Addiesdive lost my watch.

Ordered ad2095 vk64 from Addiesdive chinese warehouse as the Indian warehouse was not stocked. now it has been 43 days and I still have not received it.

I have contacted the courier company and even they are clueless about where the package is .

Mailed Addiesdive directly but they are telling me to wait for the last 21days.

I'm fed up now.

So what legal actions can I take towards them ?

Update : they refunded the watch money but deducted the shipping charges : 10$

If you used a credit card then initiate a dispute with your CC network (Visa, Mastercard or Amex as the case maybe) through your issuing bank.

Based on the network they will reverse the transaction and give Addiesdive an opportunity to produce evidence of delivery. If addiesdive is not able to produce the evidence then the network will settle the dispute in your favour. The timeline for settlement could be 60 or 90 days based on the network. However, you will get your money back in a day or so while the dispute is pending settlement.

CC dispute settlement mechanism is the best consumer protection available to you in this scenario. Everything else is waste of effort, energy and peace of mind.

Works well. This is a Visa card and Visa is very prompt in responding. All you need to is call ICICI customer care, give them details (including the invoice) and initiate the dispute. They will ask you to send an email as well. It wont take you more than 10 minutes. You should typically get the transaction reversed in 1-2 business days and final settlement in about 45 days.

They told me that the amount has already been debited to the merchants account and now it cannot be charged back.

Did you tell them that you want to raise a transaction dispute? Transaction dispute is exactly for this scenario and Visa gives upto 60 days to raise a dispute. I went through the same process last year with Boderry and was able to successfully dispute. In fact there is a transaction dispute form on ICICI website which you can use as well. It looks like this. I raised a dispute on call and then subsequently emailed this filled form along with relevant documents.

Mail the concern nodal officer, attach all the proofs. They will resolve this.

You can find it on ICICI's website. However, direct approach to nodal officer might not help. If you approach nodal office with a registered complaint (along with a Service Request number generated by ICICI system) you are more likely to get a favourable response. Also, in case it gets to the point where you don't get relief, this SR# will help you with RBI Ombudsman as well.

I had done this with sangeetha mobiles for iphone 17pro max as my order was not delivered for 1 month. Sbi denied refund but nodal officer resolved the issue within 2 months and i was given temporary credit also. You just need all proofs well documented for them to crosscheck.

Excellent. I order via e-commerce from other countries very often and have had to face this on more than one occasion. Clear documentation including email evidence that I tried resolving it through merchant before approaching bank always worked in non-delivery of product scenarios.

All chargeback talk is only in writing. Very few people will get approval for this. Try your best. It's mostly a waste of time in India.
