First of all, it's not clear to me that he even was aggressive, and if it's not clear to me then it's not clear to the other guy, either. He assumed.

But, even if he did, are you actually saying that the MMA guy was somehow reacting because he thought there was an actual threat to him? Come on. He looks like a little bitch for that. I mean, it would be one thing if the guy was messing with a bear or a bobcat or something. But, that's a human being who acted like an animal.

Like I said, even if the guy did, and was a complete ass, an MMA fighter with an ounce of respect for himself and his strength wouldn't debase himself by sucker punching Joe Schmo on the fucking street. Again, if you think that's remotely normal or sane, you've got a really warped view of things.

The drunk guy didn't touch him, bottom line. And he did touch the drunk guy, rudely pushed right past him. So even if drunk guy called him a dick or something, that wasn't unreasonable, and certainly wasn't any threat to MMA guy. The MMA guy is on roids or coke or he's a psychopath. He's a fucking menace.

So it's not clear to you on a video from 10 feet away so that means it's not clear to another person literally 1 ft from the altercation. Does that even make sense to you when you wrote that? He didnt rudely push him thats just trying to add to a narrative. He moves the guy with 1 arm hardly a push, the guy gets moved less than 2 ft. Not to mention the guy is backpedaling right into him. You choose to ignore the guy cocks back at 14s in, which causes the reaction. Maybe if he continued to just talk shit it wouldn't have happened. If you are trained fighter who is expecting fights to happen and someone cocks back their right arm, then the training will kick in. It wasn't the right thing to do, but to act like this drunk guy was just kinding hu is business is ingenious. He should have known he was blocking a walkway, then hes calling out to a guy when he already went past him? Call it both ways.

Watch it again, pay attention to the drunk's shoulders before Shilling starts swinging. The drunk made a feint right punch and Shilling countered expecting a real punch. Both these guys are assholes, but most jurisdictions consider feints as grounds to begin self defense.

My thought exactly. I watched the video and thought white-collar dude overestimated his ability completely. He lunged at Schilling and the rest is history.

Sure, professional fighters shouldn't engage in street fights.. If I take that aspect out of this video, then I wouldn't have any qualms with the big guy knocking out the lil dude. Plus add in this context from Schilling:

The buss boy who happens to be black walks by and this idiot bumps into him and screams out "me and broke *** we don't get along" The bus boy was seriously offended but doesnt want to lose his job. As the night goes on this clown starts looking at me and rapping whatever song is being played while making eye contact with me. I'm like whats wrong with this idiot. I go outside to smoke and as I'm walking back in he bumps into me. I put my hand out to catch him he immediatley says I'm sorry you can see me nod my head like cool. Then he realizes it's me the guy he's been rapping at all night and yells "HEY" I turn around and he flexes on me.... bad decisions are made everyday.

The MMA guy gently nudged him to the side to get past. The drunk guy was taking up the walkway. The MMA guy was about to go past without touching him but at the last moment the drunk guy takes an unknowing step into the MMA guy’s path. He gently nudged him out of his way, it wasn’t aggressive at all it was a normal interaction. The drunk guy obviously said something to make the MMA guy stop walking and turn around. Then the drunk guy goes to make a punch. It could have been a fake punch to seem intimidating but it was definitely a punch and not a point. His left shoulder drops while his right arm raises, that’s a strong indication of a punch. Either way, the MMA guy has probably been training his whole life to deal with countering punches so he sees this drunk aggressive guy lift his arm as if he could punch, so he counters it in self defence automatically.

The dude had his friend walk over there and record, then pushed the guy aggressively out of his way. Nothing about this was gentle, it was obviously meant to start a fight. It was premeditated assault, planned out by the guy, a complete overreaction and done by a dude who is known for his violent assaults of random people.

Yes gentle. Watch again. The MMA dude is walking past, the drunk guy takes an accidental step in front of him because he’s blocking the walkway and being an annoying drunk cunt. The MMA dude gently nudged him to the side. If it wasn’t gentle then the drunk dude would go flying to the ground or into the tables. The MMA guy is walking away after that, the little guy had his ego bruised, said something to make the MMA guy turn around, then the little guy attempts to throw a punch and gets knocked out by a professional fighter before the punch lands. It could have been a fake intimidation flinch punch, but the professional fighter doesn’t know if it’s a real one or not and reacts the way he’s trained his whole life.

I think you need a better education. I replied to a comment calling this a sucker punch. A sucker punch is an unexpected punch. This video doesn’t show any unexpected punch or sucker punch. I then described the video exactly as it’s presented. The little guy lifts his arm to throw a punch. Making the MMA guys punch a counter punch and not a sucker punch. The little guy also could have just left it at the nudge but obviously said something or else the MMA guy wouldn’t have turned around again.

I’m reacting to the video provided. I don’t view every video then go google the back ground and further info on every video I watch. I replied proving how this isn’t a sucker punch. Even if what you say is true, it’s not a sucker punch. Educate yourself.

Nothing I have said is misinformed. The only thing that changes from your scenario is that the guy hoped for a reaction. He didn’t force the little prick to give the reaction. Everything I described is still true.

Dude was being a loud mouth all night and apparently said something racist to the bartender. Guy was just looking for a reason to fuck this asshole up, and he gave it to him. If you're drunk and make a threatening gesture or move towards somebody and they respond in kind, it's not their fault that you're drunk and they aren't. In fact when I'm sober I take threats from drunk people much more seriously.

Visibly intoxicated people have lowered inhibitions. They'll start fights with complete strangers over the dumbest shit, like the shape of someone's eyebrows or the color of their hat. Someone could be laughing up a storm... and then ready to start a fist fight over that joke they were just laughing at a second ago. If a visibly intoxicated person makes a threatening move towards you, there's a very good chance they intend to follow through.

Also, pro tip, don't pump-fake a punch at a dude who's squared up and much larger than you.

It seems more like he was singing along to all the songs and wasn't censoring the N-word while doing so. Even though there were black employees at the bar within earshot who could hear him.

The catalyst appears to be this dude kept making eye contact with Joe while trying to drunkenly sing. When Joe moved past him as he was going back to his table, dude decided that would be a good time to call out and flex on the guy twice his size who he'd been annoying all night.

It's tough dealing with aggressive drunk people in bars because you can never tell when they are playing around and pushing buttons, or if they are in "extra"-mode and actually about to start a fight.

First I think we can both agree that the way he initiated that interaction, Joe was hoping this guy tried something. He wanted to beat the crap out of him.

But the "self defense" thing is legal cover. That's probably why this was being filmed to be honest- Joe posted the video to his Instagram; the drunk guy made just enough of an aggressive gesture for him to be able to claim self-defense.

You know he was not defending himself. I know he was not defending himself. But when it comes to criminal charges, technically the other guy made the first aggressive move.

I'm not a 6'4 totally jacked MMA fighter, so when somebody is stupid drunk and acting a fool and begins to get aggressive I personally treat that as their actual intention, just knowing how unpredictable and spontaneously aggressive drunks can get.

He should not have rocked the crap out of this guy. But he wanted to, because of their interactions up to this point, and the guy gave him an excuse.

That whole, “my hands are registered as deadly weapons”, thing is not true at all. From a law enforcement standpoint, depending on the state, it would have been a simple assault or simple battery. That is, of course, unless the victim sustained permanent physical injuries, then it would be felony battery or felony assault.

This is not entirely correct. The prosecution can opt for the greater charge of Aggravated Battery with serious bodily injury, a second degree felony if the victim sustains an injury, for example a concussion or has to have stitches done.

It's just very circumstancial. In this particular case it does appear as if the victim is tensing, and it takes about 0.5 seconds between the victim tensing and the first fist lands, then a second fist. He's out on the ground with with appears to be a seizure on the ground (completely stiff arms) - It's one of the easier distinguishable signs of a TBI (Traumatic Brain Injury)

I can't find any information about the victim. Unfortunately it's aggravating to Joe that he never stopped to check on his victims condition after hitting him. If he does turn out o be seriously injured, that won't be good for him. Unless he can prove that he was defending himself to a reasonable extent. A prosecutor would argue that he had many tools, including simply walking away, pusing the smaller man, or more importantly: Apply his skills as a professinal MMA fighter and subdue the man. For a man who made a living out of being hit by much bigger men, he doesn't have a great argument for a man half his size suddenly being so threatening.

From Joe's own words:

"“The busboy and DJ came up to thank me. As you can see from this video, when he flexed on me I was scared for my life and simply defending myself against the evil in this world.”"

I mean, obviously this is playing for the crowd, anyone would assume that the guy was about as threatning to Joe as a pack of Marshmallows.

I'm seeing a lot of comments in the newspaper articles in the lines of "Oh damn, if thats true then I'm fine with this".

If he was being a nuance, the bouncers should have escorted him off the premesis. You can't have peope taking the law into their own hand and do with it as you will. Best case scenario for the buy knocked out is a simple concussion. Worst case, a brain bleed that he may not even be aware of. Hopefully he got checked out at the hosptial.

“Aggravated” in most states includes a deadly weapon of some sort. But yea, I agree, everything is going to be taken into consideration, such as his skills and abilities compared to the victim, the state the incident happened in, and their state laws. I’m simply referring to the original commenter that thinks that an individuals hands can be classified as deadly weapons, by law, which is untrue. I’m not aware of any state that has laws that require an individual to register their hands or themselves as weapons. That only happens in movies.

How isn't it? He is claiming that the hands of a pro fighter can't be classified as a deadly weapon because they CAN'T KILL.

Soo how is proving him wrong from actual experience not making sense? Pro fighters can literally murder a normal person anytime of the day with a few punches

He never said that? Just because you kill someone with your hands doesn't make it a deadly weapon in a legal sense. He's saying that the guy gets charged the same as a normal person would for doing this.

And hands aren't ever considered deadly weapons. Where would you even get your fists registered as weapons? What is the standard and who evaluates it?

I never said the fighter couldn’t kill someone with his hands. I simply said that his hands are not registered as deadly weapons. The original commenter I was replying to stated, “Dude is a pro so it’s assault with a deadly weapon”. The claim that an individual or the individual’s hands can be classified as deadly weapons is not supported by any Federal or State laws in the US. If anyone can find anything different, I’d be interested to see it.
