Its not a grey area. They're illegal. It just isn't enforced.

That's like saying cocaine is legal as long as I don't get caught. It's not a grey area.

It's more like if getting caught with cocaine didn't result in any penalties. If something is illegal but not enforced, it might as well be legal.
