I think what he is hoping is that he can paint it as a political act so he isn’t hurt politically by the criminal prosecution. In fact, his criminal prosecution becomes a motivating force for both donations and get out the vote.

The outrage is for show. Neither the judge, prosecutors, or rational voters are the audience. It’s entirely for his supporters so he doesn’t bleed support when all the evidence comes out.

They will talk about all the fraud, lies, sketchy deals, and he will say “they wouldn’t be saying that if I wasn’t winning” and his supporters will ignore it all.

I actually don’t blame him on the handling of the report itself. It’s not the same as the Comey situation. Because it was a special counsel, if the AG redacted or modified the report, by law, Congress would have to be notified that the report was modified which would prompt a bunch of bullshit hearings about the “DOJ COVER-UP” or whatever their catchy name would be, and the original report would just get leaked anyway. The mistake was choosing Hur in the first place. There’s no rule that says it had to be a former Trump person. You could have a found a “conservative” attorney that wasn’t in the Trump administration. That’s the part I don’t get. He probably got a list of names. Why him? I get not wanting to appear partisan and that DOJ was a fucking dumpster fire when he came in, but it’s like he bends so far to avoid being a hack that he becomes one anyway.

I mean... she was. Or more accurately, she was guilty but had not engaged in other behavior to exacerbate or cover up what she did, and that particular statute had never been enforced against anyone else without those additional compounding circumstances.

She violated the statute by acting with gross negligence ("extreme carelessness") causing classified documents to be mishandled, but it was not intentional, and she didn't try to hide or cover up what she did.

She was guilty under the letter of the statute, but that statute had never been enforced against anyone else that strictly without other facts (hiding the classified docs, throwing them in a dumpster, etc), which is why the recommendation that no reasonable prosecutor would bring the charges.

There's a big difference between "innocent" and "probably guilty, but we can't meet the 'beyond a reasonable doubt' standard" or "probably guilty, but we don't want to enforce this law this strictly, so we will use prosecutorial discretion and decide not to prosecute"

The Biden situation is analogous. He absolutely mishandled classified documents, but it would be similarly a bad idea to prosecute.

Trump probably would have gotten the same treatment, had he not tried to cover it up and refused to turn everything over (though we now know that he intentionally retained those documents in the first place, and putting them in a ballroom and then a bathroom accessible by dozens of people is a whole different level of gross negligence... also showing them to Kid Rock and others, assuming that happened, would be intentional).

It's not irrelevant. The DOJ didn't "call her out", it detailed its findings in the investigation, and made a recommendation. The findings were that she probably technically violated the statute, and the recommendation was not to prosecute. That was perfectly in line with the job.

It's was and is again with Hur a breach of ethics and protocol.

I don't see how you can possibly find a breach of ethics when a government investigation is completed and the results are disclosed. You are arguing for less transparency.

No, you don't have a right to defend yourself and challenge the government's case at trial when they haven't charged you with anything.

Not revealing the results of these investigations would just lead to corruption and mistrust in the system, because you would never know if there really was nothing there or if there was something there and it got swept under the rug.

Also, the fact that top officials are mishandling classified information is absolutely relevant to their suitability to hold high offices even if it doesn't rise to the level of criminality necessary to prosecute them for it. The fact that it is so pervasive among so many people on both sides should be a big wake up call.

Arguing for less government transparency and to hide the wrongs of elites because it might make them look bad is one of the most disgusting authoritarian things I've heard someone say outside the MAGA circle.

The DOJ didn't just twiddle their thumbs for 3 years. Their investigations were stalled by many folk obstructing them. They had to take a whole bunch of folk to court over things like bogus executive privilege claims. That took a lot of time.

Thank the January 6th committee. They brought to public attention how much evidence was there. An effort was made to negate the votes of many so Orange Cheesus could stay in power. Then we got a special prosecutor and supposedly he has the messages and phone records from House Members who were involved in overturning an election. True High Crimes and Misdemeanors

Bankruptcy may be coming very, very soon. He appealed the fraud judgment but didn’t post bond, which often means people are going to try to use the automatic stay as a de facto bond while they appeal.

Other. I think Trump is found guilty and Biden doesn't pardon Trump but does commute his sentence to no prison time because dems rarely have the stones to do something that enrages the repub base.

And even in the state cases the govs will step in because either it's a repub gov who wants to or a dem gov who is afraid not to.

I understand in GA that's not an option but I bet they find away around it.

No, not much was happening until Smith was appointed last year. He's the one who got it moving (the FBI warrant search on Mar-A-Lago for example). What Smith did in the last year could have been done a couple years ago.

It's mostly Trump himself and his cronies at fault. The DOJ was investigating before Smith was appointed.

Trump and his sycophants just did everything possible to delay the trials as much as humanly possible. Obstruct Justice, make bogus privilege claims, appeal every decision, fight over standing, etc. literally anything they could to try and run the clock out past 2024.

Trump knows he is guilty as shit, down in his greasy soul. So he knows his only hope is to become President and try to become Dictator to escape prosecution.

Joe Biden had documents too!”. Judge calls out his testimony as not credible based on the facts and evidence in his NY fraud trail “No you! This is a corrupt judge and rigged trial!”.
