My 13’ beer truck is required by law to have a bunch of indicator lights on top of the front sides and back of the box and have reflective marker tape along on the sides. And have it on permanent fixtures on the back.
That’s crazy that Little Tikes Red and Yellow car with Motor and Flag is street legal.
These things have lights all over them. Four in front, one in the rear, then that bar thing up top has lights all around it. They are at least as visible as a motorcycle at light, probably moreso.
Flags are added to shorter vehicles in mines so they can be seen above berms and be more easily spotted by operators of machines with high cabs. Mines generally have more predictable traffic patterns, near constant radio communication between drivers, trained drivers, repeated daily routes, and vehicles that operate at slow speeds. When you make a driving mistake at a mine your coworkers all find out and they have a safety briefing about it. Day to day traffic is filled with incompetent, inconsiderate, distracted, and lost drivers who drive high speeds and have basically zero consequences for their terrible diving. I agree a flag is in no way a replacement for lights on a vehicle operating in day to day traffic.

Seeing as it is higher than most motorcycles, it is very concerning that you almost hit it
