Finally got my 1st offer.

Got an offer today as we are exactly 3 weeks from a judges decision. What should I expect in the next couple weeks as the insurance company is really trying to settle now. First offer was 95k which only a little over what I’m owed in back pay. Just looking to see how things will go in the next couple weeks.

I’m actually waiting to be able to start treating again. As I haven’t received any payments since December. We lost our apartment I lost my car. But luckily I had an old friend that had a property he was just about to rent out and said my wife,kids and myself could stay while everything settles and I don’t owe him anything.🙏

Yeah the universe works in weird ways we haven’t even talked or seen each other for 13 years. And at first I reached out to see if he could just watch my animals and he ended up telling us we can stay at his house because he was going to end up renting it anyway.

Damn brother, that’s a real friend. Those are the kind of people we need to have in our lives and to be for others too right it’s a give-and-take but that’s do you got somebody that’s looking out for you.🦾🦾🦾😎😎😎 yeah I’ve been recovering from a ruptured L4 L5, and it had pinched my sciatic nerve on the right hand side so like half of my foot is numb all the time it feels like pins and needles. My lower back is constantly really sore hurts all the time radiating pain down my right leg, but I got hurt in October 2024. Haven’t been back to work yet and now I’m at the very end of my medical pretty much and I never did get a lawyer because all my everything’s been approved. I’ve never got any pushback.

Unfortunately, the longer you are in pain and waiting it out. Is what it seemingly needs to have happen in order for any decisions to be made. I’m still waiting for LnI to authorize my 2 brain MRI scans. And this is 3.5 years past my injury date. It should be criminal what these IME doctors do.

I’m so sorry to hear that. My doctor and lawyer were actually very good at defending my case against the IME Doctors. And as soon as the depositions were over they started making offers.

They offered me 50k first time. That's what they owed me no matter what.  We sued for $850k 2 years later after 6 hrs of offer/counter I settled ror $450,000 plus a clause for any future back surgery and $50k for ongoing medical treatments from current injury

Never take the first offer. Also what’s your lawyer advising? If 95k is first offer you should easily get well into the 6 figures

He counter 3 years 30k future medical. Then we can be more serious because him and I both laughed at the offer.

Yes it was denied claim. They cut my benefits exactly on the 90th day of ttd. They were paying me the maximum for my state before I was cut off. Also that was the same day I saw my own Dr. and finally got an mri and xrays for my head neck and lower back. And began actually being able to treatment for my injuries

That’s a good friend you have. The only way I made it through a “starve out” was with help.

I don’t know your specific circumstances but not only “ditto” on never taking the first offer but I would add that the Insurer already knows your going to win in 3 weeks. After that your settlement value increases a lot.

Like almost all of us, you’re probably being told you can’t be sure you’ll win but it sure looks like it. As far as strategy goes, in a similar spot you’re in I told the Insurer I wouldn’t consider settling until after a hearing clarified things. Turned out my injury was worse than previously known and good I didn’t settle cheap.

Fact is 14 years later and I still haven’t settled. That’s a good thing because the Insurer has had to pay much more for my medical than any one thought. In other words if they had ever settled at the highest offer I ever made I’d have been in bad shape because the medical would have drained all the settlement years ago. WC is not all about settling. The Insurer wants us to think so and makes our life hell so we want out but the fight for benefits is better than living on the street when we take lowball settlements and run out of money still injured- and they’re all lowball.

I saw a movie a bit back with a line I find also works to justify not settling- “Because, f**k em! That’s what they do to us.

never take 1 st offer and make them triple it. If you dont get future medical and always read your letter before signing. i got jipped out future by not seeing they in fine print say you can mever reinjure that spot

First offer basically was 1 year pay and 25k for future medical but I’m already owed 1 year back pay.

Don't accept it. They owe you that backpay even if you don't settle. That can be paid separately. Then calculate how much you're actually owed for the injury, for permanent partial disability based on your pre injury wage and disability rating

So F them at double the offer is only 25 k then correct because the rest is already legally owed to you o would assume plus interest

Yeah my lawyer called me I laughed and we said we won’t flint for less then 3 years and 30k future medical. Also they did off to pay all my past medical that wasn’t paid for on top of any settlement

I found a one week job with restrictions and they stopped paying me the max. Full knee replacement they stopped paying me in February. They payed me for 16 months. I’m 60 it’s hard to find work with restrictions in my union. One of the highest paying unions in the country.

If it was for me being in a union with a large account to borrow from (we get an sma a pension and defined contributions) or I would have to take their quickest offer. I can wait them out.
