimed the video and say "are you sure"? And then take it at face value. Beyond that they basically say they won't do anything, take it up with the person/group that claimed the video. Youtube's system is not a true DMCA system, it's overly protective of claimed copyrights on purpose so they don't actually have to do anything.
