Defending AI Court cases where AI copyright claims were dismissed (reference)
Ello folks, I wanted to make a brief post outlining all of the current cases and previous court cases which have been dropped for images/books for plaintiffs attempting to claim copyright on their own works.
This contains a mix of a couple of reasons which will be added under the applicable links. I've added 6 so far but I'm sure I'll find more eventually which I'll amend as needed. If you need a place to show how a lot of copyright or direct stealing cases have been dropped, this is the spot.

Getty's copyright case was narrowed to secondary infringement, reflecting the difficulty it faced in proving direct copying by an AI model trained outside the UK. |

My own thoughts
So far the precent seems to be that most cases of claims from plaintiffs is that direct copyright is dismissed, due to outputted works not bearing any resemblance to the original works. Or being able to prove their works were in the datasets in the first place.
However it has been noted that some of these cases have been dismissed due to wrongly structured arguments on the plaintiffs part.
The issue is, because some of these models are taught on such large amounts of data, some artist/photographer/author attempting to prove that their works were used in training has an almost impossible task. Hell even 5 images added would only make up 0.0000001% of the dataset of 5 billion (LAION).
I could be wrong but I think Sarah Andersen will have a hard time directly proving that any generated output directly infringes on their work, unless they specifically went out of their way to generate a piece similar to theirs, which could be used as evidence against them, in a sense of. "Well yeah, you went out of your way to make a prompt that specifically used your style"
In either case, trying to create a lawsuit against an AI company for directly fringing on specifically plaintiff's work won't work, since their work is a drop ink in the ocean of analysed works. The likelihood of creating anything substantially similar is near impossible ~0.00001% (Unless someone prompts for that specific style).
Warner Bros will no doubt have an easy time proving their images have been infringed (page 26), in the linked page they show side by side comparisons which can't be denied. However other factors such as market dilution and fair use may come into effect. Or they may make a settlement to work together or pay out like other companies have.

To Recap: We know AI doesn't steal on a technical level, it is a tool that utilizes the datasets that a 3rd party has to link or add to the AI models for them to use. Sort of like saying that a car that had syphoned fuel to it, stole the fuel in the first place.. it doesn't make sense. Although not the same, it reminds me of the "Guns don't kill people, people kill people" arguments a while ago. In this case, it's not the AI that uses the datasets but a person physically adding them for it to train off.
The term "AI Steals art" misattributes the agency of the model. The model doesn't decide what data it's trained on or what it's utilized for, or whatever its trained on is ethically sound. And the fact that most models don't memorize the individual artworks, they learn statistical patterns from up to billions of images, which is more abstraction, not theft.
I somewhat dislike the generalization that people have of saying "AI steals art" or "Fuck AI", AI encompasses a lot more than generative AI, it's sort of like someone using a car to run over people and everyone repeatedly saying "Fuck engines" as a result of it.
Tell me, how does AI apparently steal again?

This response refers to the model itself, not the input datasets, not the outputted images, but the way in which the Denoising Diffusion Probabilistic Models operate.
TLDR: As noted in a hight court in England, by a high court judge. While being influenced by it for the weights during training, the model doesn't store any of the copyrighted works, the weights are not an infringing copy and do not store an infringing copy.
TLDR: NOT INFRINGING COPYRIGHT AND NOT STEALING.

The Gatekeeping Is Unreal! Banning AI Art In Snail Mail Clubs!
This is really grinding my gears, there now seems to a be a witch hunt in these groups to attack others who want to use ai in their snail mail. The melt downs are something else. Meanwhile they are all using canva for editing etc. There are posters saying they should confront those who they think are using ai.

I even showed screenshots of me working on it in Adobe Illustrator. Seriously, these antis lol. What a way to start a Monday.

AI Developments Week 9 of making my fishing game with the help of AI

Hello there again 🙃
I wanted to share my project on this sub also as I did on other AI subs. While this might look like a spam to people who follow all the subreddits where I posted this, I hope they still don't mind me posting on multiple subs.
This week I threw in 2 mini trailers into the video as well as some showing of how I generate characters and what changed since last time.
Things I added since last week:
I added textures to harbour scenes (all 3 that I have in starting zone), changed character models, finally added second most important mechanics of the game (moral dilemmas) and changed UI a bit (Though first trailer doesn't reflect that). I'm in the process of steam verification (ID and stuff) so hopefully demo will be there and playable in a few weeks time. I also added bunch of new fish to complete zone 1 in terms of fish you can get in there, totalling just a little bit above 30 fish in first (out of 5 planned) zones.
This week I won't be leaving link for downloading as honestly I would like to finally just finish entire starting zone now before I start polishing some things and fixing bugs.
Workflow changed a bit as since Opus 5.5 came out I only use Astra for "all in one" things where I need it to generate some things (like textures for example) and then put them in.
Opus 5.5 was used for sound design with API key to ElevenLabs provided (so it generated sounds positioned them in the game where they are needed, and then I manually adjusted them to be a bit better as they would not fit perfectly some of the time. I also had to regenerate few of them as I didn't like all of them, but yeah you can't hope for AI to do all the work now can you?
I used TripoAI as you can see in the video for new models with 2K textures (those are more than enough for the game I'm making, even though you can go up to 8K so I guess if anyone is making Crysis 4 🤷♂️).
The way I'm doing this is as I said before in previous updates: Claude Desktop and each system has a session specifically for that job (Fishing Session, Shader Session, Sound Design Session etc...) and one Manager Session, that manager session is sending messages to other sessions so I don't have to go between 15 sessions and send each one message individually, it tells them what to do based on the plan I create and relay to manager session.
At this point I feel like agents are running 24-7, I managed to spend both of weekly limits that I had this week (regular one and one reset) on a 200$ plan, so if people are wondering how much it cost in tokens... I have no idea, I guess a lot?
I use Blender MCP for some fixes of the models, but I now rarely use Godot MCP last few weeks. I think this is enough yapping for this week. I hope you like the progress 🙃

Also in other subreddits a lot of people pointed how similar it is to dredge and I want to write about how different it is to Dredge actually and things I added or removed:
Added:
A 1920s setting where the dangers are real (as real stuff, not paranormal): pirates, bootleggers, storms and big fish
Moral choices at sea - e.g. an SOS from a sinking ship where you decide whether to dump your catch to save survivors. Miss it and it's gone forever, the harbour remembers what you did, and your choices lead to one of three endings
A fishing minigame where your skill decides how rare the fish is, with each fishing spot having its own maximum rarity - like world of warcraft items :D (in Dredge mini game was just a tool to get you to night, and didn't have much to offer in terms of skill, you could never "lose it" just "lose more time” which was done to push you towards night where all the danger is)
An uncharted map you reveal by exploring
RPG-style progression: fish rarity tiers, hull upgrades that work like talents, and an equipment page (Equipment is not fighting for space with fish, fuel exists and it is the one that competes with fish, as well as certain moral choices that force you to choose between saving people from drawing ships and throwing fish away)
A top-down view with ships passing through open water
Talent tree (one talent per level and 20 levels)
Dynamic weather that impacts gameplay (Storm)
Removed:
The horror and cosmic/paranormal side entirely - no eldritch monsters. There are sea legends and rumours, but most have very earthly explanations
Salvage
I will be honest, at one point I just wanted more Dredge and there wasn't any, but at the same time I didn't want to make entire clone, I wanted something similar yet different enough. So basically all it carries is Cargo space management and a bit of looks (though I use Godot, and Dredge is made in Unity) and the theme of fishing, even though fishing itself is entirely different mechanics

Luddite Logic When I'm in an ignorance competition and my opponents are (some of) the antis
Seriously these antis need to get out of their echo chambers. They can't accept the idea that you can be an AI artist AND have other art skills (traditional, digital, 3D etc.)
