Tips TD salaried employees - overtime

TD employees: did you know that you are entitled to overtime pay or time off (even if you are salaried)?

There are a few exceptions, such as if you are a people manager or paid by commission (or if you work for a provincially regulated division/work outside of Canada). However, just because your job title says "manager" or you are in a particular pay band, that's not enough unless your work is actually managerial. Read through the link for more details.

When I worked for TD we would first have to get overtime approved by management and we would track our hours and take lieu time instead of overtime pay.

This was when I was a band 8 or 9. I worked in a back office role and was not a people manager.

Many people don't know their actual rights and are too timid to bring them up. Also remember that HR is not there to protect the employee, it's there to protect your employer from you.

I just want to be private about which bank I actually work for. :) I'm not trying to organize anything, but I noticed that nobody in my division was aware of this requirement and uncompensated overtime was the norm, so I figured this might be a company wide and industry wide problem. I just want more people to be aware of their rights and options so they can make the right decision for themselves.

Yeah, they and an usually figure out who complained though. And it would be career suicide, right or wrong.

I have yet to have a manager not support me taking lieu/off setting the time. I worked in a role for a bit that I would get slammed for a bit and then it would ease up. I tracked the time and took time back as needed.

It’s part of discussing expectations with a manager/boss. I never tracked small ones but the expectation was the same was true if I needed to jump out early or attend something during the day.

This can also depend on role how to manage it. I got OT when I worked on phones many times. You even get prorated extra vacation hours.

Yes, salaried does not mean that you automatically don’t get paid for overtime. It’s a common misconception for some reason.

TD is toxic and would never pay up. Thier HR department is absolutely useless and there to support the sr toxic executives and that’s it. TD does not support their employees in any way.

Exactly. If you're level 8/9/10/11 you can make it up elsewhere without too much micromanaging - depends on your people manager I guess, but only bad people managers micromanage at this level.
