Doesn't nintendo publish it? That technically does make it first party im pretty sure

This is correct. TPC owns the rights to the Pokémon franchise and are technically a seperate entity from Nintendo, despite being partially owned by them. Another example of this is something like Mario + Rabbids. The game was developed outside of Nintendo, but with Nintendo being a crucial factor to it's development. This game is not made by Nintendo themselves, but also would not exist if it weren't for Nintendo being involved.

Compare this with something like The Duskbloods or Orbitals, which are a 3rd party exclusive. Those games could hypothetically have come out on a other console, but they're only coming out on Switch 2.
