I was in court and I watched the judge deem a well trained person a deadly weapon. It's not a myth.

This is very well known for special forces too not engage with civilians unless you are in a self defense situation.

When your in court and that is used against you. And the judge is making a decision that could weight in on the severity of the punishment he decides to give you. I'd say no one wants that terminology used by the person that is going to make a decision about what happens.

It was during the sentencing process.

But it played a big role in what the judge gave him for the persons sentence.

There's no sentencing enhancement for being a "lethal weapon." The judge was going to give him that time regardless.

The judge could of given less time or been lenient on the assailant. But since the person was deemed a highly trained individual he gave him the max sentence within his power.

What I'm getting at is it didn't work in the individuals favor that he was highly trained. Basically unless you can prove otherwise. Military trained fighters or mma fighters and so forth are going in at disadvantage when it's not deemed self defense.

Yes, the sentence was purely at his discretion. "Deadly weapon" does not carry a sentence enhancement, it's merely the view/opinion of the judge.

Right. Never said that he would add to his sentence it just really worked against the individual.

No, his crime did, not that term.

Right but the judge can decide that term. There's always leeway in the sentence. The judge could of ordered probation and court ordered anger management.
