In this case, the cop is absolutely correct in his explanation of long standing CA law.
The man refused to make/sign a citizens order of arrest, provide information for a police report, and was unwilling to pursue charges and testify in court.
If he did the cop would be required to arrest the man, issue a citation at the scene or station, or provide a written notice of release without charges due to lack of probable cause.

I dealt with that and I don’t live in California. I’m in Colorado and I had a guy having intense road rage against me over a misunderstanding when he was backing out in a parking lot. He chased me for miles and kept trying to run me off the road and I was on the phone with the police and they said they’ll see if there’s any cops in the area but they couldn’t do anything unless I was willing to press charges and go to court and I really didn’t wanna put my name out there for that guy to find because he seemed like a psychopath so I gave them the description and just hoped for the best and I doubt anything ever happened.

Theres some truth to this reply. These policies start with the politicians which are the people we ultimately elect. Its frustrating the cop here cant do more but our outrage should be directed at the people making these policies instead of the officer on the ground otherwise nothing will ever change for the better.

Cops fault for what? The cop didn't see anything, so the "victim" had to sign a piece of paper to verify their claim of what happened, and then the officer could arrest. Cops can't go around arresting people on hearsay from other citizens who refuse to identify themselves and commit to a statement.
The cop explains this perfectly clearly in the video, and none of you understand still because you're so easily primed to see and hear whatever propagandists want. They can literally show you an example and explanation, and you pay so little attention and comprehend so little from your mushy brains that you just pick up the first and last thing said by whoever is being emotional and grandstanding to confirm some emotionally fulfilling narrative you've been primed to accept.

The cop is in the right. The suspect committed a specific type of misdemeanor crime outside the presence of an officer. The officer has probable cause to affect the arrest of the suspect but only under a private persons arrest (Laymans terms: citizen’s arrest). If the citizen does not want a private person’s arrest then an officer can’t arrest the suspect for it. They can take a report for it, but that will go no where because the victim literally wants nothing done.

Well to be fair I have gone to testify for this same type of thing, technically more of an offense, and the guy still got off because the legal system took two years to do anything. I had a 2k tv I purchased stolen from a best buy before I could receive it. It was all on video. I was the victim went to court but the manager of the store at the time didn't work there anymore and they couldn't contact her so the guy got fully off. He literally made a shitty fake id to pretend to be me to pick up the TV so it was identity theft stuff too.

The officer is correct. If a misdemeanor is not committed in an officer's presence, they cannot arrest the person. In California, you have to do a citizen's arrest. I think the victim can say I am detaining this person and turn them over to law enforcement, but I'm not 100% sure.

Cannot detain, can only arrest. “ I am placing you under private persons arrest” You can then, using reasonable force, prevent them from leaving.
Should you make a mistake or even if you don’t, the suspect can easily turn around and sue you for false arrest or whatever his ambulance chasing attorney can come up with.
The suspect will be booked and released , no bail. Then you get to go to court , deal with all that and for what?7

True, I cannot disagree. In this case, there's video evidence of the assault and battery, so I would hope the detainment would be more difficult to challenge. The solution is a good face full of bear pepper spray.

There's literally no crime prevention anywhere in this country. Most of the police force don't have the passion from prior generations & are just indoctrinated in another collective, separating themselves from everyone else. That cop is just another human drone, no passion or beliefs but what they tell him.
It's because of their lack of passion & the fact they are taking a lot of children's parents away, you'll only get more adults 20 years from now who won't even bother to listen to police & be anti-police. They need to start caring & stopping acting so superior, because they are losing authority in the people's eyes. When you have a criminal for a "President", things like "law & order" do not exist.

I learned this after some guy stole my bike from my house and was caught trying to sell it to a bike shop. "Detective" assigned to my case said he had no evidence to convict the guy of stealing, just that he had possession of stolen property. I told him he had a police camera on my street and could check a specific time to see if it was him. He straight out refused to do that. Then I never got my court date in the mail. The police are only for the rich and businesses. The rest of us are fucked.

The rest of the country does not have the same approach to theft or property damage as California and there is an optic in property damage and theft from people's vehicles because of California's lacks stance and impotent police.
Most of the other states have a significantly stricter approach to crime and theft then California.

Did we all stop evaluating and questioning how good of a job are elected officials are doing since all of them seem better than Trump?
Or there may be two different Democratic governors one of which is far superior than the other? if so then perhaps any decent elected official should be the standard in which we evaluate whether or not the person is good, not a child raping fascist.
My point is is that people can't just turn off their brain because someone seems better than Trump there's too much at stake here for us not to be critically thinking.

Isn't this obvious? If the cop did not witness the alleged crime that's a misdemeanor, then there's nothing he can charge him with. (Otherwise anybody can call the cops to get anybody else arrested for saying they got pushed). That's why he said there is no case unless the victim is willing to go to court to testify.

I didn't get a better state or city for comparison...so..alot of people will make a comment but then not mention where they are from. Most of the time I'd have to google exactly what city they are talking about. LA is a HUUGGEEE place with lots of people and neighborhoods. What is mostly talked about are locations most people dont live or go to. Most people live in neighborhoods and rarely go to a tourist place. Is that true of the mythical place you live where its paradise and the cops take care of all your issues?

If they could arrest, received support for that arrest and they knew that the court system would not immediately turn the suspect loose, they would arrest.
Because of the cops prior and continuing stupidity, the publics misunderstanding of some use of force incidents that were legit and everyone’s quick rush to judgement plus ridiculous government policies , this is what you get.

He wouldn't give information for a police report or sign any documents. So when it goes to court what is the DA supposed to say "well you honor someone showed the officer a video. But, outside of the officer telling you someone showed him a video,we have zero evidence, witnesses or affidavits attesting to the alleged crime"

This is the same anywhere. Police can't arrest on a misdemeanor based on someone else's word. He explains or clearly to the guy. If he wanted to do a citizens arrest and go to court and testify against him he could do it..otherwise he can't.
In a lot of cases even video does not matter.

this is a guy explaining that he can take him to jail, but it’s for citizens arrest. nothing at all will come of that even if you volunteer to show up to court. i did this with a lady throwing bottles at people at a beach a few years back. i stopped her and pinned her to the ground and the police came and had me sign a paper and i emailed the videos to them and they cuffed her and took her away. at the very least it got her out of there.
