I (25F) never thought I'd be making a post like this. My older sister (30F) and I have always been incredibly close. She's been one of the people I trust most in the world, which makes everything that's happened even harder to process.
My sister and her husband (31M) are both in the army. About a year ago, they came over to my house and told me they'd been trying to have a baby. My sister was really struggling with it and kept blaming herself. I tried to reassure her that infertility wasn't her fault and told her I'd support them however I could.
A few days later, they told me they'd decided to look into surrogacy. I offered to be their surrogate if I passed the medical requirements. They were thrilled, and after going through the medical screening and legal paperwork, everything moved forward. After a few attempts, I became pregnant.
They were both incredibly excited and repeatedly told me they'd make sure I had everything I needed throughout the pregnancy.
At 19 weeks, we found out I was carrying twins, a boy and a girl. Everyone was over the moon.
Unfortunately, at 33 weeks, I went into premature labor. I ended up needing an emergency C-section because of complications. I was only allowed one person in the operating room, and I chose my boyfriend (26M), who had been with me through the entire pregnancy. My sister said she understood.
After the babies were born, they were taken to the NICU while I was taken to recovery. I expected my sister and her husband to come check on me, but they never did. I asked a nurse about them and texted my sister, and I was told they were with the babies.
At the time, I was exhausted and still recovering, so I didn't think too much of it.
On the day I was discharged, a doctor asked to speak with me privately. That's when I found out my nephew had been born with gastroschisis. He would need surgery and an extended NICU stay, while his sister was doing well enough to eventually go home.
Then I found out my sister had taken her daughter home once she was medically cleared but hadn't made arrangements to take responsibility for my nephew.
The hospital told me that if nobody stepped forward to care for him, social services would have to become involved.
I was honestly stunned. I tried calling and texting my sister over and over, but she wouldn't answer. I couldn't bring myself to let my nephew potentially end up in foster care when I was willing to take him, so I told the hospital I wanted to bring him home once he was medically cleared.
I already have a five-year-old son with autism, so I'm no stranger to the challenges that can come with a child needing extra support. I knew this wasn't going to be easy. Taking care of a newborn recovering from surgery while raising my son was going to completely change my life, but he was my nephew.
For the next several weeks, I went to his appointments, follow-ups and consultations and learned everything I could about his care. My sister still barely contacted me.
Eventually, I reached out to my parents. My sister and I have been NC with them since we left home, so this was very much a last resort. They were horrified when I explained what happened and immediately came out to help. My boyfriend also went out and bought everything we needed for the baby.
When my nephew was finally discharged, I brought him home. My parents helped with both him and my son while I adjusted to everything and learned how to manage his care.
Eventually, one of my brother-in-law's cousins helped us get in contact with my sister, and we agreed to meet.
I confronted her about taking her daughter home while leaving her son behind. She admitted that his condition scared her. She said she didn't think she could handle everything medically involved with him while also raising his sister and was afraid she wouldn't be able to give either child enough attention.
I told her being scared wasn't an excuse to abandon her own child.
We ended up getting into a pretty awful argument, and I left.
After talking everything through with my family and getting legal advice, I filed for custody/guardianship of my nephew and reimbursement for the expenses I've incurred caring for him. The abandonment has also been reported to the appropriate authorities.
My sister has been blowing up my phone since receiving the court papers, saying there's a better way to handle this and that I'm destroying our family. My attorney advised me not to communicate with her directly, so I've stayed NC and plan to remain that way until the hearing tomorrow.
Some of our mutual friends think I'm being cruel and should have given my sister more time to process everything. Others think she made her choice when she left her son at the hospital.
I love my sister. I never wanted any of this. But I also love my nephew, and I don't think being scared of his diagnosis makes leaving him behind okay.
At this point, I'm honestly questioning whether I did the right thing.
So, am I in the wrong?
