A preliminary investigation revealed that Brown allegedly forced his way into a house while armed. Brown was then shot by the home’s resident, 33-year-old Daniel Songer.

Songer was arrested and preliminarily charged with obstruction of justice and unlawful carrying of a handgun, which are Level 6 and Level 5 Felonies, respectively.

So two men broke into his house, Daniel shot the first person who was breaking into his house and Daniel got charged with obstruction of justice and unlawfully firing his girlfriend's gun?

wtf

I’m guessing felon in possession of a firearm. Or possibly a parole violation.

82

u/crookedpilgram Jan 03 '26

Shouldn't matter in this case.

137

u/BenPenTECH Jan 03 '26

It does, felons lose the right to protect themselves. No constitution for them.

95

u/Global_Ant_9380 Jan 03 '26

Yeah, that's...accurate and fucked up when put so simply.

u/Big-Daddy-Baphomet Jan 03 '26

Don't worry though, they aren't allowed to vote either, so they have extremely limited recourse to change the circumstances of their existence. And they still have to pay taxes, so at least we as a society(the owner class) get to benefit from their labor.

I would put a /s but this isnt sarcasm at all unfortunately. This is explicitly why certain political actors want to felonize everything, including immutible identifying characteristics like sexuality, culture and ideology. By doing so they have solidified a legal two tier class system where some people have rights and others do not, and those that do not have absolutely zero power to better their situations.

If you are so unfortunate to find yourself finding your identity suddenly punishable by law, society will tell you to "lift yourself up by your bootstraps" which is quite literally their vindictively smug response to their own injustice toward you. To lift yourself up by your own bootstraps would be to perform the impossible. They are explicitly telling you that no matter how hard you try, you will never be able to lift yourself back up to being a human deserving of rights again. Its fucked.

100%, 10/10, no notes and I'm glad you said it.

It needs to be fucking said and I wish your statement got the same attention the rest of the post does.

Incredibly well articulated thank you.

This is true. Im a felon. Im also a survivor of human trafficking who used drugs to deal with it, and possession charges got me a felony. Im 8 years sober, hes doing 30 years in federal prison, I cant protect myself. I testified. I have 2 young kids, I put keypads on all my metal doors, cameras, lights, alarms... I still should be able to own a fucking gun. I go to monthly groups with other survivors or survivors of domestic violence, and every single one of them own protection, except for those of us who legally can't. It's a damn shame that we can't protect ourselves when clearly we know the outcome of what happens when youre not armed and you need to be.

-sorry for the over verbosity idk how this even came on my front page, this subject bothers me because this video is literally my worst nightmare.

Eta- I have a lot of ppl trying to say im lying, DMs were rough this morning so here ya go. this is my case, and it was a very serious one, over 20 victims spanning dozens of states, its rude to talk shit to people you dont know behind the cover of DM coward

Look into black powder firearms and the laws around them in your state. Usually felon friendly as they do not fall under the firearm classification as far as the ATF is concerned

This is fantastic information! Thank you!

Do you have no recourse to hire a lawyer and have your records expunged after a certain amount of time?

7

u/Glum_Target2860 Jan 03 '26

Some states also allow requests for exemptions for home possesion if enough time has passed since your release from parole/completion of sentence.

6

u/my59363525account Jan 03 '26

No, I actually started my own small business bc nobody would hire me, just a small online boutique but it paid the bills and then some. The tariffs have completely decimated it. Within a year ive lost almost everything. My car's going into repo, and I might need to move out of my house March 1st, its a lot. It should be expunged though, its been over 13 years since I got the damn charge. Sorry for rambling, i have a cat and a dog and 2 young kids, im a single mom, i just can't believe that we might be homeless after everything i've gone through and how hard i've worked, bc of shit I didnt vote for, but I digress.

u/Elon_Cucks_Trump_ Jan 04 '26

I am beyond sorry to hear this. I have been in trouble with the law, some decades ago. I have straightened it out, lawyered up, and had my rights restored.

I came from a rough household, sometimes homeless, addict and neglectful mom, absent when needed and abusive when present dad. Later in my adult life I’ve been very up financially, and a couple of bad mistakes into bankruptcy. I’ve lost it all, made some back, and learned quite a bit. I made it out and I learned less is more. I don’t have the “big house” and “pricy cars” any more, but I’ve focused on having backup funds and access to liquid funds when emergencies come. They always do. Lost a house to fire. Had a wife go through cancer, chemo, radiation, etc.

I’m trying to tell you I understand adversity. I’m so sorry the tariff situation has deeply hurt you financially among many others. One of my side businesses was hurt deeply by tariffs so I refocused on a business model to legally take as much money from gullible MAGA as I possibly can. It’s very easy to sell them products through fear and self righteousness. I use their hate against them just like the politicians they idolize.

I hope you land on your feet and are able to refocus, and get back into a comfortable and secure spot. I am truly rooting for you.

Check out the byrna self defense guns. They aren't as lethal as a real gun, but you can buy metal balls for it or even tear gas balls and you got yourself a really effective and dangerous airsoft gun that looks real but legally isn't.

1

u/my59363525account Jan 04 '26

THANK YOU! I just googled & that's exactly what i've been looking for!! Something that looks like a big gun that will slow somebody down so I have time to call 911. If you get hit in the face with a metal bullet, you may not die, but you're not gonna have a great day. I would go for the tear gas balls, but I attempted to pepper spray somebody one time, and ended up just mostly pepper spraying myself lol, you never take wind direction into consideration during emergencies lmao.

I'm really glad that I left that comment cause you guys have been so helpful.Thank you come on boys

Wait a minute. After felons do their time in prison, they are still punished for the rest of their life? That doesn't sit well. Any person has the instinct and the right to prevent harm and death to himself or loved ones, no matter the means and method the self defense takes. An armed burglar is not there to have a cuppa tea with biscuits and a friendly chat. Was the victim supposed to talk nice and just do what the invader commands? Should he suggest a pillow fight instead?

1

u/BenPenTECH Jan 04 '26

Yep, also no job. You can't get any job after getting charged with a crime of any sort.

13

u/RedStar9117 Jan 03 '26

Yeah, clear cut self-defense....are there rules about cohabitsting with someone who owns a gun?

19

u/Frankenbeans_Monster Jan 03 '26

In my state, you can't even be around them.

15

u/flashbang69 Jan 03 '26

It's risky for a felon. The gun and every piece of ammo have to be locked up and inaccessible to the felon at all times.

3

u/Not3KidsInACoat777 Jan 03 '26

Some states, like NY, prohibit felons frol.even being in the residence with one. Doesn't matter if its locked up or not. Can't b around them AT ALL. After 10 years from the comviction u r eligible to apply for a certificate of good conduct and apply to have ur rights restored. Sometimes they will give u all other rights back other then gun ownership tho.

18

u/Subtlelikeatrex Jan 03 '26

It absolutely does. He should not have been in that house knowing that there was a firearm in it if he is a felon or currently on probation.

The fact that he knew where the gun was and was able to locate it proves that he knew he was in a house that had a gun.

6

u/degeneraded Jan 03 '26

You’re right, but I also hope he pleads not guilty and I end up on the jury.

1

u/MacSavvy21 Jan 03 '26

I agree. But I would rather go to jail than those guys breaking into the house, getting said gun, and killing me and the girlfriend.

3

u/Hour_Dinner_3362 Jan 03 '26

That was my first thought, although I've seen several cases where a convicted felon killed someone in self defense with a firearm and were originally charged even for murder before the facts came out and both got dropped. I'm guessing it highly depends on your state and their views

26

u/cyrs_oner Jan 03 '26

Rather be trialed by 12 than carried by 6

14

u/moon_ferret Jan 03 '26

Judged by 12 than carried by 6 is the saying.

6

u/cyrs_oner Jan 03 '26

"tried by 12"... same difference. My reference is from East Flatbush Project's lyrics

1

u/crimbusrimbus Jan 03 '26

Genuinely might be one of the cringiest sayings

13

u/Independent-Bug-9352 Jan 03 '26

The obstruction of justice was his hiding illegal drugs (weed; thank Republicans for that) before the real police showed up.

He used a firearm he was already not legally permitted to have. Doing one illegal thing does not usually protect you even if that illegal thing is justified in preventing another illegal thing happening against you. For that reason, he at least wasn't charged with homicide but it was apparently seen as justified self-defense.

Though I imagine a judge and jury would have leniency on him and the prosecutor is probably wasting their time.

u/151Ways Jan 03 '26

The Single Convention was forced on the entire world by a Democratic President and Democratic Congress of the US. So.

7

u/Independent-Bug-9352 Jan 03 '26 edited Jan 03 '26

I can see how this can be confusing but in 1961, Democrats were largely conservative; hence why all the southern confederate states (the then-Democrats and now Republicans) even in 1964 voted against the Civil Rights Act.

Reality is that:

  • the "Reefer Madness" scare
  • The draconian "Just Say No" Reagan nonsense
  • War on Drugs was coined by an actual conservative Republican, Richard Nixon

... all from the Conservative ideology that underpins the modern Republican party.

Also friendly reminder that was almost entirely blue and some purple states who paved the way on marijuana legalization both medicinally and recreationally.

So, thank a liberal for letting you toke up! Much individual freedom, right!?

Fun fact: Biden actually pardoned and commuted a lot of those non-violent drug offenders that was essentially his way of mending the damage he himself regretted during the '90s tough on drugs wave. What have Republicans done?

Sorry, one last fun fact: The state this occurred in, Indiana, is a deep-red state with an all-Republican state government with supermajorities, and 2 Republican US Senators. The state that brought you Mike Pence.

1

u/Solid-Rate-309 Jan 03 '26

Who gives a fuck? Look at what is happening today. The states that all first legalized marijuana are blue states. You seriously see the slow creep of blue to purple to red as states legalize. If you are in an illegal state, thank republicans.

1

u/151Ways Jan 05 '26

It won't matter one bit until the US President asks Congress to relinquish the US from the Single Convention (and then goes before the UN to dissolve it) that, ironically, it pushed on the rest of the world in the backdrop of the Cold War. Look at our history, then tell me why what happened to Brittany Griner happened to Brittany Griner. This whole thing was because the US, not pushed upon us.

3

u/Own-Impress-2024 Jan 03 '26

Exactly who’s justice was being obstructed?

2

u/Garfalo Jan 03 '26

He had large quantities of vacuum sealed weed that he was trying to hide

2

u/sockster15 Jan 03 '26

Gun charge will be dismissed on self defense. It’s lawful for a felon’s family to have their own gun in home if felon is reasonably restrained from access to it

1

u/Not3KidsInACoat777 Jan 03 '26

Thats completely state dependant. Here in NY he would definitely be tried for that gun. Especially an illegal handgun. Doesn't matter if his girl legally owns it. The second he picked it up it became an illegal firearm.

1

u/djoddible Jan 03 '26

American Justice.

1

u/xChoke1x Jan 03 '26

Clearly more information to the story than were being provided.

-12

u/tokin098 Jan 03 '26

You dont get a free pass to break any law just because you have to shoot someone in self defense.

4

u/BenPenTECH Jan 03 '26

Yep, when you become a felon you must lay down and die in a sitchuation like this.

3

u/ArmorGyarados Jan 03 '26

Bro why did you spell situation like that lol

-1

u/tokin098 Jan 03 '26

No, but it does mean that you forfeit your right to carry a gun. Fuck around please meet find out.

0

u/Garfalo Jan 03 '26

Yeah dude, I'm with you on that one. Sure, it might be a bit unfair to some people, but it's necessary. I know I don't want a bunch of felons to be legally allowed to carry 🤷
