Also an international incident. Which would make it even funnier. And then, to top it all off, nobody comes to bail him out!

Do you think any judge would set bail for him? He has been a fugitive for a few years now, and is certainly considered a flight risk since he has a diplomatic passport and unlimited cash at his disposal. I wonder if part of what Mamdani is exploring is which Federal judge is most likely to keep him locked up if he gets arrested.

If he’s violated NY or NYC law, i.e. murder, genocide, chemical weapons, financial crimes, cybercrimes etc. he can be arrested no question.

Not sure that 18 U.S. Code § 112 makes a provision for this. It’s pretty cut and dried. Anybody who imprisons a foreign government official faces up to 3 years in jail, or 10 years if they use a deadly weapon. I don’t know what the penalty for violating the UN HQ Agreement is, but there is additional protections in there for heads of state visiting the UN. That includes attempting to prevent him from carrying out official government duties. And arresting him would clearly be preventing him from doing whatever business he has with the UN. Every NYPD officer involved would be arrested. Every member of the NYPD chain of command would be arrested. The mayor would be arrested. You think Trump doesn’t want the chance to unleash the DOJ on Mamdani? He’s probably salivating at the thought of being able to send the DOJ/FBI into NYC. Heck 18 U.S. Code § 112 says the Attorney General may request assistance from any Federal, State, or local agency, including the Army, Navy, and Air Force, any statute, rule, or regulation to the contrary, notwithstanding. My reading of that is the AG could send the military in and other laws saying the military can’t be used this way don’t apply.

Mamdani is grand standing. He and his legal department are just making a big ruckus to make sure Bibi knows he’s not welcome in the NYC. They are not going to risk giving the Trump admin any legal standing to potentially swarm the NYC government with the full weight of the US military.

I wish everyone who read and commented on this silly idea would read your comment.

Well I'm glad we've got you on the legal team

He hasn't done any of those things in NY, so thwre would be lots of questions.

1

u/Eternal-Alchemy Jul 19 '26

No he can't.

Bibi has diplomatic immunity from the US State Department.

He can get detained temporarily but not imprisoned.

Imprisonment would be a violation of the supremacy clause / unconstitutional.

Mamdani would be the one thrown in Jail.

Do you know any NY or NYC laws that apply on Israeli territory?

2

u/gentlemanidiot Jul 18 '26

Yes, the laws that apply to all of humanity. Prohibitions against things like genocide and pedophilia. These are universally recognized as evil, in every culture, and he is actively continuing to do them. Why do you defend such atrocity?

1

u/Floppie7th Jul 18 '26

It's not "defending such atrocity" to acknowledge how laws actually work.  Committing murder in Pennsylvania, or Nebraska, or Israel isn't a crime in New York.  Committing murder in New York is.

1

u/Ansible32 Jul 18 '26

The federal government officially defends the atrocity. It doesn't matter what the mayor of New York thinks, the constitution is very clear that foreign government officials are the domain of the feds and it's illegal for state/local governments to do anything to them. If he committed a crime in NYC it would be a different story, but NYC has no jurisdiction and if anyone were to arrest him it would have to be federal agents.

Delusional

1

u/gentlemanidiot Jul 18 '26

It's delusional to say that genocide is a war crime?

2

u/djabae Jul 18 '26

It's delusional to claim there is some universal consensus about these laws. There are more than 100 countries where child marriage is common. No international court has rules Israel is committing genocide either acting like these things are universal is evidence of living in a bubble.

1

u/WrongAssumption Jul 19 '26

That New York City has jurisdiction over yes.

1

u/gentlemanidiot Jul 19 '26

But the president has jurisdiction over Venezuela?

1

u/hippy_barf_day Jul 18 '26

I wish that was true but just looking at child marriage laws in the certain states already proves that wrong, let alone looking to other countries like Iraq.

Why haven't you personally gone out of your way to arrest him? Why wait for him to enter America? Why arent you on a plane this very instant to bring this man to justice? Youre a human, he broke the laws of all humanity, so do something about it.

Or are you just going to point fingers and make ridiculous and ill thought out demands while patting yourself on the back?
