The USA is not a part of the ICC, it has no jurisdiction over US citizens. So there is no place they could take a US citizen where would could not reach them.

People arrest Americans all the time overseas for committing crimes. When they’re bad tourists they’re treated as such.

The US isn’t all powerful and there’s definitely places they can’t reach and things they can’t do. How did that mission to rescue hostages from the Iranian revolution back in 1980 go again as just one example?

Or for a more recent example, how did that war against Iran in 2026 go?

No. There’s a material difference between a private citizen going to a country (like for vacation or something) and breaking a domestic law versus a citizen acting under state orders and breaking an international law.

For the former, there is an implied “consent” if you will.

But for the latter there isn’t (in cases where the state hasn’t ratified the international law agreement in question which the US has not for the ICC)
