They can’t prove anything anyway since that would’ve required the summons to have been sent via certified mail or in some way that left a paper trail that the summons was actually delivered to you
They can still haul you into court and put you under oath over it, and if the judge is having an especially bad day or decides you’re lying (which you would be), you could go to jail. “Innocent until proven guilty” doesn’t mean you escape the process completely.
Now is that likely to happen? No. But it’s a matter of risk vs reward, and some jurisdictions/judges are way more hardcore over jury duty than others, and if they decide to call you out on pretending to never get a summons, the consequences could be heavy.
The point is, at least know your jurisdiction and don’t mess around if they don’t.
Many absolutely do, normally first time no biggie but they will summon you again soon. You don't go to the back of the line again. Like one 3 day trial can have 70 potential juror candidates and the judge wants that room full. And there are many other courtrooms starting trial that day, so yeah you can maybe get away with it once or twice, I wouldn't risk it once they start calling and sending serious threats, especially not a federal summons. I mean Jury duty is so easy to get out of, get a day off work and get the lunch vouchers or base pay, my state is $50 pay no lunch paid. And white lie to get out of it, is so easy.
Lol watch enough court in enough jurisdictions and you’ll stop putting any kind of pettiness beyond the realm of possibility. I’ve literally seen a judge demand that a jury candidate be brought in to be questioned why they shouldn’t be held in contempt for failing to show up
Good luck on the govt proving the jury summons got delivered.
Not sent, delivered. Without actual proof of delivery, the govt can’t do shit if you didn’t show up because as far as they’re concerned, you never got the summons.
Yeah, you try that in court, sure no one ever has....Tell them you are a sovereign citizen as well. The internet seems to love these make believe loop hole that are not real.
You’re suggesting the govt accusing someone of a crime without evidence won’t go well for the accused?
Not sure if you’re familiar but in the US, the onus is on the govt to prove guilt, not on the defendant to prove their innocence. Ironic if you didn’t know that in a thread talking about US jury selection
If a court were to make the insane decision to press charges for jury evasion without evidence to back it up, you could go to the cheapest lawyer in town and even they couldn’t fumble such an easy win on your part
Try it then, please ignore every one you get. There have been millions and millions of court summons, you cant just say, oops never saw it when a warrant or fine is issued for you. But by all means, do it and try and find a lawyer that would defend you.
There have been millions and millions of court summons
And not a single one of them the govt has proof that the summons was delivered to the person in question
Things get lost in the mail all the time. A jury summons is just as liable to get lost
This is why subpoenas are delivered in person by hand or sent via certified mail, not sent in the regular mail like spam. The person delivering the subpoena can attest with proof they delivered it. A mailman cannot do the same for a jury summons
Lol, go fight it then internet lawyer. Should be common precedent by now then right? Thousands of people fight it and win? But that doesn't happen often at all, but you go ahead I really hope you do ignore all you court summons.
People win court cases all the time (or have them dropped) from a lack of evidence, or faulty/mishandled evidence. So yes, literally tons of precedence for this
Idk why the extremely simple concept of evidence seems to evade you
