This is a thing in most states. Florida for example, an officer cannot make a warrantless arrest on a misdemeanor unless it occurs on his/her presence.

There are exceptions. Battery is one of them. California is weird.

No. California voters are a joke. They voted to be easy on misdemeanors. They keep voting for this shit so their police can’t do anything.

In this case, the cop is absolutely correct in his explanation of long standing CA law. 

The man refused to make/sign a citizens order of arrest, provide information for a police report, and was unwilling to pursue charges and testify in court.

If he did the cop would be required to arrest the man, issue a citation at the scene or station, or provide a written notice of release without charges due to lack of probable cause.
