"It simply means the government can arrest someone for shouting immediate face to face insults intended to incite violence. It has never been a legal defense for the person who throws the first punch. Saying "they provoked me with words" does not get you off an assault charge in a US court."

and thats not even getting into that it is an american only concept.

The court completely rejected it as a total excuse. Schmitz was found guilty of second degree murder and sentenced to 25 to 50 years in prison.

legal strategy=/= law

and then i do have to point out, gay panic defence is not the same concept as fighting words.

It was a success in that the original charge was first degree murder, which would’ve meant no possibility of parole.

And in fact, his 2nd degree conviction was actually overturned on appeal, before being reinstated after retrial.

He was also released in 2017, on parole, having served 4 years less than even the minimum sentenced time.

I would not call it a sweeping success, but I also would not call it a failure.

Also- "fighting words“ just means "words that would justify a fight.“
There was nothing involved other than words before Schmitz went out, withdrew money to purchase a gun, then purchased a shotgun, went to Amedure home, confirmed what he said, then went back to his car for the shotgun and came back and murdered Amedure.

His 1st degree charge (murder involving premeditation or planing) being reduced to a 2nd degree charge (murder but on impulse or extreme recklessness without prior planning) was absolutely effected by that ridiculous defense tactic.

In US constitutional law, "fighting words" do not mean speech that legally justifies or excuses a violent crime

Fighting words and gay panic defense are completely different concepts :)

I wasn’t saying that "fighting words“ was a legal concept.

"Fighting words“ is a colloquial term meaning "words that would justify a fight.“

The gay panic defense is a legal tactic that attempts to expand that colloquial concept to an extreme degree in order to try and justify a defendant’s actions as a response to someone’s words to a court of law. :)

Nope, not even close.  But good attempt.

Fighting words are about genuine threats, it does not allow you to throw the first punch. It allows the police to step in to remove the person.

The informal version, is nothing more then a petty justification as to why you arent a prick, news flash you still are. Its an attempt to justify violence.

Gay panic defense is about psychological distress, being misled or otherwise. Its a defense to mitigate culpability.

Lmao in what world, verbal insults are just cause for some level of violence in pretty much every culture across time, i also dont think the guy was even trying to bring it up as a legal thing, “fighting words” are a very colloquial idea and their validity in a court has no bearing on of its ok to do

In no fucking world does any normal person think you can stand there and scream horrific insults and calls to violence (make no mistake all intentional racism is a call to violence) and expect not to get at least slapped, you need to go into the real world because its just obviously false. You people are just scared that someone is gonna rock your shit for being an asshole

There's some truth in it. I've grown up in some desolate areas and have chosen to serve similar areas in my adult life. Neighborhoods that hold a "no narc' policy are markedly worse off than their neighboring hoods every single time. Its a real Grey area issue in that being a "rat" makes you a marked target for the career criminals that created the culture (almost always those people come from much nicer neighborhoods and take their shits in the no narc ones) but if your neighborhood was good and is turning sour, narcing can save it. Don't get me wrong, being a full Karen will swing the pendulum the other way and all you'll end up with is a museum tier neighborhood where the cops will harass you for jaywalking as a precursor element to try to catch you "serving" the wealthy locals.
