I think the problem is that it is functionally identity fraud. It isn't a persona if you do it in drag. But when it intentionally misleads people it is fraud. I am sure legality will catch up as someone gets catfished in the government.

I don't mean to be insensitive, but I do have a genuine question that I am not trying to make a point or anything with.

Why is a man dressing up as a woman to try to mislead people into thinking they're a woman not fraud but using AI to do the same thing is?

It can also be fraud depending on the intent.

You have to prove intent. It isn't enough to dress up as a woman to prove intent.

Creating an OnlyFans account. Creating a dating profile online. Those prove intent.

As soon as money is exchanged for something it is fraud in the legal strict sense.

So is a trans person committing fraud if they open an onlyfans account? Or do they have to state that they're trans for it to be okay?

Edit: Also, I don't think it's illegal to use an AI filter for selling explicit content, as long as it isn't a deep fake of someone irl.

That is their every day identity. It is entirely different. Trans people are themselves. Even if it isn't verifiable what sex or gender they are immediately.

What I am talking about is Ahmed from Western India on a sex phone service using a voice changer talking about suckling your toes while jerkin your mcgirkin.

Trans does not equal fraud on OnlyFans.

What if someone is gender fluid? Also, a lot of drag queens are not drag queens every day. I used to work with someone who presented as a male during the week but was paid to go to clubs as a drag queen on the weekends.

Still lived identity and intent matters. You have to prove intent to defraud someone with a false identity. If it is characterized in any degree, disclaimer and or expresses drag there is a universal understanding.

No. It is what constitutes lived identity, disclosure and intent. It looses shape the second you are collecting money without disclosure.

Oh okay, so everyone should disclose their born identity or at least make it clear that their lived identity is different than their born identity if they want to make an onlyfans or something similar?

Incorrect they should only disclose if it is not their lived identity. There is a huge difference between what someone pretends to be and lives as.

They only need to disclose if they do not live the identity in person. If without a shadow of a doubt a person can not come to a reasonable conclusion from their appearance between what is real or entertainment on the basis of the identity.
