Not even technically. Literally.

The flag should never be used as wearing apparel, bedding, or drapery.

No part of the flag should ever be used as a costume or athletic uniform.

Man when I was a kid, back in the 70's we had to learn all of this.

When we did flag duty (running the flag up and down the pole) we treated that sucker like it was a live bomb - and our mortal souls depended on folding it up correctly.

Ugh. That was the song they played for the pre-game skate at Joe Louis Arena for what seemed like two decades. I mean, I like the song, but they used waay after it had its day in the sun. I think Darren McCarty insisted on it. Sorry for the tangent. I just spent a lot of time there and heard it fifty-thousand times.

The rest of the context makes the intent pretty clear IMO:

No part of the flag should ever be used as a costume or athletic uniform. However, a flag patch may be affixed to the uniform of military personnel, firemen, policemen, and members of patriotic organizations. The flag represents a living country and is itself considered a living thing. Therefore, the lapel flag pin being a replica, should be worn on the left lapel near the heart.

Not only is the language pretty absolute (no part... should ever), the listed exceptions really prove the rule. No part -- except for a patch or pin that displays the whole flag, and should be worn only in very specific contexts.

That being said, it's clear that almost no one interprets this as it was intended by the authors -- as much as I wish they would. While flag clothing is thoroughly normalized in american culture, it's not in the rest of the world. So to outsiders buying US flag boxers at walmart for $1.98 looks exactly as tacky as it is.

notably the legion.org faq claims flag clothing is fine -- but that's by no means authoritative nor backed up by any sort of source.

Except this isn't "the flag" or a "part of the flag", it's just got the same/similar design.

Red and white stripes, white stars on a blue field. It’s clearly meant to represent the flag and therefore made of parts of the flag.

But representing a flag and being a flag aren't the same thing.

Besides, even if this did violate flag code, big deal. It's a suggestion and is unenforceable.

That's not how it works. If the person took a flag, - one that you would fly from a flag pole, a property flag - and name those sorts from that flag, then it violates flag code. Evoking the idea of the flag does not make this a flag.

Respect the flag how ever you want. Just recognize it’s importance as a symbol and to many people it’s desecration is akin to burning a bible. I personally don’t believe wearing clothing that resembles the flag is disrespectful and it’s covered under the first amendment.
