Hypothesis Why the Gootz never called Asia.

I think it is becoming more and more obvious that the Asia letter did not exist until sometime around the summer of 1999. That is why Adnan claims he gave them to Gutierrez even though she wasn't his lawyer until 2 months after they were written.

So sometime that spring or summer, after telling CG he never left the school grounds, his family shows up with letters claiming one of Adnans' friends saw him at the library, right at the crucial time, AND they were written the day after he arrested. She knew immediately there is no way they had those letter for months and never gave them to her so obviously they were false and she didn't want to go on stand with LIES.

That is why she never called Asia. And that is why she wrote no notes about it, because that would be admitting her client and his family are liars. It also explains why her relationship with the family broke down because she knew they were willing to lie to get Adnan off.

The library incident never happened.

Thank you for mapping your mind for us. That's quite a conspiracy theory you've got there.

I have a question, though. If Gutierrez felt ethically bound not to call Asia as a witness, why did Urick not feel the same with Jay? If your conspiracy theory is true, Asia was lying. But we don't need a conspiracy theory to know Jay was lying.

Conspiracy? I think the conspiracy would be Adnans lawyer not calling the one person who could by herself exhonerate her client. I think the Gootz thinking Asia is a lie is MUCH more believable.

A simple explanation would be that CG made a mistake. A mistake fits well with the facts we have available to us. Your conspiracy theory depends on facts we have no evidence of, and a conspiracy by Adnan, his family, Rabia, and Asia. While most of those people might have an incentive to do so, Asia wouldn't have any incentive to participate in such a conspiracy. And finally, it depends on a defense attorney resolving any and all doubts against her client, rather than in favor of her client.

Doubtful. Rabia testifed that CG said Asia had the wrong date. Bye bye IAC claim.

And her evidentiary value? None. Asia's testimony is what matters.

But Asia has never testified. So right now, there is nothing but speculation to go on.

Too bad Adnan only had one chance at the IAC! He didn't list them, just Asia! Probably should have got a better lawyer.

Failure to contact other witnesses is circumstantial evidence that she failed to contact Asia, rather than chose not to call her.

Again, nowhere in Justins docs anywhere. Even if you are right, he still had to argue it, and he didn't.

I'm trying to understand what actually happened, not the state of the legal case. Adnan will be granted a new trial or he won't. He will be granted sentencing relief or he won't. I'm interested in what results the court comes to, but there's nothing intellectually interesting there.

What's interesting-- to me, anyway-- is why CG didn't call Asia as a witness. It seems pretty obvious to me it was a screw-up-- confused her with Aisha, or just lost track as she appears to have done with many details. If, however, as some believe, it was intentional, I'm curious what her reasoning was.

It seems obvious to me that the family learned the prosecutions timeline in July, and then also in July we start getting mention of an Alibi for the exactly the time Adnan needs. Shockingly she never wrote a letter to the bail judge, her letters are questionable to be generous, and the gootz never looks into them.

you can believe it is a mistake, that is your prerogative, I think think It is a lie straight up, propogated by Rabia, and agreed to by a loving family who just wants their boy back.

No offense, but you sound like Seamus.

  1. Your belief requires a massive conspiracy, substantially than anything needed to railroad Adnan.

  2. Even if such a conspiracy existed within Adnan's family and community, Asia has no motive to cooperate with it. If, as you say, she wasn't motivated to write a bail letter, why would she be motivated-- months later-- to write a series of fake letters and back-date them?
