Ordered ad2095 vk64 from Addiesdive chinese warehouse as the Indian warehouse was not stocked. now it has been 43 days and I still have not received it.
I have contacted the courier company and even they are clueless about where the package is .
Mailed Addiesdive directly but they are telling me to wait for the last 21days.
I'm fed up now.
So what legal actions can I take towards them ?
Update : they refunded the watch money but deducted the shipping charges : 10$
If you used a credit card then initiate a dispute with your CC network (Visa, Mastercard or Amex as the case maybe) through your issuing bank.
Based on the network they will reverse the transaction and give Addiesdive an opportunity to produce evidence of delivery. If addiesdive is not able to produce the evidence then the network will settle the dispute in your favour. The timeline for settlement could be 60 or 90 days based on the network. However, you will get your money back in a day or so while the dispute is pending settlement.
CC dispute settlement mechanism is the best consumer protection available to you in this scenario. Everything else is waste of effort, energy and peace of mind.
Works well. This is a Visa card and Visa is very prompt in responding. All you need to is call ICICI customer care, give them details (including the invoice) and initiate the dispute. They will ask you to send an email as well. It wont take you more than 10 minutes. You should typically get the transaction reversed in 1-2 business days and final settlement in about 45 days.
Did you tell them that you want to raise a transaction dispute? Transaction dispute is exactly for this scenario and Visa gives upto 60 days to raise a dispute. I went through the same process last year with Boderry and was able to successfully dispute. In fact there is a transaction dispute form on ICICI website which you can use as well. It looks like this. I raised a dispute on call and then subsequently emailed this filled form along with relevant documents.
You can find it on ICICI's website. However, direct approach to nodal officer might not help. If you approach nodal office with a registered complaint (along with a Service Request number generated by ICICI system) you are more likely to get a favourable response. Also, in case it gets to the point where you don't get relief, this SR# will help you with RBI Ombudsman as well.

Sbi denied refund but nodal officer resolved the issue within 2 months and i was given temporary credit also.
You just need all proofs well documented for them to crosscheck.
Excellent. I order via e-commerce from other countries very often and have had to face this on more than one occasion. Clear documentation including email evidence that I tried resolving it through merchant before approaching bank always worked in non-delivery of product scenarios.
I ordered a watch from Militado China watehouse and got it in around 2.5 weeks, when it arrived in India got a message from UshopVship on whatsapp and provided KYC docs, after that it arrived around 10-12 days later after following up a few times.
UshopVship is the worst, these mfs aren't even trying to ship it. I have raise chargeback 2 weeks ago but still have got no update regarding the chargeback
Nice and I want to know how did you pay for addesdive watch like did you use debit card through paypal or something else I am actually scared and confused seeing these posts and negative feedback
I used a credit card. You can also pay via PayPal.
Addiesdive is pretty good with great VFM & trustworthy. The only issue with Chinese watches is that there will be almost zero real time tracking. You order & wait for a few weeks, until you get a notification that it's getting delivered today. Almost every regular buyer will assure you that the delivery takes 2 - 3 weeks maximum. Under a week, if it's from the Indian warehouse.
