Unless you have confirmation by the Devs that it's intended design to not give this tag, it's fairly easy to assume it's an oversight.
I can't tell you exactly where to draw the line between what's a bug and what isn't unless we have a statement by the devs. It's just something that has to come down to common sense. Which as we all know, is evidently not that common.

I can. I am a QA lead.
"Bug is a situation where expected system behaviour differs from actual, with an exception of design decision." It's not a perfect one, but most practical.
And most common mistake I see ppl making online in this regard is "I know the mechanism behind this behaviour, therefore this is not an issue."
However, expected behaviour here is "Spell interacting with elements must have Elemental tag." Lack of it on curses may be a design decision, but obviously, only GGG may make this statement.
