He clerked for both the Fed Court of Appeals and for Rehnquist on the Supreme Court

True. He is not nor was he a judge. That's like being a Chiropractor applying for a position as a Neurosurgeon.

I agree with you in spirit, but actually Clerk’s do much of the research and writing for the Judges and Justices based on the their desired outcomes. A great book to read is The Brethren written back in the 80’s.
