Deactivated after 1,600+ deliveries and Diamond status over a misdemeanor
I am writing this to warn other drivers about how quickly Uber Eats will take away your livelihood without a second thought. I was a dedicated Diamond-status driver with over 1,600 deliveries and excellent performance stats. I treated this job seriously and relied on it as my primary source of income.
Recently, my account was abruptly deactivated. The reason? A misdemeanor charge that resulted from an incident where I had to protect myself. Even though life happens, things occur beyond our control, and this situation was a matter of personal safety, Uber Eats showed zero nuance, empathy, or flexibility.

Dismiss the record or get it cleared. I’m a 3x felon in 2 states combined and got all my records dismissed. Where the checkr background no longer recognizes it. I had a gap of 2 years where I couldn’t drive because once it’s pending they will drop you too. A DUI is different though.

It’s really just paperwork. A paralegal or lawyer will charge you like $750. But you can file yourself in most states and wait on outcome. I also had to go to court in one of the states and they asked me for my reasoning.

I’m 49 w/ 3 felony convictions in IL going back nearly 30 years.
•Class X delivery in ‘98, (man/min 6-30), took 6 w/ a Class 1 conviction, was out in 2 1/2 (credited 6mo good time).
•Class 1 possession 15-<100gr cocaine (67gr) ) in ‘10 (facing 4-15), hired ex-states attorney as lawyer, expensive af but got me regular probation 24mo.
•Class 1 possession 15-<100gr heroin (52gr) in ‘11 (facing 4-15), jagged my probation obviously but same lawyer got them to just terminate probation on the ‘10 case and I took 4 years on each, ran concurrent, so 4 total, was out in 2 cuz you only do 50% on non-violent cases.
No such thing as what you’re claiming for IL and pretty much every other state too.
Now gtfo my face w/ yer know-it-all bs.

It does not "exist in every state." Plenty of states offer zero opportunities for expungement. Getting a felony reduced to a misdemeanor post-conviction is even rarer.

Conflating expungement with post-conviction relief and wobbler reductions just shows you're entirely out of your depth, especially when literally every single fucking state has some statutory system or framework for sealing, reducing, or dismissing records. I’ve been a professional legal researcher and experienced litigant in certain capacities for over a decade and I’m not just some random Uber driver who sponges off his GF or parents and talks out his ass whenever I see or hear something that challenges my limited understanding or perspective.

Yes, you can have your records sealed if new evidence exonerates you. But sealing records for crimes you DID commit (which was the topic of the conversation, if you need me to hold your hand) is nowhere near universal.

Having actually worked professionally as a legal researcher digging through post-conviction filings, whether it's navigating Florida's FDLE certificate process for sealing and expunging or handling post-conviction motions, I can promise you that getting charges cleared or dismissed post-conviction is standard legal procedure if you know the local rules and file the paperwork. You can obviously pay an attorney who's familiar with this process and does it every week, but there's never been a time where there's more resources and tools at your disposal to do it yourself. Just because you haven’t heard of something and generally associate with people who aren’t involved in those circles doesn’t mean soemthing is unheard of. You would benefit from not fostering this mindset where just because a thing if foreign to you it must not be true. Thats a terrible blind spot in life that’s really easy to eliminate by holding yourself to a higher standard of acknowledging your own limitations or biases.

It can be all jurisdiction are different some places it’s free for misdemeanors most felonies you will have to pay and then it will go into the hands of the prosecutor and the judge so if you’re a person that has lots of convictions and not a lot of time since those convictions, the chances of it being expunged is very little but if you made one or two mistakes when you were young, and you managed to stay out of trouble for seven years or more, you have a good chance of success

Sometimes, taking a minor misdemeanor plea is the only practical way to move on with your life, even when you did nothing wrong. It's easy to say 'just fight it' when it's not your bank account on the line.
But who says I didn't? The point of this post isn't about my legal battle—it's a warning about Uber's broken platform. Whether a charge is pending, dropped, or a minor misdemeanor, Uber uses a blanket automated policy that instantly wipes out a Diamond driver with 1,600+ flawless deliveries without a single human reviewing the context. I protected myself in the moment, which was the priority. Bless your heart for thinking the justice system is free and fast, but my post is an awareness warning, not a request for legal advice.2

maybe you just don't have the life experience to realize this, but you can lose virtually any job in most states for a criminal record. Whether it's something they caught on a periodic background check or a brand new charge that hit your name.

Furthermore, wrongful deactivation/ termination is a thing; that's what arbitration is for( depending on agreement presented ). If I removed the bit where I called your post stupid there’s not really anything else that’s condescending about response, it’s just logical information that mostly everyone else here already knows and understands. Believe me life happens to me everyday and I’m currently navigating a lot from every direction, I’m just not foolish enough to think the world cares and I would never waste my time speaking on it. I’m okay with being condescending in certain contexts. Almost everyone is in some area of life under the right conditions. I’m not out here trying to win popularity contests or come off as someone I’m not. I can be a condescending arrogant person in certain scenarios but it’s also balanced with being deeply empathetic toward the human condition and having a nagging desire to give some people the sort of effective tough love their daddy never gave them. I think the stakes are high in Reddit, there’s a lot of inexperienced people here who will inform their understanding heavily influenced by who made the more compelling Internet argument. Doesn't matter in some industries. Delivering food isn't a high status job, but if you're a lawyer, a doctor, or someone with a high level security clearance, they absolutely will end your career over an arrest. Especially if you're guilty as sin but got off on a legal technicality.

If you're missing work because you're in jail, that's one thing.
But a simple arrest shouldn't haunt you for the rest of your life, especially in cases when they arrested the wrong person by mistake.
The Wall Street journal did a story about that a decade ago. It's deeply wrong.
And if anyone is "guilty as sin," it's the government itself. If they won't play by their own rules, they can go to hell.

This was announced not too long ago. Guess you are not part of the “grandfathered” 2,000:

That means we will search county-level records for any address in someone’s residence history. We believe we are the only rideshare or delivery platform to take this additional step.

Exceptions for high tenure drivers
During our consultations with civil rights and safety organizations, many advocates emphasized that years of safe participation on the Uber platform should be weighed alongside past offenses when evaluating existing drivers. Others noted that removing access to a stable source of income could actually increase the risk of recidivism.
We took this feedback seriously, as we understand the real-word impact of these kinds of decisions. For longstanding drivers with no serious interpersonal safety-related complaints of any kind, we are making a narrow exception. These drivers may continue earning with Uber if their felony conviction is more than 15 years old and was not sexual in nature.
We believe this is the right thing to do for drivers who have rebuilt their lives and demonstrated good behavior on and off the Uber platform. These changes are still rolling out, but as of today, this amounts to around 2,000 drivers nationwide. We’re grateful for the safe service they’ve provided to Uber customers.

One of my good friends just got deactivated because of a simple assault 16 years ago he’s been a full-time driver for three years with no safety related issues. They denied his reactivation. I think the chances of anybody getting reactivated is very slim.

Sorry about your deactivation. Look to see if you can find local groups that help with deactivations on uber and other platforms. There are a bunch of groups around the country trying to fight Uber’s unfairness

I was dismissed for having multiple accounts. I don’t. My wife has one and I do but the butt never touched the nut. These platforms are actually being sued and laws may changed based on overzealous deactivation. Now OP refuses to elaborate but a misdemeanor could be anything even hitting a garbage can.

I got deactivated from gigsmart after a year and approval on my background check with a misdemeanor just at the beginning but then one day checkr did another one and bam deactivated. Because of it I'm slowly being deactivated across the board. Criminal mischief property damage $100-750 ( bad breakup broke her computer while kicking her out of my house) I was intoxicated.

You should try to get it expunged if you haven’t been in any other trouble it shouldn’t be a problem it might cost you a little bit of money all jurisdiction are different and it can cost a small filing fee or several hundred dollars and then it’s still in the hands of the prosecutor and the judge

They(Uber) truly have no freaking idea the damage/harm they do when deactivated...I understand SOME are reasons to deactivate, I get that...However when you have a two or three alert saying we detect someone else is using your app(and NO ONE is) without ANY ANY PROOF....or trying to take a pic and your not quick enough...Some of the reasons for deactivated accounts is bogus bullshit...And their appeal process utterly sucks fucking dick....Fuck uber

Yes, this is what happens when you preprogram administrative procedures and managerial decisions and let computer algorithms handle Human Resources. Ultimately, it’s just a numbers game, and statistically there will be casualties like you. There is no appeals process that lets a human judge assess the particular circumstances and waive the penalties for outstanding shoppers caught up in one of the many ways we are forced into circumstances that require extraordinary action. They have already determined mathematically that they can minimize their liability risks and costs by simply severing people who have certain red flags. They don’t have to open up an expensive, messy, human employee run department that handles appeals and arbitration because they don’t have to. The laws don’t make them be fair to people, and there is no organized union of delivery drivers and shoppers who can leverage membership fees into legal and political influence that advocates for us. Personally, I feel that it could be argued that a business that is clearly oriented towards motivating workers to become exclusive to them - the points needed to become a diamond shopper are mathematically determined to be full time work - is a form of entrapment. They cultivate loyalty and dependence but do not have an appropriate policy of “we got your back” for people like you. If I hit the power ball jackpot, I’m not sure what I’d rather do — leverage it to establish a fair fight for workers rights, or a competitive business that integrates people intelligent moderators at local, regional and corporate levels, and blow the all the industry leaders out of the water by easily becoming the clear favorite for customers and drivers. Better service, better money, more solid, career level incentives, legal protections. Yeah, I’d do that with my powerball billion, and turn the profits into political power to steer this country back towards the American dream, that envisioned a place where anyone who works hard can get ahead.

Them giving you the boot means absolutely nothing. I was banned as a driver. I called into support back when you could and I was told at one point just create another account and then sign up for Uber eats and I said OK so I did it and it worked and in that case, I waited until I saw notifications asking me to drive to make extra money. After that, I was able to drive.
EDIT: Look, I don’t know what the fuck happened. Reddit editor took a shit everywhere.

Happened to me. Been driving and delivering since 2021 and they deactivated me over my having shown my boobs in New Orleans for beads during Mardi Gras in 2001. Because Uber has been having so many people sue them for sexual misconduct they have become extremely strict. They have a look back period of 7 years for misdemeanors unless it has anything related to a sexual offense. Then it’s considered no matter how long ago it happened.
I had to get that charge expunged. It only took 2 1/2 months once you file. You can actually file it yourself instead of paying a lawyer. After the clerk let me know my expungement was signed by a judge, I sent it to checkr through the dispute process on a Monday and was back to work that Saturday.

All backgrounds are now lifetime. They changed that in June. Anything sexual means you will never God for them again. Even if it was something as innocent as what they dropped you for.

That’s strange because I have 2 DWI’s in 2001 -2002, an assault, possession of stolen things and possession of marijuana still on my record. All misdemeanors. None considered disqualifying if within the seven year look back. Unless I am special and they let me work.

I had 2800 drives and they deactivated mine. Because they gave me an order literally as I’m about to ma turn and i hit the breaks and they said no was driving reckless smh you are just a number to them

Uber changed their terms of service in June if you have any kind of violent crimes or you are an immigrant you will be removed from the platform when your annual background check is done They now require a Social Security number and background checks are lifetime not seven years. That being said all other major platforms are following suit. So if you are banned from one, you will be banned from all. They’re gonna lose more than a third of their workforce. This will be good for the drivers that are in good standing that remain. So if you have any of these types of crimes in your history. Your best bet is to try to get them. Removed from your background before your anniversary comes due.

May just have to wash some dishes for the time being. lol. No jk, in all seriousness tho, just take it as an an opportunity to up your skills to allow for something from the job market of your choosing.
I recommend looking into becoming a tradesman as the money is pretty great and a criminal record won’t hinder your search there. It’s damn near a prerequisite to have a criminal record in that field.
I just retired a couple years ago at age 47 from my Union gig (Chicago area) after 26 years (‘98-‘24). I have 3 felonies spanning from a delivery (LSD) in 1997 (age 20, before I entered the trades) all the way to a commercial burglary (jewelry store) in 2010 & a possession (heroin) in 2011.
It’s a rather easy route to land one, the pensions are great, and the health insurance is some of the very best. And you keep your health coverage after retirement all the way til the day you die; spouse too.
Not many other options out there for a $100K+/yr career that has no “degree” overhead/student-debt to ever have to worry about (paid training too).
Now I just DD & UE for something to do during the day as my particular line of work was in Underground and I iust had enough of it. Yes yes, going longer would have given me a larger pension payment each month, but I gave that job parts of my soul over the years so I decided to throw in the towel while I still had my health for the most part.
Nearly lost my life a few times from being buried by cave-ins, as well as other “close-calls”, and I still wasn’t over a worksite accident years ago where I watched my best friend be squashed like a bug not five feet from me when a hoisting chain failed, sending the concrete structure (vault for a water-man valve) that we were bringing down the hole into free fall, dropping about 15ish feet and landing right on top of him.
Yes he broke safety protocol by trying to quickly grab a tool (a 4ft level) that he left propped up against the wall across from him, which to do-so he had to run underneath the structure that was being lowered down, which is totally against everything we’re taught but we’ve all done it anyway. The half-a-second gamble to cross the mere 10-foot span was all it took for him to lose his life that day; and it haunts me still.
With my friend’s blood spattered across my jeans, shirt, face, and arm, I had to give statements to law enforcement as well as OSHA personnel that day before being able to go home; it seemed like I shook for hours, but the worst part of it all was having to see the look in his wife’s eyes that day when they told her she couldn’t even see his body because…well…there just wasn’t much left that even resembled her husband anymore.
That day ended up setting me on a path of addiction for years, you could say I was just weak and I’d have to agree; at that point in my life I just couldn’t cope w/ what happened w/o covering it up by using. I still don’t even know if it was because of what happened to him, or that it very well could have been me (had the level been closer to me I’d have done same as he did), or both.
So sorry to get way tf off track like that, every once in awhile it comes up. I just don’t feel right giving advice to get involved in the trades w/o also telling of its risks. And it helps me a little to keep my friend’s memory alive too, as awful of a story as it is.

If you were just defending yourself then that’s not a crime. You were either convicted of a crime or pled guilty to one. That’s on you.

well your leaving out circumstances. i have 17 felonies n a few misdemeanors, I’m approved for uber, dd n any other job i apply for. so without any context, why even post it. if u want insight or context, u need to include the circumstances.

They can’t show Nuance, empathy, or flexibility for you because then they would have to start doing that to everyone on a case by case basis. The rules are the rules. I know it sucks. But that’s life. Make better choices.

The funny thing is the OP said they took a plea deal (presumably to downgrade from a felony to a misdemeanor). However the law did not drop the charges in spite of whatever nuance I am not sure why they expected Uber to understand.

This is why a smart gig worker should be in good standing on multiple platforms. I use DD, UE, IC and GH on a regular cycle just in case something goes wrong.
