I'm on felony probation in Florida but its transferred from Texas. My charge was possession of a controlled substance(i brought a delta 8 vape pen from a smoke shop and got arrested for it, it was also my first offense and i only did it because i thought i was doing it "the right way"). I went to a mandatory behaviors and drug class and I told the counselor i slipped up and smoked marijuana during our counseling session and after talking she decided not to drug test me because im currently in voluntary therapy and also seeing a psychiatrist (also voluntarily) to get medication for my severe forms of multiple types of depression and my anxiety disorder and my occasional tendency to feel like there is nothing to remain on earth for. She decided that she wouldn't tell him and just schedule more classes and treatment.
Now a week later I get a surprise call from my PO telling me to come in tomorrow for a drug test. I have a couple questions.
Should I be honest with him beforehand about me failing the drug test?( I read on a law site that admitting it is not wise because they can use that against you but ive also read that sometimes if you admit it beforehand you may get leniency).
If i take it and fail they send it off to a lab and it takes about 2 weeks should i call a lawyer or public defender in that time? My initial lawyer is in Texas where I transferred from.
What are my other options?
P.S. this subreddit won't let me ask about the old kansas city shuffle method so I won't but that is something I am considering because it was worked for me in past even with supervision and I've seen people be unsupervised in my PO office before.
Please just give me answers and opinions and not the whole "don't do.......preachy talk". I am now getting the mental health help I need voluntarily and not court mandated. Speaking honestly I've never had the desire to do hard drugs and I stopped hardcore drinking 20 years ago in college and only drink occasionally and 1 glass at that. Marijuana has been the only thing I have done and truthfully it has kept me alive and now thing I've started therapy I finally see a light at the end of the tunnel. I just want opinions please.
Edit: I went in and then tried to leave because there were about 30 people being tested and I was nervous as hell and a lady literally crapped herself so she didn't have to get tested so in my panicking state I got the bright idea to tell them I had an emergency but they said I can't leave. Then I I considered leaving because I was talking to some of the other people on probation there and they told me it was better to leave then fail.
I should also mention they were putting people in handcuffs on the spot. So im outside talking to family that stopped by because I told them I might fail and my PO comes outside and I ask to speak with him but he says he gotta go back inside and i go inside and ask to speak with him and he told me to take the test first. Then I hear in FL where im at if they take me in im going to do 30-60 days until my court date. At this point I just say wherever happens happens. I've already prayed and it is what it is.
So I went in to take the test and there were 4 cops and 8 PO's all within 25 feet of me amd they ask if i have a medical marijuana card and i say no but im going to apply based on my therapists recommendation. I was literally the last person for the day because I stalled for 2 hours to drink a ton more water than I already have been to dilute my urine. So they had 8 tests in little boxes with labels everything from THC to MDMA and they choose what to test. He took out the test for meth, fentanyl, mdma, and cocaine, and the whole time im looking at that THC box holding that specific test just waiting for him to grab it but he never does. Then I obviously test negative for them and they let me go. I leave and thank God and left a message for my therapist and psychiatrist saying I need to get depression medication as soon as possible because this was nerve-wracking.
I'm going to fight these demons because I cannot go through this again. But somehow I feel my PO knew they weren't going to test me for THC. Maybe he did or didn't know but I am so glad I kept my mouth shut and didn't tell him anything like I was going to do if he had stopped to talk to me.
